In this episode I speak with Karen Vladeck, an employment lawyer at the law firm Wittliff Cutter PLLC based in Austin, Texas. Karen represents corporate, start-up, and non-profit clients in the resolution of employment disputes and counsels clients from many different industries on employment-related issues. Before moving to Texas, Karen practiced employment law at Arent Fox LLP in Washington, D.C. After graduating from the University of Miami Law School, Karen started her legal career as a law clerk to Judge Mary Ellen Barbera of the Court of Appeals of Maryland (Maryland's highest court). In addition to her practice, Karen co-hosts a podcast called In Loco Parent(i)s with her husband Steve who is a professor at the University of Texas School of Law where they "discuss parenting and lawyering — in that order." In our conversation we discuss what employment lawyers do (and what she loves about that practice area), her unplanned path to Texas, the importance of both being lucky and making your own luck in finding career success, what its like to practice at a small, start-up-style law firm, strategies for balancing both personal and professional fulfillment in two-lawyer parent families, and what she loves and has learned from both podcasting and maintaining an active social media presence. While among corporations, women now comprise 28 percent of general counsel in the United States, the situation is worse in law firms where women represent only about 19 percent of equity partners. Scores of law firms have signed on to "The Mansfield Rule, "named after Arabella Mansfield, the first woman ever admitted to practice law in the U.S. Self-certification with this rule implies that firms must actively consider diverse candidates, including women for at least 30 percent of open leadership and governance roles in the firm, including equity partner promotions and lateral hires. Many other firms have signed on to implement formal sponsorship programs designed to retain and promote women attorneys to partnership, with the intent of limiting the high volume of female attorneys who leave the profession before they can get to a leadership position. intellectual property (IP) law is unfortunately not an outlier to this situation, despite the fact that in law schools IP classes are still mostly attended by female students. In this environment, today’s guest truly stands out. Cristina Carvalho is the managing partner of Arent Fox LLP, a law firm based in Washington, D.C., USA, with around 450 lawyers globally. She joined the firm in 1997, and in 2016 she was appointed managing partner at the firmwide level. In today’s episode, we discuss with Ms. Carvalho the challenges she faced to raise to the top, the pivotal role of women mentoring programs, what it means to be one of the most powerful women in Washington, D.C., the opportunity and asset of being both a Brazilian and American lawyer, and how IP can ultimately be a tool to promote a more inclusive business field. He is also a Counsel at the law firm of Arent Fox LLP.A veteran of several high-profile political campaigns Chen served as the policy director for the 2012 Mitt Romney campaign and most recently, Chen was a senior adviser to Senator Marco Rubio’s 2016 presidential campaign. On April 20, 2016, the Supreme Court decided Harris v. Arizona Independent Redistricting Commission. In 2012, the Arizona Independent Redistricting Commission redrew the map for the state legislative districts based on the results of the 2010 census. Wesley Harris and other individual voters sued the Commission and alleged that the newly redrawn districts were underpopulated in Democratic-leaning districts and over-populated in Republican-leaning ones and that the Commission had, therefore, violated the Equal Protection Clause of the Fourteenth Amendment. The Commission countered that the population deviations were the result of attempts to comply with the Voting Rights Act. A three-judge district court ruled in favor of the Commission. -- On appeal, the Supreme Court affirmed the judgment of the district court by a vote of 8-0. Justice Breyer delivered the opinion for a unanimous Court, which held that the federal district court did not err in upholding Arizona's redistricting plan. The challengers failed to demonstrate, the Court explained, that illegitimate considerations more likely than not were the predominant motivation for the plan's population deviations. -- To discuss the case, we have Mark F. “Thor” Hearne, II, who is Partner at Arent Fox LLP.

On December 8, 2015, the Supreme Court heard oral argument in Harris v. Arizona Independent Redistricting Commission. In 2012, the Arizona Independent Redistricting Commission redrew the map for the state legislative districts based on the results of the 2010 census. Wesley Harris and other individual voters sued the Commission and alleged that the newly redrawn districts were underpopulated in Democratic-leaning districts and over-populated in Republican-leaning ones, and that the Commission had, therefore, violated the Equal Protection Clause of the Fourteenth Amendment. The Commission countered that the population deviations were the result of attempts to comply with the Voting Rights Act. A three-judge district court ruled in favor of the Commission. -- There are two questions before the Supreme Court on appeal: (1) Whether the desire to gain partisan advantage for one political party justifies creating over-populated legislative districts that result in the devaluation of individual votes, violating the one-person, one-vote principle; and (2) whether the desire to obtain favorable preclearance review by the Justice Department permits the creation of legislative districts that deviate from the one-person, one-vote principle, and--even if creating unequal districts to obtain preclearance approval was once justified--whether this remains a legitimate justification after the Court’s decision in Shelby County v.
