    Episode 22 - Setting the Record STRAIGHT on the Breonna Taylor Case

    In the months since the shooting, we heard numerous tales regarding the facts of this case that turned out to be untrue yet are still being parroted by those with a racial axe to grind.  For example, one of the issues from the original story was that Breonna and her boyfriend, Kenneth Walker, were asleep when the cops stormed into the apartment. We now know based on statements of those involved in the altercation that both Breonna and Walker were awake and in the hallway waiting for the cops to come through the doorway.  This is important since the clear suggestion from the sleeping narrative was that the two individuals were caught off guard and at the least could be reasonable in shooting who they throught were intruders, and at most were reasonable because the cops were trying to ambush them while they were off guard and sleeping. This is not true.Second, we have the issue of the supposed no-knock warrant.  We have heard in the weeks following the shooting that the cops effectuated a no-knock warrant for the apartment, and thus this added to the supposed element of surprise involved with the cops breaking into the apartment. Now we know that while a no-knock warrant is permitted in Kentucky, it was not utilized in this case. On the contrary, based on statements from the cops and from another resident of the building the cops indeed knocked and announced themselves before entering the apartment. Walker himself admits that he heard knocking but claims he did not hear the cops announce themselves. I think that the witness statement confirming that the announcement was made is critical here. Some disinterested party has backed up the proper procedure by the cops.  Furthermore, it would be interesting to know where the witness lived in the building.  If, for the sake of argument, the witness lived down the hall, on the other side of the building, or on another floor, and was still able to hear the cops announcing themselves, that is very strong evidence that proper procedure was followed insofar as the initial entrance into Walker's apartment.  Moreover, it also calls into question Walker's claim that he didn't hear an announcement from the cops.  If that hypothetical turns out to be true, then how could Walker be believed that he didn't hear the announcement when someone in a different part of the building was able to hear them?  Although I think the witness statement justifies the conclusion that the cops properly entered the apartment, the location of that witness could be useful in assessing Walker's credibility.Next, is the nature of the shooting.  We know based on the statements and initial forensic work done so far that Walker fired first, and thus initiated the ensuing firefight between he and the cops. So the simple act of firing, generally speaking, was prompted by the initial use of deadly force by Walker.  Nevertheless, those on the racial left always have a failsafe, always have a backup lie to go to, on the rare occasion they get held down on their arguments and have to pivot.  We were then met with the bogus claim that apparently the bullets, obliviously not meant for Taylor since she was not the one who started the gun fight, were excessive for a couple reasons - first, the shots were excessive because several shots missed both individuals in the dark apartment (now being used as the anchor for a kind of wanton recklessness type of charge against one of the officers); second, the number of shots hitting Taylor is somehow evidence of intent to kill, never mind the fact that this still doesn't establish that she was the intended target. At the end of the day, this is being used as a vehicle to smear the cops on some kind of drummed up negligence type charge relating to Taylor's death.

    Episode 20 - Presidential Taste Making and COVID In Sports

    In this week's episode of Fate of the Union, Franklin discusses the differences in response to the Jacob Blake shooting from Vice President Biden and President Trump.  While Biden has emoted about Blake's victim status and acted as a sort of cheerleader for Blake, Trump has been much more even keeled.  The latter response goes a long way in the way Americans view these cases in particular, and the justice system in general.Next, we cover how Minnesota Vikings's quarterback Kirk Cousins got in hot water for simply saying that he doesn't feel threatened by the coronavirus, but will nevertheless wear a mask out of concern for others.  While the sports media dolts tried to lambast Cousins, his statements have been easily the most reasonable and practical of any athletes regarding the pandemic as it related to their own personal circumstances.     Episode 18 - Derek Chauvin / George Floyd Update

    This week on Fate of the Union, we are going to look at some updates regarding the case against Officer Derek Chauvin in the wake of body cam footage being released of the police's confrontation with George Floyd leading up to his death. The real influence of this video is its impact on the charges brought against Chauvin, and the relevant likelihood of success on each count. Minnesota's Attorney General, and former Congressman, Keith Ellison has brought the following charges against Chauvin: second degree murder via the felony murder rule, third degree murder, and second degree manslaughter.  In the prosecution's view, the knee was at best a contributing factor to Floyd's death, that likely would not have resulted in Floyd's death without the fentanyl in his system. Moreover, there was no way for Chauvin to know about the lethal dose of drugs in Floyd's system at the time of the events. Without using hindsight, the use of non lethal force on a suspect who was resisting arrest and had other preexisting conditions, the extent of which could not have possibly been known by the officer, does not amount to an unreasonable risk of harm. For comparison, even a choke hold would have been a better case for the manslaughter charge. Instead, this case is at best a case where some may find the measures unnecessary in the circumstances given Floyd's inability to escape, but that is still short of actions that are criminally culpable. If you enjoyed this episode, please subscribe on iTunes and leave a rating/review.     Episode 17 - MLB Pitcher Refuses to Kneel to BLM; More Slander of Cops

There will also be a second half portion for the audio only podcast.First, we recently lost civil rights icon John Lewis. He also served as the Congressman representing Georgia's fifth congressional district beginning in 1987. Lewis was one of the prominent civil rights leaders at the forefront of the 1963 March on Washington, as well as leading the marches from Selma. On July 17, 2020, Lewis passed away after a sixth month battle with pancreatic cancer. There was an enormous outcry of admiration of Lewis' civil rights efforts and legacy from President Trump, along with former Presidents Obama and Bush, and countless others. John Favreau, former Director of Propaganda for the Obama Administration was front and center in this effort. In fulfilling his role as race baiting guilty white extraordinaire, Favreau wrote on Twitter, on the day after Lewis' death, that “Joe Biden should announce that the first bill he'll introduce as President is the John Lewis Voting Rights Act of 2021, a law that would guarantee every American the right to vote and the right to equal representation.”Now, this may seem odd for a couple reasons- first, every American already had the right to vote, and has had this right for some time now. Additionally, the equal protection clause of the 14th Amendment was passed in 1870, and its complete and accurate interpretation was solidified by Brown v. Board of Education in 1954 and the Civil Rights Act in 1964. Second, Favreau of course didn't stop at the grandstanding of “restoring” rights that are already enjoyed by every American, but used the opportunity to further other political goals using Congressman Lewis' hearse as the vehicle towards political ends.In reality, this effort is not unlike those in which members of Congress purposely name proposed legislation with acronyms that can be used to bludgeon those who disagree. They'll name the act in question the CARE Act, the Affordable Care Act, the We're Against Poor People Act, etc. Next, congress will stuff these acts full of ancillary issues that are in line with their political goals. Incentivized unemployment through prosperous stipends, more socialized health care ideals, and more now find themselves in these acts. Then, when someone opposes the acts, regardless of the basis of their dissent, the proposers can say “What are you against caring about those in need? Are you against affordable health care? Are you okay with poor people suffering?” Never mind that virtually all points of disagreements that are framed as against the overarching idea behind the acronym are actually legitimate concerns.We also look at the permeating social justice drivel that has now found a home in Major League Baseball. While the teams did not kneel for the anthem, they all rose to attention in unison in time for the song to start, every player knelt while viewing a BLM message displayed on the giant screen in the outfield.     Episode 14 - Revisiting the Case of Kevin Cooper (True Crime Pod #3)

    In the first installment of Fate of the Union's true crime episodes, host Franklin Shelby examines the case of Kevin Cooper. Cooper was convicted in connection to the 1983 murder of the Ryen family, along with another child in the Ryen home. The brutal slayings have since been dubbed the "Chino Hills Massacre."     In the first installment of Fate of the Union's true crime episodes, host Franklin Shelby examines the case of Kevin Cooper. Cooper was convicted in connection to the 1983 murder of the Ryen family, along with another child in the Ryen home. The brutal slayings have since been dubbed the "Chino Hills Massacre." In the decades since the killings, Cooper has exhausted every avenue of appeal in both state and federal court in an effort to free himself from San Quentin's death row, or at the very least, prolong his execution. Most recently, the California Supreme Court has granted a stay of Cooper's execution while another round of DNA testing is done.
