In the midst of everything that is going on, you need to find something to uplift and better ourselves as people. And this podcast has been that for myself & the listening audience all over the world. And in the middle of another black life that has been lost due to racism, a mother has carried her son's legacy and memory into a foundation that will be fundraising for an incredible cause. On February 23, 2020, Ahmaud Arbery, a 25-year-old black man, was murdered during a racially motivated hate crime while jogging in Satilla Shores, a neighborhood near Brunswick, GA. Three men hunted him unjustly & as Arbery attempted to defend himself, Travis McMichael fatally shot him. The case would have been mishandled had the public interest not peaked and forced outside agencies to take over the case. On June 24, 2020, a grand jury indicted each of the three men on charges of malice murder, felony murder, and other crimes. On January 7, 2022, the McMichaels were sentenced to life imprisonment without the possibility of parole plus 20 years, while Bryan was sentenced to life imprisonment with the possibility of parole after 30 years. Now, after 3 years since the tragedy, his mother, Wanda Cooper-Jones is keeping Ahmaud's name alive with his the 1st Annual Run With Maud 5k Walk/Run. The Run with Maud 5K Run/Walk, an initiative to celebrate the life of Ahmaud Arbery and raise funds for the foundation established in his name, will take place on May 6 in Centennial Olympic Park. "Ahmaud ran to feel free,” said Cooper-Jones, who created the foundation. “It is the goal of the Ahmaud Arbery Foundation for all people to enjoy running for their mental and physical health. The Run with Maud 5K will raise awareness for that vision and funding to provide mental health resources for black boys." Sean talks with Elle Herman about the varieties and modalities of fascism and the carceral dynamics at stake in the institution of criminal prosecution. Elle recently gave a talk for the Karasu Philosophical Society in Albuquerque titled "The Problem of Prosecuting Fascism." In the talk, she focuses on two recent prosecutions of notorious 2020 American vigilantes: Kyle Rittenhouse's trial for fatally shooting Anthony Huber and Joseph Rosenbaum and non-fatal shooting of Gaige Grosskreutz at the Jacob Blake protests in Kenosha, WI; and the trial of the McMichaels and William Bryan for the pursuit and murder of Ahmaud Arbery around Brunswick, GA.On Monday, the McMichaels were each sentenced to life in prison +, while Bryan received a sentence to serve 35 years. While Sean interviewed Elle last week, the problems she approaches in her talk are all the more significant to consider in light of these sentencings. Three men were sentenced in federal court for their role in the February 2020 murder of Ahmaud Arbery. The man who shot Arbery, Travis McMichael, and his father Gregory McMichael were sentenced to life in prison. And the other trial that proved that it was a hate crime. And how officer Tatum never put up a video admitting that he was wrong in every way. The last video that he put up was about him trying to find reasonable doubt in the murder trial. He purposefully never put up a video about the hate crime trial. White father and son are arrested after 'chasing down and shooting at black FedEx worker' in Mississippi. A black Mississippi FedEx delivery driver is speaking out after he claims two white men - a father and son - shot at him during his shift in what his attorney describes as a 'copycat' attempt of the murder of Ahmaud Arbery. D'Monterrio Gibson, 24, said that he was working Monday, January 24, when the men, identified as Gregory Case and Brandon Case, allegedly attacked him. He was delivering packages in Brookhaven, a suburb of Jackson, at around 7 p.m. that day when a white pickup truck, driven by Gregory Case, came toward the address of a scheduled drop. Gibson alleges that Gregory Case tried to drive 'extremely close' to him and cut him off, and that as he drove away, he saw Brandon Case a few houses down in the middle of the road pointing a gun toward the driver's truck, which was a white Hertz van despite him working for FedEx. On February 1, Brandon and Gregory Case turned themselves in. Gregory was charged with a count of conspiracy assault, while Brandon was charged with one count of aggravated assault, according to the Mississippi Free Press. Ahmaud Arbery's killers sentenced to life in prison. Here's what happened today in the sentencing of the 3 men who killed Ahmaud Arbery. Travis McMichael and his father, Gregory McMichael, were sentenced to life in prison without the possibility of parole by Judge Timothy Walmsley on Friday in the death of Ahmaud Arbery. William “Roddie” Bryan was sentenced to life in prison with the possibility of parole. Walmsley addressed Arbery's family ahead of the sentencing, warning that "sentencing does not generally provide closure." "In this case, I think many people are seeking closure. The mother, the father, the community, and maybe even parts of the nation, but closure is hard to define and is a granular concept. It's seen differently by all depending on their perspective and the prism of your lives," Walmsley said. In this episode, we discuss the recent trial of the McMichaels, for the murder of Ahmaud Arbery, and the importance of jury instructions in a trial. We will focus on the judge's instructions to the jury on citizen's arrest. A major issue of the case was the statute for citizen's arrest - which is ambiguous or confusing. All the Lawyers Who Stood Between Ahmaud Arbery and Justice. The three notorious white men caught on video chasing and fatally attacking Ahmaud Arbery last February are now officially convicted murderers. But Gregory McMichael, his son Travis, and their neighbor William “Roddie” Bryan” are not the only villains in the gruesome case plagued by allegations of initial prosecutorial misconduct before arrests were made 70 days after the 25-year-old Black man's shooting death in Georgia. The prosecutors who won the case argued that Arbery was on a jog through Satilla Shores, a mostly white neighborhood in Brunswick, Georgia when the trio chased him down the street after wrongly suspecting him of burglary. Travis McMichael was caught on video footage—filmed by Bryan—firing the fatal shots. The defense for the three men argued that they were trying to perform a citizen's arrest on Arbery in connection with suspected break-ins in the area. After nine hours and two days of deliberation, a Glynn County jury on Wednesday found the three men guilty of felony murder in the Feb. 23, 2020 homicide death of Arbery. But Arbery's murder was almost never prosecuted. And when the case did make it to trial, defense attorneys stepped over themselves to engage in ugly arguments rife with racist innuendo. Last February, Johnson was the Brunswick District Attorney in the midst of a re-election campaign when Gregory McMichael, a former police officer and one-time investigator in her office, called her after his son shot Arbery to death in the street. Eventually, Johnson referred the case to Waycross District Attorney George E. Barnhill, recusing herself. But investigators now allege she meddled in the case before handing over the reins. On Sept. 2, after losing her re-election bid, Johnson was indicted on several charges—including obstructing police—after allegedly directing officers to not arrest the McMichaels after the incident. The indictment also states that Johnson showed “favor and affection” to Gregory McMichael and failed to treat Arbery's family “fairly and with dignity” when she recused herself from the investigation. Monday on Political Rewind: Race continues to be a central theme in the case of Travis McMichael, Gregory McMichael and William "Roddie" Bryan — the three white men charged with murder in the shooting of Black jogger Ahmaud Arbery in 2020. A defense attorney in the case received criticism after complaining about the presence of Black pastors, including well-known names like Rev. Al Sharpton, in the courtroom. Emory professor of constitutional law Fred Smith said the attorney's comments are notable because they provide additional framing of the high-profile case within America's ongoing reckoning with racism. "Part of what we're seeing in this particular trial is that the subtext of race — which is often present in the American criminal legal system — the subtext is just the text,” Emory professor Fred Smith said. “There's also, built into that, a broader context in the criminal legal system, where many scholars like Paul Butler and others have written, about how when police see African Americans, they are viewed more as a threat and how that's kind of a thread throughout criminal legal system." Meanwhile, President Joe Biden is scheduled to sign the long-awaited infrastructure bill Monday. Every Republican member of Georgia congressional delegation voted against the measure. Some congressional Republicans who did vote for the bill, including South Carolina's Lindsay Graham, are being targeted with death threats and calls for expulsion. In other news, a federal appeals court signals its displeasure with the Biden Administration vaccine mandate. Three men were indicted on hate crime and attempted kidnapping charges by a federal grand jury in Southern Georgia in connection with the death of Ahmaud Arbery, the Department of Justice announced Wednesday. Arbery, a 25-year-old Black man, was out for a jog near Brunswick, Georgia, on February 23, 2020, when he was chased down in a truck by three men and fatally shot. Two of the three men -- Gregory and Travis McMichael -- claimed to be conducting a citizen's arrest and acting in self-defense.
