She now lives in Republic with her blended family, and in this week's episode of "Class Reunion," she tells us about graduating (again) alongside her son, Noah, and what it means to be raising kind kids in an era of divisiveness. (初級〜中級)*** Script *** [ (47) Drinking Parties ] M: Hey, Inez, how was your weekend? W: It was OK - I went to a drinking party on Saturday night. M: A drinking party? You drink a lot? W: No, I didn't. But my Japanese friends drank a lot of beer. They played some games, and the people who lost had to drink! Sometimes they drank it all in a single gulp. I was really a little surprised. They were really crazy about drinking. M: I see. Did you hear about the news that a Japanese student in a very famous university died from drinking too much? W: Oh. That's sad. But I can imagine how much he drank! At drinking parties, Japanese students don't stop drinking until they get badly drunk. Sometimes I just wonder why they have to do that. I don't drink much and I've never been drunk before,so I don't know how it feels to be drunk, but I just wonder why they wanna drink that much. M: Sometimes, you see, they don't really wanna drink that much, but their friends push them. I think it's peer pressure that makes them have to drink that much. W: Exactly: peer pressure. But anyway, I didn't drink that much. I just ordered some kind of soft drink with a little alcohol. It wasn't worth it for me, cause I paid 3,000 yen for a drink buffet. M: Haha, Oh, poor Inez! W: But that's not the main problem. Maybe because I didn't drink as much as my Japanese friends, I just felt I couldn't get into their talk, and I felt bad that I spent 3,000 yen and didn't like it very much. M: Hey, Inez, I have a question: why don't you drink just a little beer? I don't think you'll be forced to drink as much as your Japanese friends, so you don't have to worry about it at all. So why not drink just a little? W: Maybe that's why I didn't have such a good time. I still have the impression that it's not good for girls to drink alcohol. M: Ho ho. Kind of an old-fashioned idea? [ (120) The Morning After ] Scene: In the kitchen. M: Good morning! Well, you look exactly how I feel! W: I know. Right. I feel so hungover. How much did we drink last night? M: I have no idea, but I'll tell you this: I'm not drinking like that again for a long time! W: What were we even drinking? I remember we started with beers at that one bar, and then we had some whiskey, and then…? M: Then we went to that new club down the road and had god-knows-how-many shots of sambuca and tequila! Ah! You two were really going for it! M: Oh, my gosh. I remember her! W: And you spilled so many of your drinks last night! M: So THAT explains why my shirt is so wrecked. W: And one girl almost slapped you when you nearly threw up on her shoes! M: Are you serious!? OK, so, let's not go back there for a while! W: You were such a mess! M: Oh no! And my bike's still outside that bar! W: Yeah, you tried to ride it back home but fell off into the bushes and we had to carry you home. M: What is my problem!? And why do I do this every time I have to write an essay! W: Isn't it due in tomorrow? M: I know, and I haven't even started! [ (172) Which Beer Is Best? ] M: [Sigh] I miss drinking beer in the US. W: Why? You don't like the beer here? M: No. I DO. It's just... Japanese beer all seems very light and refreshing. Don't get me wrong, Asahi, Sapporo, Kirin are definitely good. It's just, sometimes, I miss the VARIETY of beer in America. W: Really? Because I've heard that American beer isn't all that great. M: Well, we definitely have some bad national brands, but we also have a lot of great local brews. And if American beer is not what you're into, in the US it's extremely easy to get your hands on pretty much any beer you want-German, Belgian, African, Indian, even Japanese! W: Well, is there any other discontent you would like to express today? M: Well, actually... I don't understand canned beer in Japan. W: What? Canned beer? M: Pretty much any beer worth drinking in the States comes in a bottle or is on tap. It's kind of rare to drink canned beer, unless you're at a college party, or just running low on money. Especially I miss beer on tap. W: You mean when they pull the handle and it comes out of the spout, right? M: Exactly! W: You can definitely find that in bars in Japan. M: Yes, but they have tap beer in most restaurants in America, and they usually have about five different varieties. One of the bars in my university's city has 50 different beers on tap, and rotates them daily! W: Every day new kinds of beer? Wow, that seems a little excessive. M: Probably so, but at least there is no lack of options. W: So, you don't want another beer is what I'm hearing? M: Oh no, no, no. Wait, wait! I never said that! W: But it's in a can and everything. M: Hey, beer is beer! [ (268) A Great Drink ] A Great Drink Situation: At a party. Greg is acting quite drunk. Maria is not. W: Hey Greg. How's it going? M: Hey, Maria. I'm great! Isn't this party awesome? W: Yeah, it's not bad. You seem to be having a great time! M: Oh yeah, I'm having a blast! I was just chasing the chickens around the garden! It was great! W: You what? The chickens? M: Oh yeah, I felt like doing something crazy. Before that I played beer pong with Charlie -- he kicked my ass. But it was great fun. W: Oh, so you're drinking tonight? M: Yeah, I managed to score this bottle of wine -- took it from my parent's alcohol stash! W: You're drinking wine? Wow! I love wine too, although I prefer red wine. M: Mmm, well, this white wine is good stuff too! So fruity! So gooood! W: You've drunk a lot already, huh? M: Yeah, it's absolutely delicious! I don't know what it is exactly, though, because the label is all in French. But it IS good stuff. And strong! I am really feeling it! W: Hmm, I think I've had this drink before, actually. M: You have? I've never heard of it before! Where did you have it? W: At my little sister's 7th birthday party. This isn't wine, Greg … it's apple juice! M: Ugh … what??

Mike Kenny, attorney, Bauer, Crider, and Parry: So, the recap is the Miranda warnings themselves have five specific portions that must be read to a suspect. They have to be told they have the right to remain silent. They have to be told that they have a right to an attorney. They have to be told that if they can't afford to hire one, one will be appointed for them. They have to be told that they can exercise those rights at any time. The setting where Miranda warnings have to be read: it has to be in a custodial interrogation. Custodial meaning the person has to have his freedom of movement limited in .a manner that is objectively reasonable. Like people would expect. “Yeah, I can't go. I’m not free to go. I’m answering these questions.” Now, that particular aspect is a very heavily litigated aspect. Because there are times that the officer’s going to say, “Hey, listen. He wasn’t in custody. I was just, you know, I was just walking up to him and we are having a consensual encounter. This was just a normal conversation.” So, the inquiry to whether, or not. a person is in custody is very fact-specific and they look at the manner of questioning. They look at whether the person was told he or she was free to leave. Whether the officers came up with some show of force that would cause a reasonably objective person to believe that he wasn't as free to turn around walk away, or refuse to answer questions. And the courts are going to look at all that to determine whether, or not, that first box has been checked. “Is he in custody?” And then the second box, which is a little bit easier - interrogation. You know? Has he been asked questions designed to eliminate an incriminating response? Well, they look at what was asked? How was the conversation made? Is it that Christian burial speech which was clearly designed to get this person in the backseat to feel remorseful? And say, “All right. Let me tell you where the bodies are.” That is also heavily litigated. But the biggest issue is is the person custody or nor? Because putting handcuffs on you isn't the only time a person is in custody. And these Miranda warnings matter because what happens is that they're not read when they should have been, an admission to a crime is kept out of evidence. Or, not even an admission to a crime, but maybe an admission to being present when a crime was committed. Sometimes, you know, that's very important. Obviously, if a prosecutor is going to convict you of a crime they’ve gotta prove that you were there. And just being there puts you one step closer to committing the crime.in a law-enforcement officer’s perspective, perhaps. So, you get to keep all of that out, if a person should have been warned, and they weren’t. It doesn't make the crime go away. It doesn't mean that the arrest was bad. All it means is that the answers that you may have given in response to interrogation should have been warned. And because they weren’t, the cure is we keep those statements out. That's the punishment. It’s basically pursuant to the exclusionary rule, they keep that set of factors out of evidence. A.nd this comes up in every single crime there is. It comes up in DUI arrests. It comes up in robbery arrests. It comes up in homicide cases. Sexual battery cases. I can't tell you how often in a sexual battery case the investigation involves two people. Most the time, people don't commit a sexual battery in the middle of a football field. Most the time it happens, most crimes,, most very serious crimes, happen away from public view. So, you have one witnesses account, the victim, perhaps. And then you have what the defendant said. What the suspect said. And there are plenty cases where a suspect may be thinking he’s doing himself a lot of good by saying, “I didn't do anything. I didn't touch her. She was there, but we didn't have sex.” But, maybe, he think that's very helpful. But it’s not helpful if a DNA test is performed, and they actually find the suspect’s DNA. That just shows that he lied. And lying, is maybe enough for this prosecutor to present to the jury that this victim accuses him of a sexual battery. This person lied about a consensual encounter. And this prosecutor would ask a question, “Why on earth would he lie about had it not been because he was afraid of getting caught?” And that's why it's crucial, when a person gets contacted by law enforcement, and they say, ”Hey, listen. We’re investigating something. We need to answer some questions.” The first thing you do is, is tell him. “Hey, listen. I don’t want to answer any questions right now.” And you contact a lawyer. You find a lawyer. You tell the lawyer what's going on, and then that lawyer would reach out to the law-enforcement officer to get an idea. “Is my client suspect? Are you investigating his potential involvement in a crime?” And then, we can make an educated decision on whether or not we’re going to answer any questions, or answer no questions at all. B: So, I mean, the best advice I’m hearing out of all this, is a experienced criminal defense attorney, Mike. Those two, you know, first important factors: the right to an attorney, and then the right to remain silent. Those are the things that you recommend most. Right? Get the attorney. M: Sometimes, yes. Everybody in the United States has a shield. And that shield is the right to a lawyer, and that right to remain silent. Everybody has that shield. The problem is that shield’s no good if it's sitting on your back and you're not using. So, the Miranda warnings are designed to let you know you've got the shield. You can use it if you want. But the people have to understand that you’d better use that shield. B: Right. M: It’s much better to decide later, after contemplation of looking at what's at stake, and looking at what the facts are, to decide whether to answer a question. Heyang:大家好!我是赫扬~欢迎来到这周RT英语词汇小百科。今天和马克我们要一起来聊一聊关于shower的那些事儿。Mark: Yes, and today we are going to be talking about a phenomenon of…either the weather or the bathroom. Right? HY: I guess so. Actually this word has a surprisingly wide range of different meanings. M: And the word is…HY: Shower!M: Yeah, we’re going to be talking about shower. So most of us are familiar in getting up in the morning and have a shower. Or actually many of my Chinese friends tell me that they have a shower last thing at night. There’s a cultural difference. Some people have a shower both at night and in the morning. HY: And that’s a waste of water. But anyway, I think that going to bed without a shower is dirtying the bed. M: Some people never have a shower. Isn’t it funny how you can always tell who those people are on the subway. HY: Yes, it’s pretty obvious. One thing that always interested me and at first got me a bit confused is, in English, there’s this phrase “baby shower.” At first, I thought it’s about giving a bath to a baby. And it turns out to be a completely different thing. M: This is an American thing actually. I don’t think it appears outside of America. But maybe it’s spreading through films and TV shows like Friends. I don’t know if there ever was a baby shower in Friends. But I’ll bet there was. Because it’s just the kind of thing that they would include in something like Friends, isn’t it? Baby shower, as far as I know not being an American citizen and my knowledge of this is limited, I think it is where friends of the new mother buy gifts and give the gifts to the mother and have a sort of party. Why not? And they would get thing that are quite useful like nappies or sometimes in America known as dippers, blankets, useful stuff. I think it’s a good new tradition really the baby shower. HY: Yeah, I think it’s the perfect occasion to celebrate the transformation of a woman into a mother. That’s something quite culturally unique, coz we don’t see that very much in China. But I do think it is an opportunity and occasion worth celebrating. M: Sometimes it’s the companies themselves that are behind these new traditions. Is ‘new tradition’ an oxymoron? I think it is, isn’t? It’s something where each word contradicts itself. Anyway, it could be that it’s the manufacturers of the baby products that are behind this. So what, people don’t have to do it. Actually they do, it’s become part of the baby tradition in America. That’s quite a good word to use for it. Coz they ‘shower’ the baby with gifts. We said that there’s two meanings to this word, but there aren’t really. Because there’s the shower you take in the morning, there’s the baby shower, or there’s a shower of rain which is light rain usually not lasting for very long. In fact, they all have the same meaning. Meaning something descending on you from above whether it be rain or water from the shower or presents. It’s pretty much the same meaning in all the uses of the word shower.HY: And what about that phrase called “April showers bring May flowers.” What does it mean? Is it a nursery rhythm?M: I’ve never heard of it. I don’t know where you’ve got it from. I’m always impressed when you find these ancient bits of English culture and literature. And I’ve never heard of any of them. But it makes sense, doesn’t it? Because April showers gets the ground moist in April. So that means the seeds will pop up in May as flowers I suppose that’s what it refers to. HY: It is a reminder that even the most unpleasant things, in this case the heavy rains of April, can bring about very enjoyable things indeed – in this case, an abundance of flowers in May. Many of life’s greatest things come only to those who wait, and by patiently and happily enduring the clouds and damp of April you can find yourself more easily able to take in the sights and smells of May. After all, it’s easier to love something if you begin with an optimistic outlook. I think it’s actually quite a nice phrase.M: There’s one more meaning of shower that does have a different meaning. Our listeners who like watching old English films starring people like Terry Thomas perhaps you’ve never heard of him but it’s worth watching some of his movies and it was used to describe a bunch of losers. He’d say something like ‘What an absolute shower!’ that’s how he’s pretty much spoke. I think that was quite a good impression of him. They played some games, and the people who lost had to drink! Sometimes they drank it all in a single gulp. I was really a little surprised. They were really crazy about drinking. M: I see. Did you hear about the news that a Japanese student in a very famous university died from drinking too much? W: Oh. That’s sad. But I can imagine how much he drank! At drinking parties, Japanese students don't stop drinking until they get badly drunk. Sometimes I just wonder why they have to do that. I don’t drink much and I've never been drunk before,so I don’t know how it feels to be drunk, but I just wonder why they wanna drink that much. M: Sometimes, you see, they don’t really wanna drink that much, but their friends push them. I think it’s peer pressure that makes them have to drink that much. W: Exactly: peer pressure. But anyway, I didn’t drink that much. I just ordered some kind of soft drink with a little alcohol. It wasn’t worth it for me, cause I paid 3,000 yen for a drink buffet. M: Haha, Oh, poor Inez! W: But that’s not the main problem. Maybe because I didn’t drink as much as my Japanese friends, I just felt I couldn’t get into their talk, and I felt bad that I spent 3,000 yen and didn’t like it very much. M: Hey, Inez, I have a question: why don’t you drink just a little beer? I don’t think you’ll be forced to drink as much as your Japanese friends, so you don’t have to worry about it at all. So why not drink just a little? W: Maybe that’s why I didn’t have such a good time. I still have the impression that it’s not good for girls to drink alcohol. M: Ho ho. Kind of an old-fashioned idea?
