According to the National Association of Legal Professions, when I graduated from Law School in 1988 only 2.7% of graduating attorneys made the choice to go solo.Looking at those same numbers, it's easy to track the strength of the economy with the number of new attorneys going solo increasing during economic downturns. But now that so much of the work we do can be done virtually, what used to be one of the largest challenges for any attorney deciding to hang out their own shingle – finding physical office space – has all but been eliminated. As my guest today points out, with the ability to work remotely no longer in question, the stigma of being what was once called “post-office attorney” is fading.Nikita Lamar is an attorney specializing in Family Law, Trademarks, and Probate & Estate Planning. After graduating from Law School in the wake of the Great Recession, Nikita would found The Lamar Legal Group and, as she herself has written, her commitment to preserving what clients have worked tirelessly to build is the cornerstone of her practice. We talk about her unlikely journey to law school, practical and philosophical tips for attorneys thinking of starting their own practice, and how vulnerability and empathy can coexist with zealousness. Enjoy the show!

We uncover the inefficiencies and pitfalls of AI-driven decisions and the hurdles sellers face in this tech-centric landscape. Listen as we provide practical guidance on navigating these complex waters and ensure your innovations don't unintentionally step on existing patents, using tools like Google Patents as a starting point. Wrapping up, we strategically dissect the considerations for obtaining patents, with a keen eye on cost-effectiveness and market impact. From the nuances of small vs. large-scale product launches to the significance of securing patents across different jurisdictions, Rich shares wisdom from his book, "The ABA Consumer Guide to Obtaining a Patent." What are the implications of recent court decisions for artificial intelligence systems trained on copyrighted materials? In this episode I get to speak with two repeat veteran guests of the podcast about two important cases dealing with fair use analysis in the context of large language model training. Here are a couple of highlights: • Courts found AI training to be "transformative use" because the process changes the works significantly through tokenization and processing.• Judges distinguished between legally obtained training data (dismissed claims) and pirated training data (allowed claims to proceed).• Both judges signaled that if plaintiffs had focused on AI outputs reproducing substantial portions of their works, outcomes might have been different.• The transformative nature of AI training was deemed significant enough to qualify as fair use even for commercial enterprises• One judge noted that if copyrighted works are essential for training models worth "billions, if not trillions," developers must find ways to compensate copyright holders.About Our GuestsRyan Phelan and Tiffany Gehrke are recognized thought leaders in emerging technology law and artificial intelligence. Both are partners at Marshall, Gerstein & Borun LLP and returning guests on the Emerging Litigation Podcast.Ryan has written extensively on digital innovation, including intellectual property issues related to cutting-edge AI systems. He is the moderator of PatentNext, a blog focused on patent and IP law for next-generation technologies. "This is a fun parlor game. Name a band, a song by that band and then an album from that band that are all named exactly the same. Here is an example. Bad Company by Bad Company on the album Bad Company. There are many that are close but a true Trilogy is all three exactly the same."

Reimagining Intellectual Property in the Age of Luxury Tech: I'm curating this exclusive side event in Geneva on September 1 during the Luxury Innovation Summit. Limited seats, apply now to join the conversation. On this episode, we discuss how the explosive growth of the influencer economy has created a fascinating new frontier in intellectual property law, where personal brands clash with corporate interests and digital avatars raise unprecedented legal questions. This episode unpacks the high-stakes IP battles reshaping the $20 billion influencer industry, revealing how savvy creators protect their most valuable asset, their identity. Through compelling case studies like Charli D'Amelio's strategic trademark registrations and the legendary "Battle of the Kylies" between Jenner and Minogue, we explore how influencers transform fleeting social media fame into lasting, legally-protected brand equity. But the legal landscape doesn't just apply to human influencers. We venture into the uncanny valley of virtual personalities like Lil Miquella and Noonoouri, examining how these digital beings, composed entirely of intellectual property, navigate contracts, licensing, and disclosure requirements. As luxury brands increasingly embrace these pixel-perfect ambassadors who never age and never sleep, the boundaries between creative assets and personas continue to blur. The global response to these challenges reveals fascinating cultural and legal differences. From Tennessee's groundbreaking AI-ELVIS Act protecting voice rights to China's comprehensive regulations on "deep synthesis" content, we witness how legal frameworks worldwide are evolving to address deepfakes, digital cloning, and the ownership of virtual identities.Whether you're an influencer building your personal brand, a marketer navigating partnership agreements, or simply curious about the legal infrastructure behind social media fame, this episode offers crucial insights into who truly owns your digital presence—and how to protect it. Remember: in the high-stakes world of influence, the law isn't here to rain on your parade; it's here to ensure you own the parade itself.Subscribe now to explore the intersection of intellectual property and digital influence, and join us at the Luxury Innovation Summit 2025 in Geneva this September for our special event on IP in the age of luxury technology.Send us a textSupport the show
"Naming a band can be quite difficult. The list of bands we will discuss today went back into history to grab a name or an event to come up with a moniker. You know a good many of them. "
I asked the BIT Crew to nominate their favorite episodes for a special August replay while we are on hiatus. I selected one of Thea's picks because it went back to season one - when we were all baby holers. She says, "Googlie Wooglie I like a lot because of Sensei Ken, the fun game with cool words, and just love Geoff's Keanu Reeves impersonation, and Keanu Reeves as Abraham Lincoln." Episode Five has what I consider our best ending. We all break each other—even Billy Merritt. I dare you not to laugh. We'll be back on September 13th with a brand new hole! ~~ In rabbitHOLE's fifth episode, the BIT CREW educates listeners about some critical issues, including: Googlie Wooglie Mc Dojo Grammar Police Konrad takes a deep dive into the origins of the term GOOGOL (a one with a hundred zeroes). He starts the BIT CREW off on an improv adventure of surf lingo, organized crime involving unsuspecting UK co-eds, "re-imagining" history, and mispronouncing words. Episode five has our favorite ending so far…we all just lost it – we hope you laugh so much your sides will ache, and your heart goes pitter-pat. As always, rabbitHOLE is unscripted and inspired by the CREW's real-life rabbit hole adventures. If you enjoy rabbitHOLE, follow, rate, and share rabbitHOLE with your friends! Guess what: your million-dollar idea isn't safe. Not unless you know the difference between a patent, a trademark, and a trade secret. In this episode, Matt and Lou sit down with IP attorney Austin Bonderer to reveal the legal toolbox small businesses and startups need to protect what matters most: your ideas, brand, and secret sauce. They dive into patent basics, trademark headaches, global filing strategies, AI risks, and trade secrets worth their weight in gold. Here's what you'll learn: ✅ Patents = a government‑granted monopoly (the why and how) ✅ The three must-have criteria: useful, novel, unobvious ✅ Design patents cover looks; utility covers functionality ✅ Trademarks aren't just logos; they protect consumers by preventing confusion ✅ Patent trolls explained; intellectual property as investment ✅ Global patents via PCT; 30-month deadline to enter country filings ✅ Trade secrets = your unregistered secret sauce (think Coca‑Cola recipe) ✅ AI disclosures can kill your patent (think twice before feeding it secret ideas) ✅ Public domain explosion: patents expire after ~20 years; copyrights ~90 years + life Who is Austin? Austin Bonderer is the founder of the Law Offices of Austin Bonderer, dedicated solely to intellectual property. A former patent examiner and stalwart lawyer, his passion is helping entrepreneurs actually protect their work without draining their budgets.
In this episode, hosts Brad and Michael share the story of a physician starting her own wellness practice. While she took many important steps to launch her business, she overlooked a critical early step: conducting a trademark search. This led to a cease and desist letter that threatened her brand and practice just weeks before opening. Tune in to learn how to legally protect your brand, why picking a business name or website alone is not enough, and how proper trademark due diligence can protect your practice. Gordon Firemark is the podcast lawyer. I first had a chance to meet him at Podcast Movement in the late 10's. In 2022 I might have had a few cocktails when I asked him about hoe to manoeuvre cross-broder conflicts between podcasters. In this episode I ask the rest of the questions I had.We discuss the importance of clear agreements between co-hosts and why you need a guest release forms. We then tackle the complexities of using music in podcasts due to copyright laws. Gordon explains the differences between copyright, trademark, and patent law, and how to protect podcast brand names and segments through trademark registration. But wait! There's more! There's sponsorship agreements, the importance of proper disclosure, and the challenges posed by international regulations, particularly for Canadian podcasters. Gordon also shares a few real-life anecdotes that illustrate the potential pitfalls of not having written agreements or proper permissions, such as costly legal disputes and misunderstandings with sponsors. (This one is jaw dropping)Practical advice: Get everything in writing, understand your rights, and always prioritize clear communication to avoid legal entanglements in podcasting. We spoke about having a guest release form to ensure that podcasters don't encounter any misunderstandings between them and their guests. Apparently, you can't keep a good grifter down, as Billy McFarland's seven-figure Fyre Fest deal collapsed, so he's hawking the brand on eBay like a box of junk. Meanwhile, Indeed and Glassdoor are laying off over 1,000 workers, probably to pay for the AI that's jacking up our electric bills. Speaking of AI, a Tesla robotaxi crashed itself while Elon Musk's Grok chatbot went full Nazi, which is of course being installed in Teslas "next week." Fittingly, X CEO Linda Yaccarino stepped down and promptly lost her blue check. To cap off the dystopian news, the DOJ is targeting an anti-ICE app developer, the 'click-to-cancel' rule is dead, and you can hack McDonald's with the password ‘123456'. The future is now, and it's dumber than we ever imagined. On the media front, Murderbot gets a second season, and the Jim Henson and The Beach Boys documentaries are must-sees. Sadly, Netflix canceled The Residence. We also got trailers for Neuromancer, Project Hail Mary, and Edgar Wright's The Running Man. Speaking of building the future, we took a deep dive into AI-assisted coding using tools like Cursor, building a functional app in hours with zero original code. It's a stark reminder that while the "free lunch" of AI development is ending, the future for junior coders is already cooked. This glorious new world also includes playing every retro game ever on your phone, thanks to emulators like Delta and PPSSPP and the Backbone controller, which led to a nostalgic dive into the classic soundtracks of Mega Man 2 and Wipeout XL. This all culminated in a personal victory: conquering all 4,678 boards in Mahjong Titan+, freeing us from our porcelain thrones.Sponsors:DeleteMe - Head over to JoinDeleteMe.com/GOG and use the code "GOG" for 20% off.Private Internet Access - Go to GOG.Show/vpn and sign up today. "Here is the second show where we play songs you might not know were covers. Often the cover version of a song becomes a bigger hit. And even if you did know the hit was a cover you may not know the original. We will play you a few."
What's your intellectual property truly worth when it's on the line? Not what you hope or what you feel, but what courts, investors, and negotiators will actually pay. This episode of Intangiblia dives deep into the high-stakes world of IP valuation, where patents, trademarks, and copyrights transform from abstract legal protections into concrete dollar amounts. We journey through landmark global IP disputes that have defined how creative assets are valued in courtrooms from California to Colombia. The Samsung v. Apple design patent battle set precedent for how much of a product's profit can be attributed to its appearance. Epic Systems v. Tata Consultancy Services revealed the billion-dollar worth of trade secrets when they cross into competitors' hands. Meanwhile, cases like Liffers in Spain demonstrate that even moral rights, the right to be credited for your work, carry financial value that courts will recognize and enforce. The podcast unpacks three essential valuation methodologies that every creator should understand: cost-based (what it took to create), market-based (what others pay for similar assets), and income-based (what future earnings it will generate). Through fascinating case studies across industries, from pharmaceuticals to streaming services, sneakers to smartphones, we see how these approaches play out in real disputes with massive financial implications.Beyond methodology, we explore how valuation strategies differ across borders, with emerging economies like India pushing back against one-size-fits-all licensing rates, and Mexico's courts mandating that IP damages reflect genuine commercial impact. The digital transformation adds another layer of complexity, as shown in Disney v. Redbox, where even access codes carried enforceable intellectual property value.Whether you're protecting your creative work, licensing your technology, or facing infringement, this episode delivers a crucial message: in intellectual property, real power lies not just in registration but in pricing. Because in the world of IP, value isn't what you feel, it's what you can prove.Send us a text
"This is the first of a two show set. Often people are shocked to hear that a hit song is a cover. We have put together a long list of hit songs that are covers and we will play the original to you can hear where the hit you know came from."
Dive headfirst into the surprisingly cutthroat world of luxury watch intellectual property battles where the stakes are as high as the price tags. From Swiss ateliers to Silicon Valley boardrooms, the gloves come off when horological heavyweights defend their creations against customizers, competitors, and counterfeiters alike. When does personalization cross into infringement? The Rolex cases against Artisans de Genève and Becker Time reveal the fine line between owning a watch and owning its identity. We explore how courts have split hairs over modified dials, aftermarket bezels, and what it truly means for a timepiece to be "genuine" in the eyes of trademark law. Meanwhile, Vortic's vintage Hamilton restoration saga offers hope for artisans who respect heritage while creating something new.The battlefield extends beyond physical watches into digital domains. Samsung faced Swatch Group's wrath over app store watch faces mimicking luxury dials, while Richemont convinced courts to make internet service providers block counterfeit websites altogether. Even tech giant Apple wasn't immune when Swatch cheekily registered "Tick Different" and "One More Thing" trademarks, leaving the Cupertino company with no choice but to rebrand their smartwatch.Perhaps most fascinating is Audemars Piguet's global quest to protect their revolutionary Royal Oak design—a struggle revealing how difficult it is to claim exclusive rights to shapes that have defined entire categories. And as watches evolve into health monitors, AliveCor's patent war against Apple Watch's ECG feature shows us what happens when traditional horology collides with cutting-edge medical technology.Whether you're a watch enthusiast, legal professional, or simply fascinated by the intersection of luxury and law, these cases illuminate five timeless principles governing intellectual property in the modern marketplace.
