A brewery's trademark and its subsequent labels are its identity and protecting that involves many steps that involve beverage lawyers, government agencies, keeping tabs on other breweries and so much more. Today we speak to three guests with an eye on trademark protection, homage/parody vs. intellectual property theft and the legal ramifications of what happens when the judicial system has to get involved. This is a fascinating part of the beer world. Guests:Brian Kulbacki of Departed Soles Brewing. Brian is a 2012 Graduate of the American Brewers Guild Brewing School, where he took their Intensive Brewing Science & Engineering course for Breweries in Planning. Prior to that he graduated from Boston College with a double major in Marketing & Finance. He has worked in marketing for the New England Patriots/Revolution and the Lakewood BlueClaws, as well as finance for Major League Baseball and Royal Caribbean Cruise Lines. He has also managed operations for a family business. Brian founded Departed Soles Brewing Company in 2014, which in 2015 opened its doors to become the first brewery in Jersey City, New Jersey since prohibition, and the first brewery on the east coast to craft gluten free beer in dedicated equipment, along with traditional glutenous beers. The brewery has won medals at GABF, the World Beer Cup, and Best of Craft Beer Awards, among others. The brewery is now run by Brian's dog, Bogan.Bill Covaleski of Victory Brewing Co. Bill has played a pivotal, creative role in leading the overall growth strategy of Victory Brewing Company. He serves as creative muse and guide for Victory beer brands and culinary collaborations as well as a driving force behind community engagement. So I’m just going to start by saying this might have been my favorite interview ever. Maybe it’s the Pennsylvania connection, or maybe it’s just Bill’s way of giving zero fucks while also being a strong competitor in the market, or maybe it’s just the lame-duck ease with which he’s handling himself after the sale and partnership with a private equity group and Southern Tier Brewing, but yeah, I think this is the one. It summarizes everything I love about doing the podcast. People sit in that chair across from me, either ready to do battle, or ready to dance, and I have the utmost appreciation for how open they are about their lives and business with me for an hour. And then letting me share it with you all. I’ve said many times that this podcast isn’t an issues-driven show — and by that I mean that I’m not looking for a hot take or new trend thinkpiece fart, or recent acquisition gossip. I’m trying to document an oral history for an industry that’s changing faster than I could possibly record. It’s guaranteed to fail in the sense that I’ll always miss more opportunities than I get. But if I thought about that, I’d probably have a panic attack. Instead, I just get what I can and hope for the best. Bill was in town for an event at the Hopleaf alongside Sam Calagione of Dogfishead and Greg Koch of Stone Brewing when this recording took place. And while I was about to hit the road, the only timeslot I had was late on a Sunday night after putting the kids to bed and Bill was happy to oblige. I’m thankful for that. Victory Brewing, man, I don’t think there’s a brewery that better defines that first wave resilience of craft beer, but still adapts and riffs on its own success to remain relevant and pioneering here in 2016. And I think you’l understand why after hearing this conversation.
On Friday Feb 12, we had the pleasure of sitting down with the co-founder of Victory Brewing Co, Bill Covaleski at City Tap House, 4 days before they announced a merge with Southern Tier Brewing Co. We had an idea something was up, but Bill couldn't really talk about it yet. In light of the news, it's fun to listen to Bill's answers to our questions, he was telling us without really telling us. City Tap House was hosting a VBC 20 year anniversary party, there were 20 Victory Beers on tap, and plenty of Victory people in the bar. This was a fun one.
