Can one federal district court judge, even temporarily, be more powerful than the President of the United States? That's the issue at the heart of the critical debate over the legal remedy known as the nationwide injunction. The deployment of this legal remedy by federal district court judges has increased significantly in the past ten years, most acutely though during the presidencies of Donald Trump to enjoin, or stop, his administration's policies from being carried into full effect. The Supreme Court is poised to take up the scope as well as underlying justification for nationwide injunctions in the Trump v. Casa Inc. case, which is scheduled for oral argument on May 15. To help us understand nationwide injunctions and the stakes of the upcoming oral argument, we could think of no one better than our friend GianCarlo Canaparo. GianCarlo is the co-author of One Ring to Rule Them All: Individual Judgments, Nationwide Injunctions, and Universal Handcuffs published in the Notre Dame Law Review. GianCarlo is a senior legal fellow in The Heritage Foundation's Edwin Meese III Center for Legal and Judicial Studies. Canaparo's research focuses primarily on constitutional and administrative law. He earned his law degree from Georgetown University, where he was a published editor of the Georgetown Law Journal, and his bachelor's degree in economics from the University of California at Davis.Read More: The Best Way to Fix Nationwide InjunctionsOne Ring to Rule Them All: Individual Judgments, Nationwide Injunctions, and Universal Handcuffs

The Rich Zeoli Show- Full Show (03/17/2025): 3:05pm- On Friday, President Donald Trump issued orders to deport roughly 250 dangerous gang members who entered the U.S. unlawfully—sending them to El Salvador where they will be held at the country's “terrorism confinement center.” Judge E. Boasberg, of the U.S. District Court for D.C., ordered the Trump Administration to have the planes reverse course and return the detainees to the United States. However, due to the late timing of the order, the Trump Administration followed through with the deportation as planned. The administration contends the removals were lawful and within the established powers of the executive branch. 3:30pm- According to research from the Heritage Foundation's Oversight Project, former President Joe Biden signed dozens of executive orders with an “autopen”—raising questions about the legitimacy of those actions. Did Biden know what he was signing? Earlier this year, Speaker Mike Johnson (R-LA) revealed that during a closed-door meeting Biden had no recollection of signing an executive order that effectively froze new liquid natural gas export permits. While aboard Air Force One this weekend, President Donald Trump said that Biden's autopen pardons should be “null and void.” 4:05pm- Hans von Spakovsky—Senior Legal Fellow at the Edwin Meese III Center for Legal and Judicial Studies at the Heritage Foundation—joins The Rich Zeoli Show to discuss birthright citizenship. The Trump Administration has requested that the Supreme Court review the president's executive order effectively narrowing “birthright citizenship” to exclude children born in the United States to parents who are undocumented citizens residing in the country illegally. Federal courts in Maryland, Massachusetts, and Washington have paused President Donald Trump's executive order. 4:30pm- Bill D'Agostino—Senior Research Analyst at Media Research Center—joins The Rich Zeoli Show to break down some of the best (and worst) clips from the Sunday shows. D'Agostino compiled an incredible montage of the media worshipping Elon Musk before his endorsement of Donald Trump for president. PLUS Sen. Mark Kelly decided to sell his Tesla, explaining: "Every time I drive it, I feel like a rolling billboard for a man dismantling our government and hurting people.” And Joy Reid says the United States is no longer the land of opportunity—despite her $3 million salary. 4:50pm- On Friday, several Senate Democrats—following Senate Minority Leader Chuck Schumer's recommendation—broke the filibuster allowing Republicans to pass a continuing resolution bill that prevented a government shutdown at least through September. According to reports, Sen. Schumer is now being targeted for a primary challenge and must even delay his book tour due to progressive backlash. 5:05pm- On Friday, President Donald Trump issued orders to deport roughly 250 dangerous gang members who entered the U.S. unlawfully—sending them to El Salvador where they will be held at the country's “terrorism confinement center.” Judge E. On his first day in office, President Trump signed an Executive Order titled Protecting The Meaning And Value of American Citizenship which moves to end birthright citizenship practice which guarantees that U.S.-born children are citizens regardless of their parents’ status. The next day, attorneys general from 22 states sued to block the Executive Order by asserting that the President is attempting to eliminate "a well-established and longstanding Constitutional principle" by executive fiat.Join this expert panel for a discussion of this important and timely topic.Featuring:Amy E. What about statutory laws that directly impact the rights of parents of minor children—can they serve to shore up parental rights while the Supreme Court remains silent on the issue, as it has for 24 years and counting? Can a combination of litigation and legislation further strengthen the rights of parents to direct the care, upbringing, and education of their children?Join Heritage Foundation Senior Legal Fellow Sarah Parshall Perry and two panels of experts in family law and public policy as they provide answers to these questions and more during a half-day symposium on the American family in the crosshairs. Republicans will hold a 220 to 215 seat majority in the House of Representatives—though with Matt Gaetz's resignation and Elise Stefanik and Michael Waltz presumably leaving for cabinet positions, Republicans will have a slim two seat advantage until those vacancies are filled in early April.
The Rich Zeoli Show- Full Episode (12/04/2024): 3:05pm- According to a report from The Wall Street Journal, president-elect Donald Trump is considering replacing his Secretary of Defense nominee Pete Hegseth with Florida Governor Ron DeSantis, Senator Joni Ernst (R-IA), or former Pentagon official Elbridge Colby. On Wednesday, Hegseth spoke with the press on Capitol Hill and revealed that Trump encouraged him to keep fighting during a conversation earlier in the day. 3:15pm- Though no Republican Senator has publicly opposed Pete Hegseth's nomination to Secretary of Defense, Sen. Lindsey Graham (R-SC) revealed that he believes the allegations against the Fox News host are “disturbing.” 3:20pm- Rich argues that Republicans need to support Donald Trump's cabinet appointments—as this might be America's best chance to combat a massive, overreaching federal government. 3:30pm- In a statement on Truth Social, Donald Trump requested that Republican National Committee Chairman Michael Whatley remain in his position following the party's big Election Day wins. 3:40pm- Police Hunt for Gunman Who Killed UnitedHealthcare CEO: Chelsia Rose Marcius and Maria Cramer of The New York Times report: “A furious manhunt was underway in Manhattan after the head of one of the nation's largest health insurers was gunned down on Wednesday morning in what the police called a ‘brazen targeted attack.' A gunman lay in wait for the executive outside a hotel in Midtown, the heart of the city's business and tourist districts, and opened fire before fleeing into Central Park, according to investigators. Surveillance video obtained by The New York Times showed the gunman walking up behind the executive, Brian Thompson, as he approached the New York Hilton Midtown around 6:45 a.m. The gunman fires on Mr. Thompson, who stumbles and manages to turn toward his assailant. Investigators said the pistol jammed during the shooting, but the assailant quickly cleared the jam and resumed firing.” You can read more on this developing story here: https://www.nytimes.com/live/2024/12/04/nyregion/brian-thompson-uhc-ceo-shot/shooting-midtown-nyc-united-healthcare-brian-thompson?smid=url-share 3:50pm- On Wednesday, the United States Supreme Court heard oral argument for U.S. vs Skrmetti—a case which centers around the legality of Tennessee's prohibition of “gender affirming care” for minors. During one exchange with Tennessee Solicitor General Matthew Rice, Justice Sonya Sotomayor bizarrely compared irreversible gender transition surgeries to side effects from taking an aspirin. Another notable moment featured Justice Sam Alito highlighting that there is no evidence that “gender affirmative treatments” reduce suicide—dismantling the argument that gender transition surgeries for minors amounts to life saving care. 4:00pm- Sarah Parshall Perry—Senior Legal Fellow for the Edwin Meese III Center for Legal and Judicial Studies at The Heritage Foundation—joins The Rich Zeoli Show to discuss oral argument in the Supreme Court case U.S. v. The Rich Zeoli Show- Full Episode (07/22/2024): 3:05pm- On Sunday, in a post to the social media platform X, President Joe Biden announced that he would withdraw immediately from the 2024 presidential race. He reasoned: “It has been the greatest honor of my life to serve as your President. And while it has been my intention to seek reelection, I believe it is in the best interest of my party and the country for me to stand down and to focus solely on fulfilling my duties as President for the remainder of my term.” Later Biden posted once more from his X account, endorsing his Vice President Kamala Harris as his successor: “My very first decision as the party nominee in 2020 was to pick Kamala Harris as my Vice President. And it's been the best decision I've made. Today I want to offer my full support and endorsement for Kamala to be the nominee of our party this year. Democrats—it's time to come together and beat Trump.” 3:15pm- Will Kamala Harris ultimately become the Democratic Party's presidential nominee? President Joe Biden, former Speaker of the House Nancy Pelosi, Governors Gretchen Whitmer and Gavin Newsom have all endorsed Harris. It could be difficult for another candidate to challenge her. Reid Epstein of The New York Times writes: “Only officials at the Democratic National Committee and the Biden campaign have the full roster of delegates. If someone decided to run against Ms. Harris, the first challenge would be to gain access to the people who will make that decision. Without access to the delegate list, alternative candidates to Ms. Harris are effectively blocked from both canvassing the delegates for their opinions and trying to persuade them to support someone other than Ms. Harris. There is no evidence to date that any serious political campaign other than Mr. Biden's and the D.N.C. has made an effort to reach out to the convention's delegates.” You can read the full article here: https://www.nytimes.com/article/biden-drop-out-nomination-delegates-harris.html 3:40pm- In response to Joe Biden withdrawing from the 2024 presidential race and endorsing Kamala Harris as his replacement, former Democrat presidential candidate Tulsi Gabbard urged voters to cast their ballots for Donald Trump. 4:05pm- Dr. Ben Carson—Former U.S. Secretary of Housing and Urban Development & a Retired Neurosurgeon and Professor of Medicine at Johns Hopkins University—joins The Rich Zeoli and reacts to Joe Biden's decision to withdraw from the 2024 presidential race and his endorsement of Kamala Harris as his replacement. How will Harris fair as a general election candidate? PLUS, as president, would Harris ban cheeseburgers??? Dr. Carson's new book— “The Perilous Fight: Overcoming Our Culture's War on the American Family”—which he co-authored with his wife Candy Carson, is available here: https://a.co/d/5RggqEs 4:15pm- Matt starts the week off in the doghouse—violating two of Rich's most important rules: no boy band music and no national polls! 4:30pm- Rich notes that people forget, but Kamala Harris was such a bad presidential candidate in 2020 that she was forced to withdraw from the race before the California primary because she was polling at 8% in her home state—behind Joe Biden, Bernie Sanders, and Elizabeth Warren. 4:40pm- On Monday, Secret Service Director Kimberly Cheatle testified before the House Oversight and Accountability Committee about the law enforcement agency's failures at Donald Trump's July 13th campaign rally in Butler, PA where the former president was nearly assassinated. During one notable exchange, Rep. Rep. Raja Krishnamoorthi (D-IL) grilled Cheatle—asking why the rally wasn't at least paused when Secret Service became aware of the eventual shooter? 4:50pm- Double or Nothing: Weeks ago, Rich bullied Matt into accepting a terrible bet. Rich wins $1,000 if Democrats replace Joe Biden as the party's presidential candidate. Matt wins 1 pepperoni pizza if Biden remains the candidate. Now that Biden has withdrawn, Rich proposes a new bet: double or nothing! If Kamala Harris is the Democrat Party's nominee, Matt wins 2 pepperoni pizzas—if she isn't, he owes Rich $2,000. That's pretty fair, right? 5:05pm- On Sunday, in a post to the social media platform X, President Joe Biden announced that he would withdraw immediately from the 2024 presidential race. Democrats—it's time to come together and beat Trump.” 5:10pm- In response to Joe Biden's decision to withdraw from the 2024 presidential race, Frank Biden—the president's brother—said that the Joe's health played a major role in his decision to step aside and endorse Kamala Harris. 5:20pm- Leave or Else: Isabel Vincent of The New York Post writes: “Operatives at the very highest levels of the Democratic Party threatened Joe Biden with forcibly removing him from office unless he stepped down, sources told The Post. The well-orchestrated “palace coup” to stop the faltering president seeking re-election has been in place for weeks, but stubborn Biden fought against it every step of the way, a source close to the Biden family told The Post Monday… Part of the ‘elaborate' strategy to remove Biden from the race—as he announced in a shock letter posted on X Sunday—was allowing him to debate Republican candidate Donald Trump last month on live TV in Atlanta. During the car crash 90-minute debate, Biden appeared confused, slack-jawed and at one point he froze up, with his shocking performance turning the tide against him.” She continues: “Although Biden immediately endorsed Vice President Kamala Harris as the Democratic candidate for president, the source said Democratic delegates will be strongly encouraged to instead back Arizona senator and former astronaut Mark Kelly for president at the Democratic National Convention in Chicago in August.” You can read the full article here: https://nypost.com/2024/07/22/us-news/top-dems-threatened-to-remove-biden-unless-he-resigned/ 5:30pm- Kamala Harris is “unburdened by what has been!” PLUS while appearing on CNN, Van Jones cried when hearing the news that Joe Biden had decided to withdraw from the 2024 presidential campaign. Matt reveals that he saw Van at the Milwaukee airport last week! 5:40pm- While appearing on Fox News, former presidential candidate Vivek Ramaswamy said he believes Democrats will ultimately bypass Kamala Harris and make Michelle Obama their party's presidential nominee. 5:50pm- Earlier today, President Joe Biden called into the Kamala Harris campaign team (which had been his campaign team prior to his withdraw on Sunday). Biden told the team: “I know yesterday's news was surprising.” He also vowed to campaign alongside Harris. 6:05pm- On Monday, Kamala Harris spoke to the media for the first time since Joe Biden withdrew from the 2024 presidential race and endorsed her as the nominee. Harris said of Donald Trump: “I will proudly put my record against his.” Harris also baselessly alleged that “Donald Trump wants to take our country backwards”—stripping American citizens of inherent rights. 6:15pm- A damning CNN News report from 2020 featuring Renata Espinoza—wife of fallen police officer Isaac Espinoza—documents Kamala Harris' failures as San Francisco District Attorney. Harris has defended her decision to refuse seeking the death penalty for the man who killed Officer Espinoza in 2004. Former San Francisco Police Officer's Association President Gary Delagnes says Harris viewed the officer's death as a “political opportunity.” At the time, even then-Senator Dianne Feinstein (D-CA) rebuked Harris' decision. 6:25pm- Earlier today, President Joe Biden called into the Kamala Harris campaign team (which had been his campaign team prior to his withdraw on Sunday). Biden told the team: “I know yesterday's news was surprising.” He also vowed to campaign alongside Harris. 6:40pm- Last week, Sarah Parshall Perry—Senior Legal Fellow for the Edwin Meese III Center for Legal and Judicial Studies at The Heritage Foundation—joined The Rich Zeoli Show from the Republican convention in Milwaukee Wisconsin to discuss Judge Aileen Cannon's recent ruling that the appointment of Jack Smith as special counsel was unconstitutional. Consequently, the classified documents case brought against former President Donald Trump was dismissed.
The legal status of cannabis has been a controversial issue ever since the Controlled Substances Act of 1970 (CSA) prohibited its distribution under federal law. That act classified cannabis as a Schedule I drug, a category for drugs that have no legitimate medical use and cannot be used safely even under medical supervision. Schedules II-V are for drugs that have a legitimate medical use and pose a decreasing risk of harm. Congress placed cannabis in Schedule I but authorized the attorney general, in consultation with the Secretary of (what is now) Health and Human Services, to reschedule it. Recently, Attorney General Merrick Garland announced that the Biden Administration has decided to recategorize cannabis and place it into Schedule III. That announcement raises numerous legal, policy, and political issues. Our panelists—Harvard Medical School Professor Bertha Madras and Ohio State Law School Professor Douglas Berman—will discuss them.Featuring:Prof. Douglas Berman, Newton D. Zack Smith, Senior Legal Fellow and Manager, Supreme Court and Appellate Advocacy Program, Edwin Meese III Center for Legal and Judicial Studies, joins the program to discuss the Trump conviction. Zack breaks down what went wrong for Trump as far as the court being stacked against him from the get go. How will the appeal process go? The double standard in justice here is fascinating, seeing how Alvin Bragg does not typically charge misdemeanor crimes. Will there be any repercussions over COVID?
Yesterday was a sad day in America, the jurors of NY were unable to look past their political biases and brought back a guilty conviction against Donald Trump on all 34 counts. At a press conference today, Biden gave an evil grin when asked about persecuting political opposition. Trump is the leader of the populist movement in this country and nothing showed that more than the $35 million brought in from small donations within 12 hours of the verdict. Steve Bannon gives us exclusive insight as to where we are and how we alchemize this into a positive movement. From grassroots campaigning to effectively using official apparatuses we have available, it's time to take collective action. Andrew Giuliani is with us directly from Trump Tower as President Trump delivered his press conference. Andrew shares the resilient attitude from inside Trump Tower to inside the court when the verdict was read. Listener of the show, Stephanie, wrote to us to explain how most of us feel. Confused. How were these charges brought against President Trump, particularly after the statute of limitations had expired? Luckily, we have expert legal advice from Zack Smith. Zack is manager of the Supreme Court and Appellate Advocacy Program in the Edwin Meese III Center for Legal and Judicial Studies at The Heritage Foundation. He breaks down the verdict and what to expect looking forward. Learn more about your ad choices. Visit megaphone.fm/adchoices
The Rich Zeoli Show- Hour 4: 6:05pm- Amy Swearer—A Senior Legal Fellow in The Heritage Foundation's Edwin Meese III Center for Legal and Judicial Studies—joins The Rich Zeoli Show to discuss a maddening story about an elderly Pennsylvania homeowner who has been arrested for defending himself during a home invasion. You can read more about the story here: https://reason.com/2024/05/01/this-elderly-man-was-arrested-after-shooting-a-burglar-in-self-defense-because-his-gun-was-unlicensed/. And you find Swearer here: https://www.heritage.org/staff/amy-swearer. 6:30pm- Did Manhattan District Attorney Alvin Bragg's “hush money” case against former President Donald Trump just blow up? Matthew Haag of The New York Times writes: “Defense lawyers for Donald J. Trump painted the lawyer who negotiated the hush-money deal at the center of his criminal trial as a serial extortionist, accusing him of taking aim at Mr. Trump before the 2016 election with a porn star's account of a sexual liaison. The lawyer, Keith Davidson, spent hours on the stand describing how he received the $130,000 payment for the woman, Stormy Daniels, from Mr. Trump's longtime fixer, Michael D. Cohen, and the mad scramble that ensued when the story got out anyway. The cross-examination quickly turned hostile: Mr. Trump's lawyers sought to cast Mr. Davidson as a shakedown artist who took aim at celebrities including Tila Tequila and Charlie Sheen, while he fought back by suggesting they were using loaded language like ‘extortion' to stigmatize legitimate settlements.” During his opening monologue Rich notes that during testimony, Davidson said he did not consider the payments from Trump to be “hush money.” You can read more here: https://www.nytimes.com/live/2024/05/02/nyregion/trump-hush-money-trial/trump-trial-keith-davidson-testimony?smid=url-share 6:40pm- Rich Lowry of National Review points out: “The Alvin Bragg case has gotten grander at trial, but also more ridiculous. The Manhattan DA has a meaningless business-records misdemeanor wrapped within a theory about an alleged Trump conspiracy to defraud the voters by denying them disparaging information before the election and obscuring, after the fact, the payments that were used to do so. Bragg is accusing Trump, in effect, of stealing the election. If this is the standard by which we judge elections, we need to go back and conclude that Bill Clinton wasn't elected legitimately in 1992, either. The Arkansas governor's political operation was, in part, an elaborate conspiracy to keep women who alleged to have had affairs with Clinton quiet. Hillary Clinton was an active participant in the schemes. And so, by Bragg's logic, this Democratic power couple—dominant in the party for a decade or more and still honored today—comprises election thieves.” You can read the full article here: https://www.nationalreview.com/2024/04/remember-when-bill-clinton-stole-the-1992-election/

PLUS, the New York Times's Maggie Haberman claims that “Trump left the courtroom, squinting strangely at Lawrence O'Donnell, the MSNBC host, as he did.” Don't forget, Haberman famously complained that Trump “glared” at her during a court appearance last month. Will Manhattan District Attorney Alvin Brag prosecute Trump for “glaring” and “squinting” next? 4:40pm- In a particularly bizarre segment from MSNBC's Morning Joe, host Joe Scarborough predicted that if Donald Trump wins the 2024 presidential race, he will “arrest political enemies” and “execute generals that don't follow his commands”—even using “SEAL Team 6 to execute political opponents.” Speaking of dictators, did you know that an estimated 16 million people are descendants of Genghis Khan? 5:05pm- After leaving court on Thursday, former President Donald Trump visited with the NYPD and FDNY—brining a mountain of pizzas with him! 5:10pm- While speaking with the press, a spokesperson for the UCLA anti-Israel protesters proclaimed that the university was “founded on colonialism,” calling it a “violent institution.” She went on to condemn the United States of America as being evil and called for the dismantling of the country's institutions. 5:20pm- The Wall Street Journal Editorial Board writes: “Why pass laws when the Biden Administration ignores them? The latest example is a new rule that purports to codify permitting reform in Congress's debt-ceiling deal last year. Instead, the rule creates a pocket veto for fossil fuels and public works while rubber-stamping green projects. Permitting reform for we, but not thee… The Administration's new rule ignores the law by making it easy to kill projects that progressives oppose… Senate Majority Leader Chuck Schumer promised West Virginia Sen. Joe Manchin he'd take up permitting reform in return for supporting the Inflation Reduction Act. But Democrats in Congress blocked significant reforms, and now the Administration guts even the minor reforms in the IRA.” You can read the full article here: https://www.wsj.com/articles/permitting-reform-rule-biden-administration-green-projects-fossil-fuels-environment-2396058a?mod=opinion_lead_pos2 5:40pm- Pro-Israel and Pro-Palestine demonstrators at Alabama University shared a brief moment of unity when both sides began chanting “F*** Joe Biden.” Who says we can't all come together? 6:05pm- Amy Swearer—A Senior Legal Fellow in The Heritage Foundation's Edwin Meese III Center for Legal and Judicial Studies—joins The Rich Zeoli Show to discuss a maddening story about an elderly Pennsylvania homeowner who has been arrested for defending himself during a home invasion. The Supreme Court will determine the fate of a major Jan. 6 Capitol riot-related case. The ruling could affect hundreds of people who were in the Capitol that day in 2021, and at the center of the case is the applicability of a federal statute. The Justice Department has been using a statute enacted in the early 2000s to prosecute those in the Capitol on Jan. 6, 2021. The statute makes it a crime to “obstruct or impede or influence an official proceeding or attempt to do so,” according to Seth Lucas, a senior research associate with the Edwin Meese III Center for Legal and Judicial Studies at The Heritage Foundation. (The Daily Signal is the news outlet of The Heritage Foundation.)During oral arguments Tuesday, the justices appeared skeptical that the statute could be applied and used in the Jan. 6 cases the way it has been.“It was clear that enough justices were skeptical of the government's expansive reading of Section 1512(c) [of the statute in question] to make a reasonable guess that they're probably going to read the statute a little more narrowly,” Lucas said. Lucas joins “The Daily Signal Podcast” to explain the details of the case and what the ruling will mean for those men and women who are facing charges for their actions on Jan. 6. Enjoy the show! The Rich Zeoli Show- Hour 4: Zack Smith—Legal Fellow and Manager of the Supreme Court and Appellate Advocacy Program in the Edwin Meese III Center for Legal and Judicial Studies at The Heritage Foundation—joins The Rich Zeoli Show to discuss the U.S. Supreme Court's decision to temporarily permit Texas's Senate Bill 4 to take effect. The bill makes it a crime for migrants to illegally enter the United States and allows for Texas officials to arrest and/or deport anyone who recently entered the state unlawfully. On Monday “The Don Lemon Show” released its first episode—which included a long-form interview with billionaire Elon Musk. During the conversation, Lemon accused Musk of inaccurately claiming undocumented migrants can alter election outcomes. Musk then explained that undocumented migrants are counted in the census which can result in blue states receiving greater representation in the House of Representatives. On Tuesday, the House Foreign Affairs Committee held a hearing on the U.S. withdrawal from Afghanistan. Former U.S. Central Command Commander General Kenneth McKenzie and former Joint Chiefs of Staff Chair General Mark Milley both testified that there was a severe lack of coordination. Gen. Milley conceded: “I'll be candid. I don't know the exact number of Americans that were left behind” in Afghanistan. In a recent interview Leslye Headland, writer/producer of the upcoming series “Star Wars: The Acolyte,” explained that one of her goals for the Star Wars franchise is to make it more inclusive. Last year Disney announced a new director for its Star Wars film franchise—Sharmeen Obaid-Chinoy. Obaid-Chinoy has won two Academy Awards for short-films examining injustice in Pakistan, but does that make her the ideal selection for a sci-fi franchise? Obaid-Chinoy said that her goal as a filmmaker has been to “make men uncomfortable,” but aren't most Star Wars fans just looking for an enjoyable two-hour movie? Is Disney destroying the Star Wars franchise?
The Rich Zeoli Show- Full Episode (03/19/2024): 3:05pm- On Tuesday, the Supreme Court decided to temporarily permit Texas's Senate Bill 4 to take effect. The bill makes it a crime for migrants to illegally enter the United States—allowing for Texas officials to arrest and/or deport anyone who recently entered the state unlawfully. Adam Liptak of The New York Times writes: “The Supreme Court temporarily sided with Texas on Tuesday in its increasingly bitter fight with the Biden administration over immigration policy, allowing an expansive state law to go into effect that makes it a crime for migrants to enter Texas without authorization. As is typical when the court acts on emergency applications, its order gave no reasons. But Justice Amy Coney Barrett, joined by Justice Brett M. Kavanaugh, filed a concurring opinion that seemed to express the majority's bottom line. They were returning the case to an appeals court for a prompt ruling on whether the law should be paused while an appeal moves forward, Justice Barrett wrote. ‘If a decision does not issue soon,' she wrote, ‘the applicants may return to this court.' The three liberal members of the court—Justices Ketanji Brown Jackson, Elena Kagan and Sonia Sotomayor—dissented.” You can read the full article here: https://www.nytimes.com/2024/03/19/us/supreme-court-texas-immigration.html 3:30pm- What is Texas State Bill 4? Maria Mendez of The Texas Tribune writes that the “law would make it a state crime to cross the Texas-Mexico border between ports of entry. If a police officer has probable cause to believe a person illegally crossed the Rio Grande, that person could be charged with a Class B misdemeanor, which carries a punishment of up to six months in jail. For subsequent offenses, the person could be charged with a second-degree felony and face up to 20 years in prison. If the migrant is convicted and has served their sentence, a judge would be required to order police to transport them to a port of entry. A judge could drop the charges if a migrant agrees to return to Mexico, and police could turn over migrant families to Border Patrol agents to avoid separating children from their parents instead of arresting them.” You can read Menendez's full report here: https://www.texastribune.org/2024/03/18/texas-sb-4-immigration-arrest-law/ 3:40pm- Craig Rucker—President of The Committee for a Constructive Tomorrow (CFACT)—joins The Rich Zeoli Show to discuss a lawsuit his organization, alongside The Heartland Institute, recently filed against the Biden Administration “seeking to overturn their approval of Dominion Energy's plans to start construction of a massive offshore wind project off Virginia that ignores the obvious harm of the endangered North Atlantic right whale. The project consists of the 176 giant wind turbines—each tower taller than the Washington Monument, with turbine blades longer than a football field—to be constructed in the open ocean 25 miles off the coast of Virginia Beach. If completed, the project would be the largest of its kind in the world. This Dominion Energy project is one of many offshore wind projects mandated by an executive order issued by President Biden, declaring that a ‘climate crisis' exists that ‘threatens mankind's existence.'” You can read The Committee for a Constructive Tomorrow's (CFACT) full statement here: https://www.cfact.org/2024/03/18/coalition-sues-to-block-virginia-offshore-wind-project-to-protect-the-right-whale/ 4:05pm- While speaking at a campaign event in Ohio over the weekend, Republican presidential candidate Donald Trump predicted that there would be an economic “bloodbath” for the automotive manufacturing industry if he didn't win the 2024 presidential election in November. Democrats and dishonest members of the media took the statement out of context—instead suggesting that Trump had openly called for a “bloodbath”, or a massacre, should he lose. A selectively trimmed nine-second clip was reposted by numerous social media accounts belonging to members of the political left, including: Biden-Harris HQ and Joe Scarborough (who quickly deleted his post). The strategically edited audio inaccurately makes it appear as though Trump is calling for violence. On Monday, morning shows on ABC, CBS, and NBC all promoted the fake narrative as well. 4:10pm- While appearing on Fox News with Jesse Watters, independent journalist Michael Shellenberger warned that progressives, as well as members of the media, have focused on Republican presidential candidate Donald Trump's “bloodbath” comments as an excuse to censor Trump and his supporters—labeling them collectively as a “violent threat to democracy.” 4:25pm- In a new “opinion video” for The New York Times, journalists Adam Westbrook and Lindsay Crouse attempted to debunk the idea that the deep state is a threat to American civil liberties—and they did so by traveling to Huntsville, Alabama? You can watch the video here: https://www.nytimes.com/2024/03/19/opinion/trump-deep-state.html 4:40pm- In response to The New York Times's new “opinion video” attempting to debunk the existence of a deep state, billionaire Elon Musk accused the publication of being a “mouthpiece of the state.” 4:50pm- Thomas Catenacci of Fox News writes: “The State of Texas is terminating a massive $8.5 billion investment with trillion-dollar asset manager BlackRock over the state's determination that the firm is engaged in a boycott of energy companies.” You can read the full article here: https://www.foxbusiness.com/politics/texas-pulls-8-5-billion-blackrock-stunning-blow-esg-movement 5:05pm- While appearing on the Texas Lindsay podcast, Elon Musk—the owner of the social media platform X—revealed that the Federal Bureau of Investigation (FBI) used a special portal when communicating with officials at X (then-Twitter) which would “auto-delete” the conversations after two-weeks. Musk noted that this was likely a violation of the Freedom of Information Act. 5:15pm- Did The New York Times just admit that Republicans were right about COVID-19 lockdowns? The Daily Wire News writes: “An analysis piece from The New York Times this week admitted that Republicans by and large were correct—and Democrats were wrong—about policies that kept children out of school during the coronavirus pandemic. The report said that today there is ‘broad acknowledgment among many public health and education experts that extended school closures did not significantly stop the spread of Covid, while the academic harms for children have been large and long-lasting.'” You can read more here: https://www.dailywire.com/news/new-york-times-republicans-were-right-about-pandemic-school-policy-democrats-were-wrong 5:20pm- In a new “opinion video” for The New York Times, journalists Adam Westbrook and Lindsay Crouse attempted to debunk the idea that the deep state is a threat to American civil liberties—and they did so by traveling to Huntsville, Alabama? The government's accusation is likely to intensify scrutiny of the ties between President Joe Biden's brother and the associate, Mississippi businessman Keaton Langston. The Justice Department named Langston as a co-conspirator in the ongoing fraud case just three weeks after congressional investigators grilled Jim Biden about his relationship with the Mississippi businessman. In the course of a previous prosecution, the Justice Department identified a defendant in the fraud case, Florida businessman Thomas Farese, as a high-ranking member of the Colombo crime family, according to court filings.” You can read the full report here: https://www.politico.com/news/2024/03/18/doj-jim-biden-associate-mafia-boss-00147626 5:50pm- While answering questions from the press aboard Air Force One, White House Press Secretary Karine Jean Pierre confirmed that President Joe Biden and former President Barack Obama speak with one another often. 6:05pm- Zack Smith—Legal Fellow and Manager of the Supreme Court and Appellate Advocacy Program in the Edwin Meese III Center for Legal and Judicial Studies at The Heritage Foundation—joins The Rich Zeoli Show to discuss the U.S. Supreme Court's decision to temporarily permit Texas's Senate Bill 4 to take effect. The Rich Zeoli Show- Full Episode (03/04/2024): 3:05pm- In a unanimous 9-0 decision, the U.S. Supreme Court ruled that states cannot bar Republican presidential candidate Donald Trump from participating in the 2024 election—and, consequently, he cannot be removed from state ballots. Only Congress, according to the Court, is capable of enforcing Section 3 of the 14th Amendment, barring an individual guilty of participating in an insurrection from holding elected office. In the main opinion, the Justices write that “the Constitution makes Congress, rather than the States, responsible for enforcing Section 3 against federal officeholders and candidates…The Constitution empowers Congress to prescribe how those determinations should be made. The relevant provision is Section 5, which enables Congress, subject of course to judicial review, to pass ‘appropriate legislation' to ‘enforce' the Fourteenth Amendment…The ‘patchwork' that would likely result from state enforcement would ‘sever the direct link that the Framers found so critical between the National Government and the people of the United States' as a whole.” You can read the court's full decision here: https://www.nytimes.com/interactive/2024/03/04/us/supreme-court-ruling-trump-colorado.html 3:15pm- After the U.S. Supreme Court ruled that states cannot bar Republican presidential candidate Donald Trump from appearing on ballots, Rep. Jamie Raskin (D-MD) appeared on CNN announcing that—with the help of Rep. Eric Swalwell (D-CA)—he is working on a new strategy to bar Trump from 2024 ballots. 3:20pm- Charlie Savage of The New York Times writes: “In criticizing the majority for unnecessarily dismissing other potential ways federal officials might enforce Section 3 besides a congressional statute, the three liberal justices [Sonya Sotomayor, Elena Kagan, Ketanji Brown Jackson] do not specify what those alternative methods might be. But when it comes to presidents, one obvious alternative would be that when Congress meets to certify electoral college votes on the Jan. 6 after an election, lawmakers could refuse to count electoral college votes won by a candidate they deemed disqualified under Section 3—even without a statute. Justice [Amy Coney] Barrett, in her separate opinion, also says it was enough to rule that states lack the power to enforce Section 3 against presidential candidates and there was no need ‘to address the complicated question whether federal legislation is the exclusive vehicle through which Section 3 can be enforced.'” You can read more: https://www.nytimes.com/live/2024/03/04/us/trump-supreme-court-colorado-ballot/31379f62-f91f-57f7-a33e-37959bc68452?smid=url-share 3:30pm- While appearing on MSNBC following the Supreme Court's ruling in favor of Donald Trump, Colorado Secretary of State Jenna Griswold said that she was disappointed by the decision and that “it'll be up to the American voters to save our democracy in November.” Colorado's State Supreme Court had ruled that Trump was barred from holding office for his role in the riot at the U.S. Capitol on January 6, 2021. 3:40pm- Zack Smith—Legal Fellow and Manager of the Supreme Court and Appellate Advocacy Program in the Edwin Meese III Center for Legal and Judicial Studies at The Heritage Foundation—joins The Rich Zeoli Show to discuss the U.S. Supreme Court's ruling that states cannot bar Republican presidential candidate Donald Trump from state ballots. 4:05pm- A new poll from The New York Times/Sienna College shows that regardless of race, age, or gender more voters believe that former President Donald Trump's policies benefited them than did President Joe Biden's policies—40% to 18%. Perhaps most concerning for Biden, 43% of voters claim Biden's policies actively hurt them personally—only 25% said the same about Trump. You can read the full article, from Ruth Igielnik and Camille Baker, here: https://www.nytimes.com/2024/03/04/us/politics/trump-biden-policies-help-hurt.html 4:20pm- While appearing on Fox News with Maria Bartiromo, Senator J.D. Vance (R-OH) said that President Joe Biden's 2021 executive orders “opened the flood gates” at the U.S. Southern border. 4:25pm- President Joe Biden continues to insist that he has no control over the influx of migrants crossing the U.S. Southern border unlawfully. But as Rich Lowry notes in his most recent article for National Review, “Joe Biden was inaugurated on January 20, 2021. Less than two weeks later, on February 2, he issued the executive order that began the unraveling at the border in earnest. The border crisis isn't something that happened to President Biden. It's not a product of circumstances or understandable policy mistakes made under duress. No, he sought it and created it, on principle and as a matter of urgency.” Lowry continues: “The February 2 action… put on the chopping block numerous Trump policies that had helped establish order at the border, from Trump's expansion of expedited removal, to his termination of a parole program for Central American minors, to his memorandum urging the relevant departments to work toward ending ‘catch and release.' Most importantly, it went after two of the pillars of Trump's success at the border: the Migrant Protection Protocols (MPP), or so-called Remain in Mexico, and the safe-third-country agreements with the Northern Triangle countries that allowed us to divert asylum-seekers to Central American countries other than their own, where they could make asylum claims.” You can read the full article here: https://www.nationalreview.com/2024/02/the-day-joe-biden-blew-up-the-border/ 4:30pm- According to the cross-tabs portion of a recent New York Times/Sienna Poll, Donald Trump is projected to win the Hispanic vote outright—45% to 43%. Equally surprising, the poll indicates that if the election were held today, Trump would win 20% of the Black vote—he won only 12% in the 2020 presidential election. 4:40pm- Philadelphia Eagles Center—and future NFL Hall of Famer—Jason Kelce announced his retirement on Monday. Kelce played 13 seasons in the NFL, earning 6 All-Pro selections and winning Super Bowl LII. 4:50pm- In a new editorial in The Wall Street Journal, Micahel Buschbacher and Taylor Meyers write: “The Biden administration is reviewing California's plan to ban the sale of new gasoline-powered cars by 2035. To get federal approval, California claims it ‘needs' this ban to prevent harm to public health from particulate matter—airborne particles like dust, dirt and soot. But banning gasoline cars would do little to reduce particulate emissions, and it could even increase them. That's because new gasoline cars are very clean. According to the Environmental Protection Agency, cars emit only about 1% of all direct fine particulate matter in California, and most of those emissions come from older models. The newer gasoline cars that California wants to ban will often have particulate filters that reduce emissions to below one 1/1,000th of a gram per mile driven. Where do most particulate emissions attributed to cars come from? California speaks as if their primary source is the tailpipe. That was true in the past. But today most vehicle-related particulate matter comes from tire wear. Cars are heavy, and as their tires rub against the road, they degrade and release tiny, often toxic particles. According to measurements by an emission-analytics firm, in gasoline cars equipped with a particle filter, airborne tire-wear emissions are more than 400 times as great as direct exhaust particulate emissions.” You can read the full editorial here: https://www.wsj.com/articles/electric-cars-emit-more-soot-california-ban-gas-powered-vehicles-521b29e3?mod=opinion_lead_pos7 5:00pm- J. The Rich Zeoli Show- Hour 3: Responding to New York Judge Arthur F. Engoron's civil fraud trial decision, former President Donald Trump wrote on Truth Social: “A Crooked New York State Judge, working with a totally Corrupt Attorney General who ran on the basis of “I will get Trump,” before knowing anything about me or my company, has just fined me $355 Million based on nothing other than having built a GREAT COMPANY. ELECTION INTERFERENCE. WITCH HUNT.” In an editorial written for National Review last November, former Assistant U.S. Attorney for the Southern District of New York Andrew C. McCarthy wrote of Donald Trump's civil fraud case: “Banks are in the loan business to make money. They are heavily regulated and have shareholders to answer to. If a bunch of them had been collectively bilked out of $168 million, don't you imagine there would have been a lawsuit or ten? It's an amazing thing to watch: Donald Trump, front-runner in the Republican presidential nomination race, is on trial for supposedly inventing wealth that he didn't have; and in order to nail him, elected Democrats [Letitia] James and Arthur Engoron are inventing losses that no one ever suffered.” You can read the full article here: https://www.nationalreview.com/2023/11/elected-dem-ag-and-judge-cook-up-a-fraud-theory-in-trumps-new-york-trial/ While appearing on Fox News with Sean Hannity, Harvard Law Professor Alan Dershowitz reacted to testimony in Thursday's hearing to determine whether Fulton County District Attorney Fani Willis should be disqualified from the Georgia election interference case she brought against former President Donald Trump. Dershowitz explained that it is possible that Willis committed perjury. Meanwhile, during a CNN panel, lawyer Jeffrey Toobin said “so what” if Willis and lead prosecutor of the case Nathan Wade had a relationship. The Rich Zeoli Show- Full Episode (02/16/2024): 3:05pm- Breaking News: New York Judge Arthur F. Engoron found that the former president Donald Trump inflated the value of assets controlled by the Trump Organization in past financial statements. With no jury, Judge Engoron unilaterally chose to fine Trump $354 million and barred him from conducting business in New York for three years. Notably, in 2018, while campaigning to become New York Attorney General, Letitia James vowed to “sue” Trump and routinely spoke of how she would like to see him imprisoned—providing evidence to the defense's legal argument that this civil suit is entirely political. Trump's legal team is expected to appeal the decision. 3:30pm- In an editorial written for National Review last November, former Assistant U.S. Attorney for the Southern District of New York Andrew C. Engoron writes: “The English poet Alexander Pope (1688-1744) first declared, ‘To err is human, to forgive is divine.' Defendants apparently are of a different mind. After some four years of investigation and litigation, the only error (‘inadvertent,' of course) that they acknowledge is the tripling of the size of the Trump Tower Penthouse, which cannot be gainsaid. Their complete lack of contrition and remorse borders on pathological. They are accused only of inflating asset values to make more money. The documents prove this over and over again. This is a venial sin, not a mortal sin. Defendants did not commit murder or arson. They did not rob a bank at gunpoint. Donald Trump is not Bernard Madoff. Yet, defendants are incapable of admitting the error of their ways. Instead, they adopt a ‘See no evil, hear no evil, speak no evil' posture that the evidence belies.” 4:30pm- Dr. Victoria Coates— Former Deputy National Security Advisor & the Vice President of the Davis Institute for National Security and Foreign Policy at The Heritage Foundation—joins The Rich Zeoli Show to weigh-in on government, including intelligence agencies, being weaponized to target Donald Trump. Speaking from Palm Beach, Florida, Trump told the press that “the judge is just a corrupt person.” 6:30pm- Thomas Grove and Matthew Luxmoore of The Wall Street Journal write: “Alexei Navalny, a fierce anticorruption campaigner who galvanized Russia's political opposition, died in prison, according to Russian authorities, bringing to an end a life dedicated to fighting the country's descent into authoritarianism under President Vladimir Putin. The cause of his death was still being established, prison authorities said. He collapsed after a walk at his prison colony on Friday after which, they said, he lost consciousness and couldn't be revived. Navalny, who was 47 and had been in jail since 2021, was serving three prison sentences amounting to more than 30 years on charges he and his supporters said were fabricated. He was detained after returning from Germany, where he was recovering from what German doctors said was poisoning with a Soviet-era nerve agent, Novichok. Navalny blamed his poisoning on the Kremlin, which denied involvement in any attempt to harm him.” You can read the full article here: https://www.wsj.com/world/russia/alexei-navalny-dead-prison-putin-critic-d58db496?mod=hp_lead_pos1 6:40pm- The Wall Street Journal Editorial Board writes: “President Biden is trying to strike a contrast with Donald Trump by promising to stick by America's European allies. Perhaps he hasn't heard Vladimir Putin's media organs crowing that his Administration has double-crossed Europe by halting permits for new liquefied natural gas (LNG) export projects. ‘Now it is not Russia, but the United States that wants to bring the Germans to their knees,' gloated the Russian newspaper Pravda after the Energy Department imposed a moratorium on permits for new LNG export projects last month. Pravda argued that Germany will eventually have to return to buying Russian gas because it will have no other choice, and it may be right.” You can read the full editorial here: https://www.wsj.com/articles/biden-lng-exports-ban-russian-media-vladimir-putin-9d31e3a0?mod=opinion_lead_pos4
The Rich Zeoli Show- Full Episode (02/08/2024): 3:05pm- On Thursday, the U.S. Supreme Court heard oral argument in Trump v. Anderson—a case which will determine whether Colorado has the authority to deem Republican presidential candidate Donald Trump constitutionally ineligible to appear on the state's presidential ballot. In one notable exchange, Justice Ketanji Brown Jackson questioned Jason Murray, the attorney representing a group of Colorado voters attempting to remove Trump from the ballot. Referencing Section 3 of the 14th Amendment, Justice Jackson stated of the amendment's authors: “They were listing people who were barred [from office under the 14th Amendment] and president is not there.” According to most analysis, based upon questioning, it appears as though liberal justices Jackson and Elena Kagan will side with conservative justices for a lopsided decision rejecting claims that Trump is disqualified from holding elected office under the U.S. Constitution. 3:20pm- The Department of Justice's Special Counsel will not seek criminal charges against President Joe Biden for mishandling classified documents. Glenn Thrush of The New York Times writes: “The special counsel investigating President Biden said in a report released on Thursday that he had decided not to seek prosecution of Mr. Biden over his handling of classified material after leaving the vice presidency in early 2017, but had found evidence that Mr. Biden willfully retained and disclosed some sensitive material. The report said that Mr. Biden had left the White House after his vice presidency with classified documents about Afghanistan and notebooks with handwritten entries ‘implicating sensitive intelligence sources and methods' taken from internal White House briefings. Robert K. Hur, the special counsel, said in his report that Mr. Biden had shared the notebooks with a ghostwriter who helped him on his 2017 memoir, ‘Promise Me, Dad.'” You can read more here: https://www.nytimes.com/2024/02/08/us/biden-documents-special-counsel.html 3:40pm- During oral argument in Trump v. Anderson, Justice Brett Kavanaugh was skeptical of attorney Jason Murray's claim that individual states have the constitutional authority to deem a presidential candidate ineligible to hold elected office after citing an involvement in an insurrection against the U.S. government. Kavanaugh adroitly noted President Trump has not been charged with, or been found guilty, of insurrection. 4:05pm- In his report to the Department of Justice, Special Counsel Robert K. Hur writes of his decision not recommend not prosecuting President Joe Biden for mishandling classified documents: “Mr. Biden would likely present himself to a jury, as he did during our interview with him, as a sympathetic, well-meaning elderly man with a poor memory.” 4:10pm- Zack Smith—Legal Fellow and Manager of the Supreme Court and Appellate Advocacy Program in the Edwin Meese III Center for Legal and Judicial Studies at The Heritage Foundation—joins The Rich Zeoli Show to discuss the U.S. Supreme Court hearing oral argument in Trump v. Anderson, Justice Neil Gorsuch grilled attorney Jason Murray after he was unable to directly answer questions explaining why Republican presidential candidate Donald Trump should be disqualified from holding elected office. “Please don't change the hypothetical, ok? Please don't change the hypothetical…I'm not going to say it again, so just try and answer the question.” 4:50pm- Listeners react to Special Counsel Robert K. Hur's recommendation that the Department of Justice not charge President Joe Biden for mishandling classified documents. Is there a legal double standard considering former President Donald Trump faces 20+ years in prison for similar offenses? 5:05pm- Philip Klein from National Review writes: “President Biden couldn't even remember when he was vice president or when his son Beau had died, leading special counsel Robert Hur to conclude that he could not bring charges for mishandling of classified documents, because a jury would see the president ‘as a sympathetic, well-meaning, elderly man with a poor memory.' In a report, Robert Hur concluded that Biden ‘willfully retained and disclosed classified materials after his vice presidency when he was a private citizen.' But he declined to issue any charges, in part because Biden's poor recollection would make him hard to convict.” At one point in the report, Hur explains: “In his interview with our office, Mr. Biden's memory was worse. He did not remember when he was vice president, forgetting on the first day of the interview when his term ended (‘if it was 2013 – when did I stop being Vice President?'), and forgetting on the second day of the interview when his term began (‘in 2009, am I still Vice President?'). He did not remember, even within several years, when his son Beau died. And his memory appeared hazy when describing the Afghanistan debate that was once so important to him.” You can read the full article here: https://www.nationalreview.com/corner/special-counsel-account-of-bidens-mental-decline-is-frightening/ 5:30pm- Listeners react to Special Counsel Robert K. The Rich Zeoli Show- Full Episode (01/09/2024): 3:05pm- On Tuesday, a three-judge panel from the Court of Appeals for the District of Columbia Circuit heard arguments to determine the validity of Donald Trump's presidential immunity defense in his federal election subversion indictment. Two of the judges on the panel are Democratic appointees—Judge J. Michelle Childs and Judge Florence Y. Pan. Though, the third judge—Judge Karen L. Henderson—seemed equally unconvinced by the Trump team's legal argument. 3:15pm- Charlie Savage and Alan Feuer of The New York Times write: “Judge [Florence Y.] Pan asked [Donald Trump's Attorney John] Sauer to address a series of hypotheticals intended to test the limits of his position that presidents are absolutely immune from criminal prosecution over their officials acts, unless they have first been impeached and convicted by the Senate over the same matter. Among them, she asked, what if a president ordered SEAL Team 6, the Navy commando unit, to assassinate a president's political rival? Mr. Sauer said such a president would surely be impeached and convicted, but he insisted that courts would not have jurisdiction to oversee a murder trial unless that first happened.” You can read more here: https://www.nytimes.com/2024/01/09/us/politics/trump-immunity-hearing-takeaways.html?smid=url-share 3:30pm- Following Tuesday's Court of Appeals for the District of Columbia Circuit hearing, former president Donald Trump said that if his presidential immunity argument is proven to be unfounded then former president Barack Obama could, and should, be prosecuted for covert drone strikes he ordered in the Middle East—including one that resulted in the death of an American citizen, Anwar al-Awlaki. The strikes were conducted without congressional approval. 3:40pm- Defense Secretary Lloyd Austin spent several days in an intensive care unit at Walter Reed National Military Medical Center in Bethesda, Maryland following elective surgery—though the precise surgery has not been disclosed. Alarmingly, the White House—including President Joe Biden—was not informed of Secretary Austin's incapacitation for more than three days. Equally concerning, while Secretary Austin was in intensive care, Deputy Defense Secretary Kathleen Hicks was on vacation in Puerto Rico. Will anyone be held accountable for this disastrous breakdown in communication? Secretary Austin released a statement on Saturday addressing the issue: “I am very glad to be on the mend and look forward to returning to the Pentagon soon. I also understand the media concerns about transparency and I recognize I could have done a better job ensuring the public was appropriately informed. I commit to doing better.” On Tuesday, it was announced that Secretary Austin has been diagnosed with prostate cancer. 4:05pm- Zack Smith—Legal Fellow and Manager of the Supreme Court and Appellate Advocacy Program in the Edwin Meese III Center for Legal and Judicial Studies at The Heritage Foundation—joins The Rich Zeoli Show to discuss the Court of Appeals for the District of Columbia Circuit hearing arguments on Tuesday to determine the validity of Donald Trump's presidential immunity defense in his federal election subversion indictment. Because they can't vote for their preferred candidate—Joe Biden—as he won't appear on the ballot following a Democrat National Committee feud with the state over scheduling dates, many Democrat voters are now registering as Republicans in order to vote against Donald Trump, supporting rival candidates like Nikki Haley and Chris Christie. Democrats have seemingly destroyed their own New Hampshire primary, are they impacting the Republican primary as well? 4:35pm- During a Fox News town hall event on Monday, Republican presidential candidate Nikki Haley accused her primary opponent Donald Trump of orchestrating chaos. 4:40pm- Lisa Kashinsky of Politico writes: “The New Hampshire attorney general's office is accusing the Democratic National Committee of engaging in unlawful voter suppression after the national party dismissed the state's upcoming primary as ‘meaningless.'
