Late on a Sunday night in September of 2016, Atlanta power couple, Tex and Diane McIver, were driving back into the city and got caught in Atlanta's notorious traffic. Diane's best friend was driving as Diane rode in the passenger seat and her husband, Tex, sat directly behind her. When they were stopped in what they considered a dangerous part of town, Tex asked for his gun, and then fell asleep. What happened next would cause one of the most hotly debated criminal cases in recent Atlanta history.I covered this case in August 2019. But In June 2022, the Georgia Supreme Court unanimously reversed Tex's convictions. This episode is a refresher on the original episode and an analysis on the new developments in the case. Hello everyone and welcome to Profiling Evil's, “Down the Rabbit Hole.” We're discussing the murder of Diane McIver in Atlanta, Georgia. Tex McIver is a prominent Atlanta Lawyer, Vice Chair of the State Elections Board, and his wife, Diane, is a beautiful, incredibly successful business woman in her own right. They are married 11 years, but on a September night, Tex McIver shoots his wife in the back, killing her. Diane McIver is shot inside a Ford Expedition she is riding in with her husband and a close family friend. They are returning home from their ranch in Putnam County late on Sunday night. Diane is in the front passenger seat, Tex is in the back seat. Dani Jo Carter is driving the SUV back from the Ranch to the Condo in Buckhead when the interstate traffic gets heavy and she takes an exit into Downtown Atlanta. McIver tells the police it was a bad area and he asked his wife to hand him his gun. He said it was in the center console up front. Diane McIver hands Tex his gun. McIver says soon they were out of danger and he fell asleep. He wakes up when Dani Jo stops the car and somehow the gun fired. As friends come to offer condolences on the passing of his wife, most expect to see Tex McIver upset, in shock that he accidentally shot his wife, the love of his life, and caused her death. Instead, they find a man who seems more concerned about money. Within two days of Diane's death, Tex is asking about his wife's Social Security benefits. Then Tex McIver seems to be investigating how to liquidate his late wife's assets. Tex McIver organizes many of his wife's possessions to sell at an auction as part of an estate sale. Tex McIver said he was liquidating things to settle his wife's estate. McIver sold everything he could of his wife's clothing, jewelry, furs, hats, just about everything. The sale lasted several days. It was later revealed that Tex McIver owed his wife nearly $350,000 which she loaned him for a barn he built on the ranch for guests on their estate The Atlanta Police eventually came to the decision to charge Tex McIver with involuntary Manslaughter and reckless conduct in the shooting death of his wife. The charges seem to suggest that they believe Tex McIver's claim that the shooting was an accident. The day after a judge sends McIver to jail, McIver is indicted on a charge of malice murder along with six other charges including three counts of influencing a witness. Diane McIver, a vibrant, accomplished, and wealthy woman of 63, was shot and killed in 2016 in Atlanta, Georgia. There is no mystery about how Diane died - the gun was held by her 73 year old husband Tex McIver. In this episode we look at true crime puzzle Intent: The Tex McIver Case. Transcript: Hey Pod lovers. I'm your host Marie and If you're joining us for the first time: Welcome! The Mastercast is a podcast recommendation show that brings you a brand new non-spoiler binge-worthy review every week of the best podcasts in a short and sweet 2-3 minute summary on everything you could want to know, from the number of hosts to on average how long you can expect each episode to be. New episodes come out every Monday. You can find the week's other reviews on the show's social on Instagram @themastercast and Twitter @mastercastpods. If you like what you hear and want to help out this independent show you can find me on Buy me a coffee by searching The Mastercast. I'd really appreciate it. This week's review is onIntent: The Tex McIver Case - No Spoilers! The question of who shot and killed Diane McIver in her vehicle in 2018 isn't a mystery. Everyone knows it was her husband 78-year-old Claud "Tex" McIver. He's admitted to as much. The real puzzle was his intent, hence the name of this podcast. Was it a malicious plot as the authorities of Fulton county Georgia believe or terrible decision-making as claimed by Tex? From Valut Studios and hosted by reporter Kaitlyn Ross, this show features experts and friends of the family weighing in on what they think happened as the case and its eventual trial are simultaneously covered. Every one of the 8 episodes is filled with information. This isn't a case that could be summed up in one or two 60 minutes episodes. Race, contentious divorces, privilege, guns, favoritism, and so so much money are all elements in this case. The pod's rating comes with a pretty notable asterisk because it was released as what seems like a second season to a different, very popular show The Officer's Wife. The case could be made that both involve domestic violence and questionable murder of spouses. However, many reviewers are quick to point out the obvious benefit using the same feed would mean for the performance of this newest segment of the feed. Some parts of the show do have a slightly sensational tone which isn't my favorite but isn't overwhelming either. Similar pods: Stolen Hearts, Death of an Artist, and The Execution of Bonny Lee Bakley. All right, guys, that's all for this week but remember if you want to see the cover art, sources or the written transcript for this episode be sure to check out the show notes. Atlanta lawyer Claud “Tex” McIver's murder conviction has been overturned by the Georgia Supreme Court. McIver was found guilty, sentenced to life in prison, in the shooting death of his wife. The court ruled unanimously that the jury should have been allowed to consider a lesser charge — involuntary manslaughter. Diane McIver died after being shot in the back. A family friend was driving Diane and Tex McIver back to Atlanta from the McIvers' 84-acre ranch in Putnam County. Diane McIver was in the passenger seat. Tex McIver was in the backseat. As they arrived in the city, McIver reportedly asked for his .38 caliber revolver from the center console — according to one statement because they had driven up on a Black Lives Matter protest, while in another statement he said it was for protection against homeless people. McIver fell asleep in the back seat, with the gun in his lap in a plastic bag. According to testimony, as they pulled up to a traffic light on Piedmont Avenue, Diane McIver, 64, told her husband to wake up and not fall asleep. Tex McIver fired one shot, which went through the seat and struck his wife in the back. The Supreme Court ruling noted McIver's contention that he was startled awake by his wife and inadvertently pulled the trigger because of it. The high court upheld a second conviction for influencing a witness, for which McIver, a well-connected Republican attorney known for union busting, was sentenced to five years in prison. He has now served four years and 10 months. The Atlanta Journal-Constitution's Breakdown podcast drops a special episode on Friday for Season 5: “The Tex McIver Case.” McIver, an Atlanta lawyer, was convicted of murder during a trial in Fulton County for killing his wife on Sept. 25, 2016. The killing happened when Tex and Diane McIver returned home to Atlanta from their 84-acre ranch in Putnam County. Diane McIver's best friend, Dani Jo Carter, was driving the Ford Expedition. Diane McIver was sitting in the front passenger seat, her husband sitting behind her in the back seat. After they exited the downtown connector on Edgewood Avenue, Tex McIver asks for his .38-caliber handgun that's in the center console. He later says he thought they had come upon a Black Lives Matter protest. They leave the area without incident and drive along Piedmont Avenue toward Buckhead, with McIver still holding the revolver in his lap. When they get to an intersection, McIver fires a bullet through the backseat. It hits his wife in the back and she later dies during surgery at Emory University Hospital. McIver tells police that it was a tragic accident, that the gun went off after he had fallen asleep and was suddenly awakened. But he is eventually indicted for murder and convicted of it during a 2018 trial. Returning to Breakdown's fifth season, Episode 12 follows the McIver case through its appeal to the Georgia Supreme Court which issued its opinion on June 30. Just eight days before, the state high court had reversed another high-profile murder case against Justin Ross Harris who had left his 22-month-old son Cooper in his hot car to die. This time, the court overturns McIver's conviction in another momentous decision. Diane McIver was riding in the front passenger seat of a Ford Expedition SUV when she was shot by her husband Tex McIver. He admitted that to police. The question, as the investigation went on, was whether the firing was intentional or discharged by accident. Tex McIver claimed the latter...that the .38-caliber snub-nose revolver, discharged by accident. McIver's attorneys have filed an appeal of his murder conviction, claiming the judge made several errors during the trial. Atlanta lawyer Tex McIver will likely finish his life in prison for fatally shooting his wealthy wife Diane McIver. Clint Rucker, the Georgia prosecutor who convinced a jury that McIver purposefully pulled the trigger and it was not an accident related to a sleep disorder, shares with Nancy Grace behind-the-scenes details of the McIver marriage and the case against the husband in this special Crime Stories episode.
Tex McIver is likely to spend the rest of his life in prison for fatally shooting his wealthy wife, Diane McIver. Nancy Grace looks at the jury's guilty verdict in the trial of the prominent Atlanta lawyer. Her expert guests include New York psychiatrist Dr Judith Joseph, private investigator Vincent Hill, Atlanta juvenile judge Ashley Willcott, and investigator reporter Art Harris. Grace also digs into the case of a fertility doctor who allegedly inseminated his own sperm into unsuspecting patients, resulting in as many as 22 children fathered by the doctor. Reporter Jennifer Dzikowski joins Nancy.
The jury in the Tex McIver murder case gets the case and deliberates, and deliberates, and deliberates. One of the last things the jury asked for was permission to see, for a second time, the SUV in which Diane McIver was shot, AND they ask to take the .38 revolver with them to the car. So some of them sat where Tex sat and pulled the trigger that Tex pulled. Learn more about your ad choices. Visit megaphone.fm/adchoices
The state rests after putting up more 70 witnesses. The defense case-in-chief takes only 2 1/2 days. The mysterious masseuse, Annie Anderson, takes the stand. And the executor for Diane McIver's estate has a surprise in store for the prosecution. Then the defense rests, and we're down to couple of rebuttal witnesses from the prosecution. The prosecution in Tex McIver's murder trial completes its third week -- a sometimes grueling slog in which the state seemed to be throwing just about everything it can find at McIver. Some if it may not be provable, but none of it looks good. And that seems to be the point. If prosecutors can't prove McIver is a cold-blooded killer, can they sway the jury by suggesting that McIver is a man you can neither trust nor like? And, of course, Tex is helping the state build its case by doing the things he did after Diane McIver died. Learn more about your ad choices. Visit megaphone.fm/adchoices
Prominent Atlanta lawyer Tex McIver is on trial for the fatal shooting of his wife, wealthy businesswoman Diane McIver. Fulton County prosecutors contend that the husband meant to kill his wife, but the defense argues that the revolved accidentally fired while he was asleep in the back seat of their SUV. Nancy Grace discusses the ongoing trial with private investigator Vincent Hill and lawyer and psychologist Dr. Brian Russell, host of Investigation Discovery’s Fatal Vows series.
The state calls Dani Jo Carter -- the only witness to the shooting of Diane McIver. She is on the stand for more than two full days. She tells the prosecution that Tex McIver asked her to lie about being in the SUV that night. But she tells the defense that she stands by her earlier statements to police that Tex was asleep before the gun went off. Learn more about your ad choices. Visit megaphone.fm/adchoices
The state opens the Claud "Tex" McIver murder trial by detonating some new bombshells. McIver, the prosecution says, provided six different versions of what happened to his wife on the night she was shot. Or did he? Among the first prosecution witnesses was Emory University Hospital ER physician Suzanne Hardy, who treated Diane McIver the night she died. Yes, Hardy testified, Diane told her the shooting was an accident. And no, Hardy testified, Diane did not want to see her husband before she was intubated and rendered unable to speak. Diane McIver died shortly afterward. Learn more about your ad choices. Visit megaphone.fm/adchoices
Tex McIver. September 25, 2016. Atlanta, Georgia. Tex and Diane McIver are a very well to do couple who are being driven home by a friend named Dani Jo Carter after having some drinks. Diane sat up front in the passenger seat while her husband sat behind her. Dani Jo exits a backed up highway then drives the couple through a neighborhood that makes Tex a little nervous and he retrieves a gun to keep in his lap. Not too long after that the gun is fired and Diane is struck in the back and they immediately go to a hospital. Despite efforts to save her life, Diane dies. As the investigation got under way, some started to believe that this was no accident and that Claude 'Tex' McIver may have planned his wife's death and that a hidden will holds the key to his motivation...
Tex McIver couldn't get the new resident of the luxury condo complex out of his mind. She ignored all his entreaties to meet him, and he finally contrived to "bump into" her at the complex's gym early one morning. Diane was a powerful and successful businesswoman who eventually would marry Tex. But on a sultry September night a year ago, he killed her. Learn more about your ad choices. Tex McIver claims a fatal bullet in his wife’s back was an accident, but prosecutors charge the Atlanta lawyer with intentionally shooting Diane McIver. The attorney is also accused of asking witnesses to lie to police. His spokesman told reporters the gun was in his lap because he feared being attacked by “Black Lives Matter” demonstrators while driving in midtown Atlanta and he pulled the trigger while napping. Nancy Grace talks with Atlanta lawyer Rene Rockwell about the case in this episode.
