All too often, capitalism is identified with the for-profit sector. However, one organizational form whose importance is often overlooked is nonprofits. Roughly 4% of the American economy, including most universities and hospital systems, are nonprofit.One prominent nonprofit currently at the center of a raging debate is OpenAI, the $300 billion American artificial intelligence research organization best known for developing ChatGPT. Founded in 2015 as a donation-based nonprofit with a mission to build AI for humanity, it created a complex “hybrid capped profit” governance structure in 2019. Then, after a dramatic firing and re-hiring of CEO Sam Altman in 2023 (covered on an earlier episode of Capitalisn't: “Who Controls AI?”), a new board of directors announced that achieving OpenAI's mission would require far more capital than philanthropic donations could provide and initiated a process to transition to a for-profit public benefit corporation. This process has been fraught with corporate drama, including one early OpenAI investor, Elon Musk, filing a lawsuit to stop the process and launching a $97.4 billion unsolicited bid for OpenAI's nonprofit arm.Beyond the staggering valuation numbers at stake here–not to mention OpenAI's open pursuit of profits over the public good–are complicated legal and philosophical questions. Namely, what happens when corporate leaders violate the founding purpose of a firm? To discuss, Luigi and Bethany are joined by Rose Chan Loui, the founding executive director of the Lowell Milken Center on Philanthropy and Nonprofits at UCLA Law and co-author of the paper "Board Control of a Charity's Subsidiaries: The Saga of OpenAI.” Is OpenAI a “textbook case of altruism vs. greed,” as the judge overseeing the case declared? Is AI for everyone, or only for investors? Today's show opens with several versions of Joe Biden assuring the world he knew nothing of his son's business dealings and never even talked about them. Well, as more of the Biden Crime Family is being exposed, the White House is having to massage that line of defense. We have gone from never discussing any business at all, to not discussing foreign business dealings to not being directly involved in business decisions to now being told, Joe Biden was never IN business with Hunter Biden. This is the latest shifting of the narrative and gas-lighting the American people by White House Press Secretary Karine Jean-Pierre. We need to be reminded of that shifting narrative in light of more and more information coming forward. As I mentioned yesterday and as reported by Miranda Devine of the NY Post, Hunter Biden's long-time friend and business partner, Devon Archer, is set to provide testimony to Rep. James Comer (R-KY) and the House Judiciary Committee. If he brings the dates, times and receipts that corroborate the FBI's 1023 form, it only gets worse for Joe Biden. Let's add to it reporting from Margo Cleveland of the Federalist, where the Pittsburgh FBI office admitted to following up on several of the facts in the 1023 form and finding them to be true. So true, in fact, they told US Attorney David Weiss that it was worth further investigation. Investigative journalist and author, Peter Schweizer, whose best-seller “Secret Empires” is about the Biden Family crimes, discussed the implications of the investigations and even said the walls were closing in around Joe Biden. The corruption within the family is so deep, we just learned today that a long-time Democrat supporter and Biden family friend paid over a million dollars to buy Hunter Biden's art and within two weeks was given a cushy position in the Biden administration. Also revealed today is a long-time friend and professional associate, Alexander Mackler just so happened to be working for US Attorney David Weiss during the Hunter Biden 5-year long investigation. Mackler started off as Joe Biden's Press Secretary when he was a senator, then as legal counsel when Biden was Vice President and then was part of the Biden-Harris transition team after the 2020 election. Mackler even managed the late Beau Biden's successful campaign for Delaware Attorney General in 2010. Emails from the Hunter Biden laptop show Mackler had an affinity for the Biden family and fondness for Hunter. Numerous emails go back and forth where Mackler considers himself a “brother” to Hunter. To me, there is no other conclusion to reach than he was a mole working to thwart the Hunter Biden investigation at every turn, while also feeding information to Hunter, Joe and anyone else in on the scheme. The grift and the corruption are so bad, even Democrat presidential candidate, Robert F. Kennedy, Jr. is calling for an investigation into the Biden bribery allegations. It's getting more and more difficult for fellow Democrats to provide cover for Joe Biden. The same will hopefully be said about the Legacy/mainstream media. At some point, they are going to be forced to deal with the reality in front of them. Because we started to learn so much about what the government is doing because of Elon Musk's purchase of Twitter, President Biden made a pretty ominous threat over the weekend. Biden seems to want his weaponized DOJ to go after Musk and take him down. And they are likely to comply with gusto. They are part of the same, un-elected 4th branch of government who is trying to take everything away from you, including all of your home appliances and conveniences. In her latest book entitled, “You Will Own Nothing,” Carol Roth shows us just how far the Marxists in government have taken us and how far they are willing to go. BECAUSE it will “make it more difficult and costly for pregnant persons to be able to receive lawful reproductive healthcare services.” And the Germans try to own the Nazis by scrapping a Nazi-Era law which banned doctors from giving women information about abortions. Except they're behaving kind of like Nazis. If actions speak louder than words, then these abortion-activists just told us two things: The humanity of the unborn is axiomatic and they're just like Nazis. What happens when no one is watching our children?   Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast, Good Law | Bad Law, is joined by Patty Dailey Lewis, Executive Director of the Beau Biden Foundation for the Protection of Children, to discuss a little-discussed consequence of the Covid-19 pandemic: the increased threat to children. With children at home, that means more children spending more unmonitored time in unsafe home environments.  As children spend more time on-line, there is also an increased danger from internet predators.   The Beau Biden Foundation’s mission, carrying on the legacy of the late former Delaware Attorney General and son of former Vice President Joe Biden, is to prevent child abuse and crimes against children through effectively educating adults and children, to develop the next generation of child welfare professionals and to strengthen child protection laws around the country. Aaron and Patty discuss increasing concerns about internet safety and online predators, the growing threat to children in unsafe home environments, the importance of parents educating themselves and their kids, and the crucial role of conversation, expectation, and heightened awareness.   What happens when the eyes of the world aren’t watching anymore? Patty explains that 9 in 10 victims are abused by someone they know or trust, emphasizing that we are all home now as result of the pandemic, and that reporters of abuse often are educators and medical professionals. Patty says that reports of abuse have plummeted… but that doesn’t mean the abuse has stopped but more likely is because teachers and health care providers are spending far less time with eyes-on these at-risk kids. Aaron and Patty talk about what we can do to help children and to stop abuse, as well as the Foundation’s available resources for guidance, education, and prevention.   Prior to her position at the Foundation, Patty served as Deputy Attorney General and Director of the Family Division of the Delaware Department of Justice. A passionate advocate for children, Patty has worked in the field of family and child advocacy since 1985. She has served as a commissioner on the Child Protection Accountability Commission, the Governor’s Steering Committee for the Protection of Children, the Victims Advisory Council, and more. As part of Delaware Debates 2018, Delaware Public Media presents Candidate Conversations in collaboration with the University of Delaware's Center for Political Communication. Delaware Public Media is interviewing all candidates who have filed to run in the races for U.S. House and U.S. Senate, as well as the races for State Attorney General, State Auditor and State Treasurer. Candidates in each race will answer the same set of questions to allow Delaware voters to get to know them and compare them. In the race for Delaware Attorney General, incumbent Democrat Matt Denn chose not to run for another term. That prompted four Democrats to throw their hats in the ring to replace him. Kathy Jennings, Chris Johnson, Tim Mullaney, and LaKresha Roberts will face off in a Democratic primary next month. There is currently no Republican on the ballot after Peggy Marshall Thomas dropped out of the race in mid-August, but state GOP officials say they are looking for someone to step in and run. They have until Sept. 4 to name a new candidate. This is LaKresha Roberts' first run for elected office. She was a Deputy Attorney General under then Attorney General Beau Biden, and has served under current AG Matt Denn as both head of the Family Division and then Chief Deputy Attorney General.

The former Dover police officer and U.S Marshal spend 8 years working in the state Dept. of Justice under then Atty General Beau Biden, including 3 years as Chief of Staff. He was also New Castle County Chief Administrative Officer during the final year of Tom Gordon’s last term in office.

Jennings has more than 20 years of experience in the state Department of Justice, including stints as state prosecutor and Chief Deputy Attorney General. She prosecuted hundreds of cases, including serial killer Steve Pennell, who tortured and murdered five women in 1988. Most recently, she served as New Castle County Chief Administrative Officer under County Executive Matt Meyer before resigning to run for state Attorney General.
