Comment on the Show by Sending Mark a Text Message.Think you're protecting yourself by forwarding emails, saving pay spreadsheets, and uploading screenshots to a chatbot before HR lowers the boom? That impulse can turn a strong discrimination or retaliation claim into a story about you breaking the rules. We walk through the hidden legal traps that many employees miss—confidentiality agreements, acceptable use policies, non-disparagement clauses—and how employers flip those mistakes into a ready-made defense. We pull back the curtain on the “retaliation playbook”: IT flags unusual downloads, HR opens a policy investigation, and termination arrives with a “legitimate, non-retaliatory reason.” Then comes after-acquired evidence to limit damages, motions to exclude improperly obtained documents, and the credibility battle that distracts from your core allegations. We also break down the whistleblower myth. Some statutes can protect targeted document retention, but coverage is narrow, fact-specific, jurisdiction-dependent, and easy to lose. Relying on Title VII's anti-retaliation language to excuse broad data grabs is a costly mistake. The AI trap gets special attention. Uploading company files to a chatbot creates discoverable records, waives privilege, and can breach your NDA. It also invites arguments that you were case-shopping, not reporting unlawful conduct. Instead of risking counterclaims and evidence exclusions, follow the safer path: consult an employment lawyer early, use contemporaneous personal notes, make formal complaints that trigger preservation, consider agency filings like the EEOC to lock in holds, and deploy preservation letters to prevent deletion. We close with a practical checklist of do nots and smart alternatives that keep your claim strong and the focus on the employer's conduct. If this conversation could save a colleague from a self-inflicted wound, share it. Send us a textIn this episode of The Small Business Big Insights Podcast, Eric sits down with litigation lawyer Margot Pomerleau to explore the legal risks that small and medium business owners often overlook. Margot shares why documenting deals matters more than most entrepreneurs think, how failing to get proper advice early can cost you significantly more later, and the most common mistakes she sees in contracts, hiring, firing, and business partnerships. She breaks down what actually happens when a lawsuit begins, how evidence is collected, and why putting pen to paper can be the difference between winning and losing a case.Margot also explains how business owners can avoid unnecessary legal trouble by setting realistic goals, avoiding unplanned expansions, and resisting the temptation to dabble in industries they do not fully understand. From mismanaged projects to bad investment advice, she walks through real situations that lead clients to her door and shares practical insight on how to avoid similar problems. This candid conversation will give business owners a clearer view of their legal rights and responsibilities and provide valuable tools to protect their companies before issues arise.Timestamps 00:00 Introduction and episode overview 00:36 Meet Margot Pomerleau 01:26 What makes a strong litigator 03:35 Navigating client emotions and expectations 06:49 What business owners do not want to hear 08:31 The cost of ignoring legal advice 10:23 The biggest legal mistake owners make 12:33 Why documenting everything matters 16:01 What happens when you sue someone 19:57 How evidence and examinations work 23:59 Why full honesty with your lawyer is critical 26:21 The litigator's role during a dispute 33:46 Suing financial advisors and investment loss cases 39:13 Controversial thoughts on scaling and risk 44:53 Final thoughts and how to connect with MargotThe conversations in this podcast, including those with Margot Pomerleau, are for informational and entertainment purposes only. In this episode of the Women Winning Divorce Podcast, Heather Quick dives into the complexities of prenuptial agreements, with a special focus on protecting women's financial rights. She explores the high-stakes scenario when a fiancé demands a prenup but refuses to pay for independent legal counsel, emphasizing the serious risks of signing such agreements without proper representation. Heather explains how prenups can dramatically impact financial security after divorce, why it's crucial to insist on your own lawyer rather than using one chosen by your partner, and what protections should be included to safeguard the less financially secure spouse. Listeners will learn to question a partner's intentions, understand the laws in their state, ensure fairness in prenup terms—including sunset clauses and children's financial needs—and avoid unknowingly signing away their rights. As Heather says, “You need someone independent… don't have him pick your lawyer… I would be very careful with that.” This episode is essential listening for any woman navigating marriage, prenups, and the pursuit of long-term financial security.Join us on our podcast as we navigate the complexities of marriage, divorce, separation, and all related legal and emotional aspects, including adultery, alimony, child support, spousal support, timesharing, custody battles, and the financial impact of dissolution of marriage.Interested in working with us? In this episode, Jeff points out the ridiculousness of the belief that President Trump has brought peace to the Middle East with the ceasefire agreement he got Israel and Hamas to sign. There is a mountain of evidence which makes clear that this ceasefire is simply a lull until the next war. In the meantime, the leftists/terrorists are making massive inroads into America and our failure to cut off the head of the terror snake will be our country's greatest failure in the not so distant future. In other news, Bruce Cutler has passed, at one point the most famous lawyer in the world. Bruce also was the lawyer who had a large part in getting Jeff to drop Pre-med in college and go to law school. In this podcast, Jeff recounts some very funny Bruce stories from years past. RIP Bruce.
