Speaker: Professor Margo Bagley, Emory University School of Law Abstract: 2024 was a year for multilateral IP like no other. WIPO Member states adopted two new treaties last year: the WIPO Treaty on IP, Genetic Resources and Associated Traditional Knowledge and the Riyadh Design Law Treaty. Both were groundbreaking in their mention of one or more of genetic resources, traditional knowledge, traditional cultural expressions, and indigenous peoples and local communities, none of which are standard IP topics and all of which have been controversial additions to the normative work at WIPO. Moreover, both treaties address disclosure of origin for one or more of these controversial areas, another first for a WIPO treaty. I will discuss how these two treaties came to fruition and their ramifications for future multilateral IP treaty-making.Biography: Margo A. Bagley is Asa Griggs Candler Professor of Law at Emory University School of Law. She returned to Emory in 2016 after ten years at the University of Virginia School of Law, where she held the Hardy Cross Dillard chair. She was the Hieken Visiting Professor in Patent Law at Harvard Law School in Fall 2022. Her scholarship focuses on comparative issues relating to patents and biotechnology, pharmaceuticals and access to medicines, and IP and social justice issues. Professor Bagley served on two National Academies Committees on IP matters, is a technical expert to the African Union in World Intellectual Property Organization (WIPO) matters, and has served as a consultant to several United Nations organizations. She has served as a US Department of Commerce Commercial Law Development Program advisor and currently serves as a member of the U.S. DARPA ELSI Team for the BRACE project. She is an elected member of the American Law Institute and a faculty lecturer with the Munich Intellectual Property Law Center at the Max Planck Institute in Germany, and also has taught patent related courses in China, Cuba, Israel, and Singapore. She has published numerous articles, book chapters, and monographs as well as two books with co-authors with a third on the way. She is registered to practice before the U.S. Patent and Trademark Office, practiced patent law with both Finnegan, Henderson, Farabow, Garrett & Dunner, and Smith, Gambrell and Russell, and has been an expert witness in several patent cases. A chemical engineer by training, Professor Bagley worked in industry for several years before attending law school at Emory where she was a Woodruff Fellow. Courtney Gambrell brings a long and rich background in behavioral health and spiritual care to wellness work. She's is a licensed clinical social worker in Texas and practiced psychotherapy there for many years. More recently, with an additional graduate degree she's served as a board certified spiritual care provider and staff wellness coordinator at Boulder Community Health in Boulder, Colorado. Most of her work has been in high acuity settings like the Emergency Department and Intensive Care Unit. Over the years, Courtney has developed rituals with the wild just outside the hospital door, using it to support humans as nature in life shifting changes for patients, their family members and healthcare staff. Throughout, Courtney continues awed by self-inquiry processes, humbled and heartened by the benefits of gathering in mutuality and shared purpose. You'll hear this awe throughout our conversation. Today on the podcast, Robin and Lester interview Judge Alvin Wong, Georgia's first Asian American judge.   Guest Bio Judge Wong came to Richmond, Va. from Hong Kong when he was 14. His father enrolled him at Fishburne Military Academy in Waynesboro, Va., shook his hand and said he'd “see him next summer.” He followed a classmate from Fishburne to Auburn University without even knowing where it was. He graduated early and moved to Atlanta. He started taking night classes at John Marshal Law School and passed the Georgia Bar in 1976. He hung out a shingle and worked as a trial lawyer and then was a partner at Gambrell & Stolz (now Baker Donelson) for 20 years. Judge Wong was elected to the State Court of DeKalb County in 1999 and since his election in 1999, he's been reelected, unopposed, to six consecutive terms. With his election in 1999, he became the first Asian American judge in Georgia history. At that time, Asians made up less than two percent of registered voters in DeKalb County. In 2004, Judge Wong co-founded a DUI court to help people, calling it one of the most rewarding things he's done. He also sits on the board of the Lifeline Animal Project, a nonprofit that helps turn Atlanta animal shelters into no-kill shelters. He also brings to the courthouse Coco, a dachshund-chihuahua mix he rescued a decade ago. Jurors love to meet her after the trial is over. Judge Wong was elected by his peers in 2021 as president of the Georgia Council of State Court Judges, overseeing the entire state. His election marked the first time an Asian American served as president of any judicial council in Georgia. In 1993, Judge Wong and Professor Natsu Saito of Georgia State University Law School combed the State Bar Directory to find 10 attorneys to start an Asian American Bar Association. Today, the Georgia Asian Pacific Bar Association (GAPABA) has 750 members. In 2014, GAPABA named its top prize the “Judge Alvin T. Wong Pioneer Award”. It is given in his honor to a lawyer who demonstrates leadership to pave the way for the advancement of APA attorneys. He is the recipient of the 2017 Traditions of Excellence Award presented by the General Practice and Trial Section of the State Bar of Georgia. He received the 2022 Randolph Thrower Lifetime Achievement Award presented by the Committee to Promote Inclusion in the Profession of the State Bar of Georgia. Judge Wong serves the ABA Standing Committee on Ethics and Professional Responsibility – Judges Advisory Committee and as a Fernbank Museum of Natural History trustee and NAPABA (the National Asian Bar) Law Foundation board member, mentoring future leaders as co-director of its Thomas Tang National Moot Court Competition.

She launched The Color of Care education  campaign to prepare current and future doctors, nurses and medical professionals to play an active role in combating systemic racism in the delivery of healthcare, as well as provide others with the necessary tools to advocate for and empower patients who experience these inequities. The Color of Care movement for more equitable healthcare in America began when Oprah Winfrey was inspired to take action following the death of Gary Fowler. In this episode, we discuss the tragic and unnecessary death of Gary Fowler inflicted by a grossly negligent and racist healthcare system.  Multiple hospitals have the blood of Mr. Fowler on their hands; however, this is a story of hope in that his death started a national campaign for health equity. Oprah says the following about the death of Mr. Gary Fowler: “I read a story that haunted me…the story of the Fowler family. When Mr. Fowler became ill, three different hospitals turned him away. He went home, sat in his recliner, and died. I wondered how many different Gary Fowlers there are out there. What if I told you the biggest indicator of how long you are going to live is your zip code? What if access to lifesaving care for somebody that you love depended on the color of their skin? The COVID pandemic exposed a tragic divide in our healthcare system. We now need to stand up, and we need to do something about it. We need to change an entire system. It seems as if everyone is chasing greatness on some level. Maybe you want to be a great Dad or a great athlete or a great person, either way all of us are chasing greatness to some extent. The question is how do we become great? In this episode the team breaks down one of the main components of becoming great which is consistency. In order to help us we have Coach Jonathan Gambrell on the show who uses examples from his life and coaching career to help us dive into this topic. Coach Gambrell is currently a teacher at Hillgrove High School and the Head Cross Country and Track Coach. He is responsible for coaching the team that would bring the high school its first ever state title in 2019.
