Late on a Sunday night in September of 2016, Atlanta power couple, Tex and Diane McIver, were driving back into the city and got caught in Atlanta's notorious traffic. Diane's best friend was driving as Diane rode in the passenger seat and her husband, Tex, sat directly behind her. When they were stopped in what they considered a dangerous part of town, Tex asked for his gun, and then fell asleep. What happened next would cause one of the most hotly debated criminal cases in recent Atlanta history.I covered this case in August 2019. Claud "Tex" McIver is convicted in the shooting death of his wife, Diane. That conviction has been reversed and now, the once-prominent Atlanta attorney takes a plea deal that will pave his way to a release. Georgia's highest court ruled that the jury should have been able to consider a misdemeanor involuntary manslaughter charge. McIver has now pleaded guilty to lesser charges of involuntary manslaughter, conduct, and possession of a gun during the commission of a crime. He will receive credit for the time he's already spent in custody. Tex McIver is a prominent Atlanta Lawyer, Vice Chair of the State Elections Board, and his wife, Diane, is a beautiful, incredibly successful business woman in her own right. They are married 11 years, but on a September night, Tex McIver shoots his wife in the back, killing her. Diane McIver is shot inside a Ford Expedition she is riding in with her husband and a close family friend. They are returning home from their ranch in Putnam County late on Sunday night. Diane is in the front passenger seat, Tex is in the back seat. Dani Jo Carter is driving the SUV back from the Ranch to the Condo in Buckhead when the interstate traffic gets heavy and she takes an exit into Downtown Atlanta. McIver tells the police it was a bad area and he asked his wife to hand him his gun. He said it was in the center console up front. Diane McIver hands Tex his gun. McIver says soon they were out of danger and he fell asleep. He wakes up when Dani Jo stops the car and somehow the gun fired. As friends come to offer condolences on the passing of his wife, most expect to see Tex McIver upset, in shock that he accidentally shot his wife, the love of his life, and caused her death. Instead, they find a man who seems more concerned about money. Within two days of Diane's death, Tex is asking about his wife's Social Security benefits. Then Tex McIver seems to be investigating how to liquidate his late wife's assets. Tex McIver organizes many of his wife's possessions to sell at an auction as part of an estate sale. Tex McIver said he was liquidating things to settle his wife's estate. McIver sold everything he could of his wife's clothing, jewelry, furs, hats, just about everything. The sale lasted several days. It was later revealed that Tex McIver owed his wife nearly $350,000 which she loaned him for a barn he built on the ranch for guests on their estate The Atlanta Police eventually came to the decision to charge Tex McIver with involuntary Manslaughter and reckless conduct in the shooting death of his wife. The charges seem to suggest that they believe Tex McIver's claim that the shooting was an accident. The day after a judge sends McIver to jail, McIver is indicted on a charge of malice murder along with six other charges including three counts of influencing a witness. Fulton County Superior Court Judge Robert McBurney says his oversight of the special purpose grand jury investigating former President Donald Trump and his allies has been "quite a ride." Episode 19 of the ninth season of The Atlanta Journal-Constitution's Breakdown podcast includes an interview with McBurney, who has now been a judge for 10 years. Atlanta lawyer Claud “Tex” McIver's murder conviction has been overturned by the Georgia Supreme Court. McIver was found guilty, sentenced to life in prison, in the shooting death of his wife. The court ruled unanimously that the jury should have been allowed to consider a lesser charge — involuntary manslaughter. Diane McIver died after being shot in the back. A family friend was driving Diane and Tex McIver back to Atlanta from the McIvers' 84-acre ranch in Putnam County. Diane McIver was in the passenger seat. Tex McIver was in the backseat. As they arrived in the city, McIver reportedly asked for his .38 caliber revolver from the center console — according to one statement because they had driven up on a Black Lives Matter protest, while in another statement he said it was for protection against homeless people. McIver fell asleep in the back seat, with the gun in his lap in a plastic bag. According to testimony, as they pulled up to a traffic light on Piedmont Avenue, Diane McIver, 64, told her husband to wake up and not fall asleep. Tex McIver fired one shot, which went through the seat and struck his wife in the back. The Supreme Court ruling noted McIver's contention that he was startled awake by his wife and inadvertently pulled the trigger because of it. The high court upheld a second conviction for influencing a witness, for which McIver, a well-connected Republican attorney known for union busting, was sentenced to five years in prison. He has now served four years and 10 months. The Atlanta Journal-Constitution's Breakdown podcast drops a special episode on Friday for Season 5: “The Tex McIver Case.” McIver, an Atlanta lawyer, was convicted of murder during a trial in Fulton County for killing his wife on Sept. 25, 2016. The killing happened when Tex and Diane McIver returned home to Atlanta from their 84-acre ranch in Putnam County. Diane McIver's best friend, Dani Jo Carter, was driving the Ford Expedition. Diane McIver was sitting in the front passenger seat, her husband sitting behind her in the back seat. After they exited the downtown connector on Edgewood Avenue, Tex McIver asks for his .38-caliber handgun that's in the center console. He later says he thought they had come upon a Black Lives Matter protest. They leave the area without incident and drive along Piedmont Avenue toward Buckhead, with McIver still holding the revolver in his lap. When they get to an intersection, McIver fires a bullet through the backseat. It hits his wife in the back and she later dies during surgery at Emory University Hospital. McIver tells police that it was a tragic accident, that the gun went off after he had fallen asleep and was suddenly awakened. But he is eventually indicted for murder and convicted of it during a 2018 trial. Returning to Breakdown's fifth season, Episode 12 follows the McIver case through its appeal to the Georgia Supreme Court which issued its opinion on June 30. Just eight days before, the state high court had reversed another high-profile murder case against Justin Ross Harris who had left his 22-month-old son Cooper in his hot car to die. This time, the court overturns McIver's conviction in another momentous decision.
