Welcome to THE Sports Law Podcast! We keep you informed on everything at the intersection of sports and the law. Dan Lust (@SportsLawLust), Justin Mader (@MaderLaw), and John Nucci (@JNucci23) to discuss the latest in the world of Sports Law. The PGA has announced today the merger between itself, LIV, and DP making a new golfing organization. (0:26) This newly merged group will be funded by the Public Interest Fund which was the financial backbone of the LIV Golf Tour. Given this new merger, this could spell the end of the anti-competitive litigation that is currently ongoing between the PGA and LIV. However, as John Nucci points out, this could open a new can of worms as they may have created a giant monopoly that could be challenged in court or by the federal government. Colts player Isaiah Rodgers has been identified as the player accused of placing over 100 bets on sports including Colt's games. (21:35) This is another in a plethora of suspensions that have occurred in the NFL regarding their sports betting policy. Earlier this spring multiple players were suspended either 6 games or a full year, yet none seem to stack up to the alleged facts surrounding Rodgers. It is possible that this could be the biggest suspension for betting we have seen in the NFL to date. Ja Morant may soon learn his fate on the length of suspension that will be handed down by the NBA following the second Instagram live video of Morant brandishing a gun. (30:52) Recently, rumors have circulated that the number of games will be in the 30-40 game range. A small rumor has also been circulating that Ja Mornat's team is alleging that the gun Morant had in the latest video was a toy gun. NBA Commissioner Adam Silver has expressed that he will be waiting until after the NBA Finals to hand down the suspension. *** Have a topic you want to write about? Welcome back to THE Sports Law Podcast! This is your one-stop shop for all things sports law. In this episode, hosts Dan Lust (@SportsLawLust) and John Nucci (@JNucci23) are joined by a very special guest Dan Rapaport (@Daniel_Rapaport) to discuss the top legal stories in the world of golf. Tiger Woods' ex Erica Herman has filed suit against the golfer, claiming she was wrongfully evicted from Tiger's residence. (9:13) This claim came to light amid a lawsuit looking to invalidate a non-disclosure agreement she signed. This NDA case was brought under the Speak Out Act which "prohibits the judicial enforceability of a nondisclosure clause or nondisparagement clause agreed to before a dispute arises involving sexual assault or sexual harassment in violation of federal, tribal, or state law." The defamation lawsuit Patrick Reed filed against the Golf Channel has been dismissed. (15:56) Reed was suing the channel for $750 million claiming that the statements made on the channel harmed his reputation and damaged his earning abilities. Reed also made threats to sue other channels but that case never came to fruition. As the LIV v. PGA saga continues, John Nucci has been on top of all of the developing stories throughout. (18:44) He discussed with Dan Rapaport the possibility of players returning to the PGA Tour and what that would look like from a legal standard. They also discussed how the PGA pros who remained loyal throughout would feel about the return of some of the LIV golfers. *** Have a topic you want to write about? Dan Wallach and Mike are back with the latest in the sports gambling world. Today they discuss California and Massachusetts as they slowly work towards legalization. California (2:15) has two competing bills on the ballot for CA residents to vote on in November of 2022. The key here is can both survive, we say no. Massachusetts (14:35) has collective agreement to legalize sports gambling but the House and the Senate cannot agree on language of the bill, and are disagreeing over allowing college sports betting, tax rate, and advertisements. The end of the regular session for their legislature is July 31, so keep a close eye on this. Dan and John Nucci wrote and article for Forbes about Massachusetts legalization here. The ROADMAP: 5:45 - College Conference Realignment & Legal Roadblocks. Breaking reports are that powerhouse schools Texas & Oklahoma want to leave the Big 12 Conference for the greener pastures of the SEC. A crippling blow for the Big 12 to lose perhaps their two most storied schools and meanwhile a massive get for the SEC. The question is— if it happens — would the SEC have an unlawful monopoly over the college sports landscape? And by no means is this guaranteed to occur as bylaws require 11 of 14 SEC schools to vote to accept them in… plus word is that Oklahoma and Texas would have to pay nearly $100M EACH in order to leave. Lots of if's, lots of questions, lots of legal issues. We hit all angles. (More on ConductDetrimental.com courtesy of Joe Esses) 21:16 - Conor McGregor Loses… Alleges Massive Coverup. McGregor lost to Dustin Poirier in the Main Event of UFC 264 in Las Vegas when he snapped his left tibia and fibula. Doctors were forced to stop the fight. Interestingly, McGregor is now claiming the UFC “knew I had stress fractures in my leg going into that cage. It was debated about pulling the thing out.” Both the UFC and Conor have an obligation to be truthful concerning pre-fight injuries and failure to do so has massive ramifications. Is it just a fabrication from Conor or is this the tip of the legal iceberg? (Article courtesy of John Nucci) 32:40 - Shohei Ohtani's Unique Arbitration Case. We have simply never seen anything like Shohei, the international superstar and new exciting face of baseball. It's not hyperbole… literally no one has ever pitched and hit simultaneously at this high of a level in MLB history. Now when it comes to his true financial worth, it seems destined for a fascinating salary arbitration case one day. Baseball arbitration relies on locating comparable players with comparable statistics. But what happens when you're doing something that no one has ever done before. We explore how Shohei might soon obliterate the arbitration process. (Article courtesy of Britton Yoder & Sam Roos) 44:34 - WWE's Post-Retirement Problem. With the passing of legendary wrestler Paul Orndorff this past week, a spotlight has been cast WWE's problem affording benefits to their talent. It's a problem that the NFL and its players have had to face before. The difference is that WWE wrestlers, unlike NFL players, do not have a union organized to fight against management to maximize their rights. In lieu of a union, it takes massive public pressure - or a challenging competitor - for a behemoth like WWE to change absent some legal obligation. We explore the shifting landscape in wrestling with AEW now on the horizon and what can be done for Paul Orndorff. 1:01:26 - What to Watch For: Welcome Sloane Lust!
