Today, I have a fantastic and fabulous guest, Kerry O'Shea Gorgone, Educational Content Director at MarketingProfs. Kerry is a lawyer, content creator, educator, speaker and host of the Marketing Smarts podcast. She is also Consigliere, Co-Host and Showrunner for Chris Brogan Media, and co-host and producer of Punch Out With Katie and Kerry talk show. She's been helping businesspeople learn what they need to know so they can do the things they want to do. Today we talk about the legal aspect of marketing. In this episode: Apart from non-disclosure agreements, what are some other instances that legal needs to get involved in marketing? The role of transparency in influencer marketing. What are the legal ramifications for live streaming and copyrighted material? What is the role of technology in content monitoring and copyright protection? How to properly (and safely) do live streaming? How can marketers control their environment when they create content. What is the setup, process, must- do's or don'ts for the people interested in launching a podcast or a YouTube channel? Examples of resolving the unexpected bloopers while creating a show, podcast or live stream. Quotes from the episode: "In influence marketing, there is a lack of understanding that disclosure is even a thing you need to do. People don't understand that in some cases, an influencer has been paid to partner with a brand and promote their services." 'When you're live streaming, be aware of what you have in the background, be aware of it and music that might be playing. And speaking of backgrounds, make sure you don't have any trade secrets or personal information of your customers or anything like visible anywhere behind you." ————— If you want to chat, reach out to any social media channels or email me hello@pamdidner.com. “The only policy you need is ‘don’t be a jerk!'” While this may seem like surprising legal advice, it shouldn’t be considering the source. In addition to being a lawyer, marketing professional, and podcaster, Kerry O’Shea Gorgone is one of the nicest (read: not jerky!) people both online and off.  We discussed the legal implications of new forms of media, copyright, podcasting, and more on this week’s episode of the On Brand podcast. About Kerry O’Shea Gorgone Kerry O’Shea Gorgone, JD, MBA, is a lawyer, podcaster, speaker, and writer. By day, she designs training programs for marketing professionals in her role as Director of Product Strategy, Training, at MarketingProfs. By night (and on weekends) Kerry writes for some of the most authoritative sites in the marketing and PR industry, including Mark Schaefer’s {grow} blog, Social Media Explorer, Entrepreneur, Spin Sucks, and MackCollier.com, and also contributes to Huffington Post. Kerry hosts the MarketingProfs weekly interview series, Marketing Smarts, named by Fast Company as one of the best business podcasts on the internet and one of “19 Podcasts Worth More Than an MBA” by Inc. The show features industry stars and authors like Chris Brogan, Ann Handley and Gary Vaynerchuk, as well as business personalities like Jon Taffer of ‘Bar Rescue’ and actress Jane Seymour. She’s also interviewed c-suite executives from organizations like IBM, National Geographic, Dell and the Baltimore Ravens. Learn more about her at KerryGorgone.com. Episode Highlights Legal 101 — what’s the difference between a copyright and a trademark? “A copyright protects your bigger works — books, blogs. Trademarking is for smaller things — logos and phrases.” At the end of the day, Kerry warns that you have to decide to what extent you’re going to pursue small infringements. So, what should you protect as a brand? “Your employees’ privacy. Like Crackerbarrell saw this week when they fired ‘Brad’s wife.'” You should also protect your copyright — both what you share from others and what they share of yours. Can Snapchat sue Facebook? This week, as Facebook launched stories, a very Snapchat-like feature, students in my marketing class (which Kerry spoke to via Skype) asked if Facebook could be sued by Snapchat for copying the stories features. “You can’t copyright an idea. It has to be expressed. At this point, stories are so pervasive.” Podcasting tips? As you can see from her bio, Kerry is one of the most popular marketing podcast hosts. What tips can she share for businesses wanting to get started with this growing form of media? “Start with conversation research and listen. Figure out what your audience is into and see if you can be a part of that.” What brand has made Kerry smile recently? Kerry pointed us to the outdoor brand Orvis. She recently had Orvis’ Simon Perkins on the Marketing Smarts podcast. She loved the engaging conversation and the real-life brand touchpoints she received afterward that made her smile. To learn more about Kerry, follow her on Twitter and check out her blog and the Marketing Smarts podcast. As We Wrap … Before we go, I want to flip the microphone around to our community …Recently Sean Carpenter gave us a shout on Twitter for our episode on authenticity featuring Bruce Kennedy. Back to back podcasters on Living Your Passion? Yup. Earlier this week I chatted with John Lee Dumas. Today (Episode #17) is Kerry O'Shea Gorgone. Kerry is a self-proclaimed geek, baker of chocolate chip cookies, lawyer, a wife, a mom (of two adorable boys), an employee at MarketingProfs, and a podcaster! While she loves her family - and her job - her true passion is learning about people through interviews (podcasting). Oh, and see that picture of Kerry (look to your right (or down))? That's the outfit she mentioned during this podcast! Finally, wait till you hear the audio good audio (just like the Julie Neumark and John Lee Dumas episodes). In case you missed any of the previous episodes, you can catch them here by visiting the Living Your Passion landing page. Are you ready to get LEARNED on how to interview/podcast? During this episode ... Kerry gave one of the best intros of "who she is" I've ever heard. We discussed our mutual LOVE for talking with other people. A love I also share with my mother-in-law I shared my thoughts on the best female podcast voice of all time - KERRY! Kerry talked about "the podcast voice" and gives some tips on how to sound better. Kerry shared even more interview tips - specifically how to ask a question and then let the guest answer (not my strength. ha!) We discussed editing (note: I don't do it either of my podcasts!). We talked about my contractor laying tile (not a euphemism!). I admit Kerry may be the female version of me! We did a "speed round" of questions that mutual friend (and Kerry's boss!) Ann Handley asked on Facebook. Thanks Ann! More About Kerry Speaker, Lawyer, Writer, Podcaster. Work for @MarketingProfs. I first learned about Mark Horvath - today's guest (#15!) - after listening to future Living Your Passion podcast guest - and past Work Talk Show guest, Kerry O'Shea Gorgone. Mark was on Kerry's podcast, Marketing Smarts. I literally stopped mid-listen and texted Kerry, asking for an introduction.  A few emails - and weeks - later, here we are. Mark BLEEDS passion. And, while Mark has many passions including good (and bad) marketing, pho, drumming, fishing, his true passion is FIGHTING HOMELESSNESS. And thanks to the work Mark is doing with InvisiblePeople.TV, he's making a huge dent. Mark is a storyteller ... as you are about to learn. In case you missed any of the previous episodes, you can catch them here by visiting the Living Your Passion landing page. Are you ready to see how we can all help fight homelessness? During this episode ... We learn that Mark was once living on the streets, homeless. Mark talks about homeless people just being ... people - just like you and I. Mark shares the difference between fighting and ending homelessness (hint: He's a realist). Mark talks about how he empowers homeless people to tell their own stories. Mark tells stories - a lot of stories. Mark dispels a BOATLOAD of myths we all have around homelessness and homeless people in general. Mark encourages us to ask homeless people what they need ... instead of assuming they need money or food. Ask! Mark suggests giving homeless people apartments (with support services). Stick with me on this. And watch this video. Mark tells us the most expensive solution to homelessness is criminalization. The second most expensive is leaving them on the streets. Wow, right? We chatted about health ... a bit. More About Mark Just a hardly normal guy trying to navigate through an abnormal world by helping others. Media Consultant.
