Can one federal district court judge, even temporarily, be more powerful than the President of the United States? That's the issue at the heart of the critical debate over the legal remedy known as the nationwide injunction. The deployment of this legal remedy by federal district court judges has increased significantly in the past ten years, most acutely though during the presidencies of Donald Trump to enjoin, or stop, his administration's policies from being carried into full effect. The Supreme Court is poised to take up the scope as well as underlying justification for nationwide injunctions in the Trump v. Casa Inc. case, which is scheduled for oral argument on May 15. To help us understand nationwide injunctions and the stakes of the upcoming oral argument, we could think of no one better than our friend GianCarlo Canaparo. GianCarlo is the co-author of One Ring to Rule Them All: Individual Judgments, Nationwide Injunctions, and Universal Handcuffs published in the Notre Dame Law Review. GianCarlo is a senior legal fellow in The Heritage Foundation's Edwin Meese III Center for Legal and Judicial Studies. Canaparo's research focuses primarily on constitutional and administrative law. The Rich Zeoli Show- Full Show (03/17/2025): 3:05pm- On Friday, President Donald Trump issued orders to deport roughly 250 dangerous gang members who entered the U.S. unlawfully—sending them to El Salvador where they will be held at the country's “terrorism confinement center.” Judge E. Boasberg, of the U.S. District Court for D.C., ordered the Trump Administration to have the planes reverse course and return the detainees to the United States. However, due to the late timing of the order, the Trump Administration followed through with the deportation as planned. The administration contends the removals were lawful and within the established powers of the executive branch. 3:30pm- According to research from the Heritage Foundation's Oversight Project, former President Joe Biden signed dozens of executive orders with an “autopen”—raising questions about the legitimacy of those actions. Did Biden know what he was signing? Earlier this year, Speaker Mike Johnson (R-LA) revealed that during a closed-door meeting Biden had no recollection of signing an executive order that effectively froze new liquid natural gas export permits. On Wednesday, Hegseth spoke with the press on Capitol Hill and revealed that Trump encouraged him to keep fighting during a conversation earlier in the day. 3:15pm- Though no Republican Senator has publicly opposed Pete Hegseth's nomination to Secretary of Defense, Sen. The Supreme Court will determine the fate of a major Jan. 6 Capitol riot-related case. The ruling could affect hundreds of people who were in the Capitol that day in 2021, and at the center of the case is the applicability of a federal statute. The Justice Department has been using a statute enacted in the early 2000s to prosecute those in the Capitol on Jan. 6, 2021. The statute makes it a crime to “obstruct or impede or influence an official proceeding or attempt to do so,” according to Seth Lucas, a senior research associate with the Edwin Meese III Center for Legal and Judicial Studies at The Heritage Foundation. Former U.S. Central Command Commander General Kenneth McKenzie and former Joint Chiefs of Staff Chair General Mark Milley both testified that there was a severe lack of coordination. Gen. Milley conceded: “I'll be candid. I don't know the exact number of Americans that were left behind” in Afghanistan. In a recent interview Leslye Headland, writer/producer of the upcoming series “Star Wars: The Acolyte,” explained that one of her goals for the Star Wars franchise is to make it more inclusive. If a police officer has probable cause to believe a person illegally crossed the Rio Grande, that person could be charged with a Class B misdemeanor, which carries a punishment of up to six months in jail. For subsequent offenses, the person could be charged with a second-degree felony and face up to 20 years in prison. If the migrant is convicted and has served their sentence, a judge would be required to order police to transport them to a port of entry. To get federal approval, California claims it ‘needs' this ban to prevent harm to public health from particulate matter—airborne particles like dust, dirt and soot. But banning gasoline cars would do little to reduce particulate emissions, and it could even increase them. That's because new gasoline cars are very clean. According to the Environmental Protection Agency, cars emit only about 1% of all direct fine particulate matter in California, and most of those emissions come from older models. The newer gasoline cars that California wants to ban will often have particulate filters that reduce emissions to below one 1/1,000th of a gram per mile driven. Where do most particulate emissions attributed to cars come from? California speaks as if their primary source is the tailpipe. That was true in the past. But today most vehicle-related particulate matter comes from tire wear. Cars are heavy, and as their tires rub against the road, they degrade and release tiny, often toxic particles.
