FOLLOW UP: UBER AV FATALITY LEGAL CASE ENDSThe legal case brought against the test operator, Rafaela Vasquez, who was working for Uber in their autonomous vehicle program who was monitoring the system when it hit and killed Elaine Herzberg five years ago, has ended after she pleaded guilty to endangerment. This has resulted in three years probation but avoids any jail time. Of note is that no charges have ever been brought against Uber or anyone else from the company. Rafaela disputes claims she was watching The Voice on her phone, instead stating she was checking the in-company channel on the app Slack, as the Uber had instructed all operatives to do. Remi Lucidi, 30, had a history of climbing various towers around the world whether they be buildings or more obscure structures such as cranes, bridges, pylons or even transmitters. Lucidi, known as ‘Remi Enigma' on social media, had reached the 68th floor of the 721 foot Tregunter Tower in Hong Kong's before his fatal fall. The large and bright 'X' logo that sat on top of the San Francisco headquarters of the company formerly known as Twitter has been taken down. And now, the company will be fined for installing the logo on the roof without a permit. A woman behind the wheel of a self-driving Uber that hit a pedestrian has been in legal limbo ever since. The operator faced negligent homicide charges after a 2018 crash killed 49-year-old Elaine Herzberg. On March 18, 2018, Elaine Herzberg of Phoenix, Arizona was the first person to be killed by a self-driving car. This brought into question the complicated issue of accountability when AI makes a mistake, who do we hold responsible for this type of accident? However, on the other end of the spectrum, if AI produces something marvelous, who takes ownership of this? That is the topic of discussion on today’s episode. Joining me on today’s show is Sekou Campbell, an attorney whose practice focuses on the meeting place between art and technology and his clients have included an AI music composition software company and other art-focused startups. His practice includes intellectual property, media and entertainment, and startups. He is also a partner of Culhane Meadows law firm. In addition to Campbell, we are also joined by Maya Ackerman, an expert on AI and Computational Creativity, she is the CEO and co-founder of WAVE AI, that allows anyone to create original songs in minutes using its AI-based tool ALYSIA. She is also an invited speaker at the United Nations, Google, IBM Research, Stanford University, to name a few. An Arizona prosecutor has determined that Uber is not criminally liable in the death of a Tempe woman who was struck by a self-driving test car last year. "After a very thorough review of all the evidence presented, this Office has determined that there is no basis for criminal liability for the Uber corporation arising from this matter," the Yavapai County Attorney's Office wrote in a letter to the Maricopa County Attorney's Office. Tempe is in Maricopa County, but Yavapai County took the case due to a potential conflict of interest. Elaine Herzberg, 49, was walking a bicycle across the road at night when she was fatally struck by a Volvo SUV outfitted with an Uber self-driving system in March 2018. There are many calls coming from different quarters to quite Facebook and streaming is taking over the music industry, so what's next?   Show Notes   Last Sunday, in the city of Tempe, Arizona, Elaine Herzberg who was 49 years old, attempted to cross a busy road. She was pushing a bicycle across the road about 100 meters from the closest pedestrian crosswalk when she was hit by a vehicle, which was travelling at 38 miles per hour in a 35 mile-per-hour zone.   The Police Chief of Tempe said the crash may have been unavoidable.  One analyst who follows autonomous vehicles, said laser and radar systems can see in the dark much better than humans or cameras and that the victim was well within the range.  He said, “It absolutely should have been able to pick her up. From what I see in the video it sure looks like the car is at fault, not the pedestrian.”   Delete Facebook  How often do you post on Facebook? A lot of people are calling for others to quit Facebook. Even the hashtag #DeleteFacebook is trending.    Many are wondering if it is time to say goodbye to Facebook.  At its best, Facebook is a nice way to stay in touch with friends around the world, in business to learn what’s important to the people we serve and to share the work we’re doing. But there’s a concern to all of this. From cassettes to cds, then onto digital downloads. For a little while now streaming is the main way of getting our music.   Streaming music is taking over the music industry, and that can be seen with digital download sales which have fallen so much in the past few years that they’re now smaller than sales of CDs, vinyl, and other physical media.   A recent report shows that digital downloads fell to $1.3 billion last year, whereas physical media, while also falling, only declined to $1.5 billion.

On Sunday, March 18th, at approximately 10pm, an Uber was operating in self-driving mode when the vehicle struck and killed 49-year-old Elaine Herzberg. Initial reports say that Elaine was walking her bicycle across the street when the Uber struck her. At this time, facts are limited, but at a press conference in Tempe, AZ, officials said that Elaine was crossing the street outside of a crosswalk area when the Uber struck her while traveling at approximately 40 mph.  I suspect that the car's sensors did not identify Elain or her bicycle as an obstacle or pedestrian. In this episode, Robert Solano explores this incident and discussed the potential impacts to the development of self-driving car technology. Phoenix has been a great test environment for companies like Waymo and Uber. The moderate climate makes it ideal for early-stage development.  In addition to the low cost of living, the "business friendly and low regulatory environment" provides an attractive alternative to the very expensive and dense Silicon Valley and San Francisco area where many tech companies are headquartered. Uber had been testing their self-driving fleet in Arizona in addition to Pittsburg and other areas. In total, the fleet of Uber self-driving vehicles had accumulated approximately 3 million miles at the time of this accident. In other words, the current accident fatality rate of the Uber fleet is about 1 fatality in 3 million miles driven. In contrast, the national fatality rate for human drivers is about 1.18 deaths per one hundred million miles driven. MAny advocates of self-driving cars claim that they will have better safety rates than humans, but this fatality puts self-driving car technology at a steep uphill battle to match the human fatality rate. This accident illustrates three key elements of self-driving car technology and development. 1) There are weaknesses to single driver fleets. Waymo CEO John Krafcik boasted that Waymo was trying to develop the most experienced driver ever. He claimed that all of the vehicles in the Waymo fleet were essentially the same driver and shared their lessons learned and experiences with each other. At first, that idea seems great, but there are serious implications if that hardware or software has a flaw. As a result of this accident, the entire fleet of Uber self-driving vehicles is suspended from further road testing.  Since Uber has a small fleet of these vehicles, suspending their services is not a big deal. But in the future, if a company has a much larger fleet, then suspending a service could potentially leave customers without a ride-hailing service Today, there are tens, if not hundreds, of thousands of Uber cars in operation around the world. Many people depend on them for transportation. There would be a severe econmic impact if all of the Uber (or Lyft, or Taxis) all suddenly stopped operating simultaneously. The one-driver model sounds good for machine learning, but it severely reduces the redundancy that is inherently built into our current system where each human is unique and we all operate thousands of different are makes and models. 2) This accident will delay the deployment of self-driving technology by 12 to 18 months. Opponents of self-driving technology will use this incident as a perfect example to push for stricter regulations, testing, and monitoring of self-driving car development. Additionally, companies will become more cautious. The result is that the deployment of self-driving car fleets will be delayed 12-18 months. 3) Company ethics are crucial to self-driving car technology. Too many academics are focused on the ethics of machine decision making.  They talk about topics like the Trolley Problem ad nausea.
