Would require the DOJ to issue guidance on how federal prisons should promptly notify families of incarcerated individuals who become seriously ill or pass away in prison. o   Litigation §  Criminal legal reform advocates scored a win in Michigan recently, when the MI Supreme Court ruled that mandatory / automatic life without parole sentences for 19-20 year olds convicted of murder are unconstitutional. o   Executive Branch Actions: §  Earlier this year, the DOJ froze work on police reform and other civil rights cases. Now, (in the absence of DOJ leadership on these issues), the burden has shifted to local governments to take action. o   Keep on Your Radar: Trump's “Opening Salvo” in His War Against Criminal Justice Reform Starts With This Nonprofit §  The Vera Institute of Justice, a major criminal justice reform nonprofit, had all five of its federal grants—worth about $5 million—abruptly terminated by the Department of Justice under Attorney General Pam Bondi, a key Trump ally. §  Evaluate your funding sources, and make sure you're not overly dependent on any one source.   ·      Non-Lobbying Advocacy o   Nonpartisan Advocacy 101: 501(c)(3)s cannot support or oppose candidates for public office, but they can… o   Educate the public about issues of importance to your organization. §  Equal Justice Initiative recently provided education related to the wrongful incarceration and conviction of black defendants in murder cases. Not only did they report on research from the National Registry of Exonerations that black Americans are nearly 8x more likely to be wrongfully convicted of murder, but they noted that they are also likely to spend more years in prison than wrongfully convicted white people. o   Hold a rally: §  Earlier this year, a coalition of criminal justice reform advocates and nonprofits in New Mexico held a rally to call attention to the reality of mass incarceration and to propose common-sense alternatives to harsh prison sentences. o   Initiate or participate in litigation: §  The Innocence Project (AFJ Member) and other members of the Innocence Network, engage in litigation on behalf of wrongfully convicted persons who can be proven innocent with DNA and other types of evidence. o   Fund Advocacy §  Private and public foundations can support organizations advancing their charitable missions through general operating grants and/or specific project grants, ensuring flexibility and sustainability in pursuit of shared goals.   ·      Lobbying o   501(c)(3) public charities are also allowed to use unrestricted funds to engage in some lobbying activities. o   Tax Code Lobbying 101: Public charities can lobby, but they are limited in how much lobbying they may engage in. §  Insubstantial part test vs. 501(h) expenditure test. §  Under either test, lobbying includes attempts to influence legislation at any level of government. §  Track your local, state, and federal lobbying, and stay within your lobbying limits. o   State/local level lobbyist registration and reporting requirements may also apply when engaging in legislative and executive branch advocacy. o   Ballot measure advocacy (direct lobbying) could also implicate state / local campaign finance and election laws. o   Lobbying win! §  In March, DC Justice Lab, an AFJ member, and several other nonprofits lobbied in support of Maryland's Second Look Act by submitting testimony to the Senate Judicial Proceedings Committee. This legislation would permit individuals convicted of certain crimes between the ages of 18 and 25, and have served over 20 years of their sentence, to petition the court to modify or reduce their sentence based on demonstrated rehabilitation. D.C. Mayor Muriel Bowser and the Washington Commanders are reportedly close to striking a $3 billion deal to build a new football stadium anchoring a massive mixed-use development at the old RFK site. It's believed to include at least $850 million from the District for parking and preparing the site, with the team paying to build the stadium itself. And the price tag could raise with an addition of a Metro station. However, not all city officials support using taxpayers' dollars to help finance a home for the Commanders. Ward 6 D.C. Councilmember Charles Allen joined the show to explain his long-time opposition to building a new sports venue at the RFK site. He said the city doesn't need to subsidize a stadium to attract development. "The public investment on this is going to be more than a billion dollars already and I don't think that's a good deal for DC," he said.Allen also said the deal should include moving its headquarters from Virginia to the District.Plus, what could be on the chopping block as D.C. grapples with Congressionally-mandated budget cuts?The U.S. Supreme Court considered a Montgomery County case this week that would allow religious families to opt their kids out of public school lessons with LGBTQ-themed books. It's a case with national implications. Montgomery County Council Vice President and chair of the county's education committee, Will Jawando, got behind the mic to weigh in. He also weighed in on County Executive Marc Elrich's proposal raise income taxes rather than property tax rates. The county-level income tax increase was made possible by a change in the tax structure by the Maryland General Assembly earlier this month. Jawando said he supports the income tax bump."I make $150,000 a year. I'll pay $150 more in income tax next year if this passes. It's $100 per $100,000 in taxable income is the increase. The Maryland General Assembly reconvened for a 90-day legislative session in Annapolis this week. Dominating debate will be a nearly three billion dollar projected budget deficit over the next five years. It's the largest gap the state has faced in two decades, and it threatens investment in transportation, education, and health care. House of Delegates Majority Leader David Moon from Montgomery County joined the show to discuss current negotiations, whether tax increases are on the table, and what cuts could be coming.Plus, Moon shared his concern about the impact of a second Trump administration could have on the state's economy. With cuts to the federal government on the table, there will likely be less federal funding flowing to states for transit,, climate change goals, and education. In addition, Maryland is home to around 160,000 federal employees whose jobs could be at risk. Moon said the state and localities need to prepare.“Maryland and Montgomery County are going to have to try to be a lot more self-reliant in the coming years and do everything we can to broaden and expand our local tax base so that whatever happens at the federal level, we are going to be economically competitive in growing our economy," he said. The Virginia General Assembly also went back into session, though lawmakers were forced to take a short recess due to a water shutoff issue in Richmond. Potential tax cuts, constitutional amendments, and data centers are among the items on lawmakers' docket. State Senate Majority Whip and Arlington's state senator Barbara Favola got behind the mic to preview the 46-day session.One of the hottest topics this session is legislation authored Democratic state senator Scott Surovell that could lead to a Tysons Corner casino. Favola said the idea currently does not have the local support in her view, noting the handful of casinos already built around the Commonwealth did."All of those jurisdictions had local officials who were completely mobilized and strongly in favor of having the casino," Favola said. "And we know these jurisdictions really did need a different venue to bring in money, to employee people, and to get back on their feet. That's not the case with Fairfax County."If passed, the bill would give voters in Fairfax the chance to decide on whether or not to build a new casino. Back in 2019, the Maryland General Assembly created the Prescription Drug Affordability Board. Their goal? Lowering the cost of drugs for Maryland residents. The board faced several barriers in the past couple years, including a veto from former Gov. Larry Hogan. But in 2023, Gov. Wes Moore signed legislation reaffirming the board's cost-reduction tools. And this year, the board is reviewing six drugs for potential cost-reduction efforts. So, what is next? Dr. Gerard Anderson is a member of the PDAB and director of the Johns Hopkins Center for Hospital Finance and Management. He is also a professor of medicine at the Johns Hopkins University School of Medicine. Midday host Tom Hall speaks with Jim Brown, president of the Poolesville town commissioners, about last night's storms. Then, there are new laws on the books. The Maryland General Assembly passed 1,053 pieces of legislation during the 90-day 2024 session. Several laws created from those bills went into effect on June 1, including harsher penalties for street racing and changes to Baltimore city's charter. Other changes include a new tax rate for abandoned homes in Baltimore, which lawmakers hope may help cut down on the number of vacant, unused properties. In today's installment in our series of Conversations with the Candidates, we talk with State Senator Clarence Lam, a Democrat who is one of several members of the Maryland General Assembly running for U.S. Congress in the 3rd Congressional District.  Senator Lam is in his second term representing District 12 in the state Senate. When he was first elected in 2019, the district included parts of Baltimore County and Howard County. After redistricting, he now represents Anne Arundel and Howard counties. He serves on the Finance Committee, and he chairs the Joint Committee on Fair Practices and State Personnel Oversight. He is also the Secretary of the Maryland Legislative Asian-American and Pacific Islander Caucus. Prior to his election to the Senate, he served in the House of Delegates for one term. In addition to his legislative work, Dr. Lam is the Director of the Preventive Medicine Residency Program and an Assistant Professor in the Department of Health Policy and Management at the Bloomberg School.
