Trump's Great Private Equity Bailout, with Dan Rasmussen

Capitalisn't

Play Episode Listen Later Aug 21, 2025 54:04

For decades, private equity has been the darling of pension funds, university endowments, and sovereign wealth funds, promising high returns and low volatility. Now, President Donald Trump has made it possible for everyday investors to get in on the magic with his executive order, "Democratizing Access to Alternative Assets for 401(k) Investors.” The order relieves regulatory burdens that limit the access of defined contribution plans, like 401(k)s, to alternative assets such as private equity (but also cryptocurrency and real estate). The hope is to give American workers access to greater choice, diversification, and potential growth towards a comfortable retirement. But Trump's order comes just as longstanding questions about private equity's promise of high returns and low risk are coming to the fore. Has the distribution of returns slowed to a trickle? What does data actually say about private equity's performance, and where is the industry headed? There is also a long standing debate whether private equity is good for society, independent of financial returns. Is private equity actually a ponzi scheme that now threatens the retirements of millions of American workers? To make sense of it all, Luigi and Bethany are joined by Dan Rasmussen, an experienced investor and author who began his career in private equity but has emerged as one of the most prescient critics of the industry. Together, the three of them distill what the state of the industry means for the future welfare of investors, workers, and the American economy as a whole.Bonus: Check out ProMarket's recent series on the impact of private equity in the health care industry.

Media coverage over the economic impact of President Trump's tariffs has been robust, but not a ton of attention has been paid to the actual legality of them. So that's where Andrew and Mary begin, after two court decisions in the last week questioned the merits and where jurisdiction lies. Then they turn to the president's significant use of the pardon power to commute sentences and override convictions of some friends and allies, and what it says about maintaining a belief in blind justice. And after some great reporting from the New York Times, Mary and Adnrew detail some changes happening within Director Kash Patel's FBI, as bureau leaders are taken down a peg and emphasis on public corruption is dialed back.Further reading: Here is the New York Times reporting concerning the FBI: Unease at F.B.I. With so many issues stemming from President Trump's executive orders now before the Supreme Court, it's tough to know where to begin. So Andrew and Mary start this week with the arguments heard last Thursday from Mary's ICAP team on the courts issuing national injunctions in several birthright citizenship cases. They recap Thursday's highlights and note the Justices' interest in getting to the merits of the birthright issue. Then, they talk through two SCOTUS decisions from Friday and Monday: one on the Trump administration using the Alien Enemies Act to ‘extract' Venezuelan migrants, and the other on their attempt to revoke the protected status of Venezuelans. Last up, Andrew and Mary turn to the specifics of a few of the immigration removal cases, as hearings continue and the lack of due process continues to be challenged.Want to listen to this show without ads? The Professional Tennis Players Association (PTPA) and 22 players have filed a class action lawsuit against the sport's governing bodies in a US court. The case has been filed against the ATP, the WTA, the International Tennis Federation (ITF) and the International Tennis Integrity Agency (ITIA). The lawsuit alleges that professional tennis players are being exploited and abused by the unfair business practices of the sport's governing bodies. Specifically, the lawsuit alleges that the ATP, WTA and others are running the sport in violation of the US's anti-trust laws. Among other things, it also calls for a more equitable distribution of the revenue generated by the sport, a less gruelling calendar, and more transparency in the anti-doping and anti-corruption investigative processes followed by the ITIA. What are the likely implications of this lawsuit and will it help bring about reform in the way the sport is organised? Guest: Ahmad Nassar, Executive Director of the PTPA. Host: G. Meanwhile, state and local government full-time jobs have risen by ~400,000 year-over-year, twice as much as the pre-pandemic period. The US labor market is weaker than it seems. the Biden administration has finalized changes to the rules governing H-1B visas. Here's an overview:  On December 17, 2024, the Department of Homeland Security announced a final rule to modernize the H-1B program. The changes are set to take effect on January 17, 2025.   The Biden administration finalized new rules for the H-1B visa program, described as an attempt to "modernize" it, which came into effect right before Trump's projected return to office. These changes include codifying agency deference for H-1B petitions, expanding eligibility, and potentially making it more challenging for Trump to reverse these policies due to the administrative rulemaking process. This has been viewed by some as an attempt to set a policy framework that could complicate future policy rollbacks by the Trump administration.  these last-minute regulatory changes as a strategic move to lock in reforms that might be politically or legally difficult for a subsequent administration to undo quickly. This idea is supported by the notion that once regulations are in place, they require a formal rulemaking process to amend, including public comment periods, which can be time-consuming. Political Context: This overhaul comes at the end of Biden's term, likely intended to cement changes into regulation before the transition to the next administration, potentially making it more difficult for a new administration to reverse these changes without going through a formal rulemaking process. https://twitter.com/JackPosobiec/status/1873172920396382490 Despite New York Post Phone Call, Question and Answer, Donald Trump Companies Do Not Use H1B Visas
