This week's podcast moves back to Kenya with Africa Legal's Tom Pearson in conversation with the senior partners from Nairobi law firm KO Associates LLP. KO Associates was named Specialist Law firm of the Year at the African Legal Awards for 2020 and, in this interview, Managing Partner Crispin Odhiambo and Senior Partner Stephen Kiptinness explain how they steered their firm through one of the most challenging times in modern history to achieve this accolade. Crispin is also the Lead Partner in the Projects, Energy and infrastructure Department as well as the Corporate and Finance department while Stephen is the Lead Partner in the Technology and Intellectual Property Practice. What sets the firm apart, Stephen says, is how they strive to give clients a small firm feel which means the attention given to any challenge is intensive and focused. “We look at a problem up, down and sideways – not just from the client's perspective but from the market perspective,” he says, “eventually we understand the matter as if we are part of the client's business.” This means the firm is able to offer advisory support that helps a business “move to the next level”. Crispin elaborates saying that as an African law firm they have to think internationally – or at least regionally – because that is the way their clients are thinking. “Businesses are wanting to expand their reach. Whereas in the past it was ‘the north' (Europe, the US and, lately, Asia) looking to come into Africa, this has swung round with African business looking outward.” Stephen says advances in technology have raised the bar in Africa as local clients demand a higher standard of service – on a par with what they are used to in other markets. What is also driving this reaching out is the African Continental Free Trade Agreement which was seeing an integration of African markets. The discussion moves on to cover the impact and subsequent bouncing back from Covid-19 and how Africa is back to business as usual while Europe and Britain are still grappling with the crisis. Stephen says the pandemic has been an opportunity to take stock and, while businesses “hit pause”, many continued growing but have emerged leaner and, in many instances, more efficient.

Rao’s personal stories (edited) “You know when you grew up in India, especially in Bangalore, it’s  kind of expected that you’d be good at science and math, and studied a lot of science and math in high school. So when I came to Randolph-Macon, I naturally gravitated towards science and math, and my physics professor used to be amazed that I could do mathematics in my head. He would ask me integration problems and I would know the answer within seconds of his question.”   “I have always been interested in aircraft, and I wanted to be a pilot as a kid but I could not because I had poor eyesight. So later on, I had always wanted to represent an aviation company and when the opportunity presented itself after I joined Maynard, I jumped on it! I started to look around for helpful information and I found there wasn’t much out there, so I started thinking about what one might need in order to make air taxis a reality... So imagine a world where instead of calling a car on your rideshare app, and going from your house to my house: Imagine a world where you could use a similar app to call an air taxi to land at a nearby vertiport and you could hop in it and it will fly to someplace near my house and you could just walk over!”   “After I made partner at Fish & Neaves, we merged into Ropes & Grey, and I thought it was very important that I had business of my own. I thought that I could easily get that business, and for about a five year period I was simply unable to generate my own business and I was relying heavily on institutional clients. Well the firm was perfectly happy with me just working on institutional clients, so there was no pressure from Ropes & Grey to do anything different, but I personally thought that it was very important. So I spent a lot of time talking to new companies to see what they were looking for in a lawyer or a law firm. Well it led me to getting very good at rejection. So I can’t overstate it but: you have to be totally super humble because you’re gonna get a lot of rejection and I must’ve been rejected thousands of times.”   “So I was working at Fish & Neaves, I was a first year associate in a mega competitor lawsuit with at least a billion dollars at stake for the companies, and I was the tenth lawyer on the case – meaning the lowest, most junior person on the team. The supreme court had just ruled on Markman v. Westview Instruments in 1996. And I remember saying to my teammates “Hey, this decision came out, I think we need to request the court to tell us what it intends to do with the claims in this case”. So basically, when it came time to argue the Markman hearing, we had a team meeting and the lead counsel on the case – who was the managing partner at Fish & Neaves at the time, Ed Bailey – said “Who should argue this?”, he just threw it out to the whole team, and I raised my hand and I said I think I should argue it. He asked me why I thought that, and I told him; because I had written the brief, and I knew the position well, and I knew it inside out. He was persuaded and he let me do it!”   More about Sasha G. [TRANSCRIPT] Recently, we represented a client in the intellectual property area, which is the area where I practice. We actually took over representation from another law firm. In this case, the client was having difficulty, and the client's former counsel was having difficulty obtaining some patents in some very technological, very complex areas of technology, and they were having difficulty convincing the patent office to grant these patents, so they decided to come to us. This was a software-related technology that the company was developing. They came to us, and we've helped them formulate a better approach, a better strategy to explain to the patent office exactly the nature of the invention, exactly why the invention was different from what's been done before, and we were able to get the patent issued. In this case, we had to appeal the decision, a rejection at the patent office up in Washington, but we were able to convince the judges on appeal that the rejection should be overcome, so were able to get the patents for the client. This was very important for the client because they were looking to do certain things in their business that required them to get the patents issued. Without the patents issued, they were not able to move forward, so they basically were waiting for somebody to help them do this. The prior attorneys were not able to do so, but we came in and effectively saved the day for them.
