Have you ever considered that your business name might already belong to someone else? In this episode of Life After Corporate, host Deb Boulanger sits down with trademark attorney Lauren Bercuson to uncover the costly mistakes entrepreneurs make when it comes to trademarks. Lauren explains why securing a URL or registering your business name isn't enough to protect your brand, and she shares the crucial steps every business owner should take before launching. From the risks of skipping a comprehensive trademark search to the dangers of infringing on an existing mark, she breaks down the legal nuances that could make or break your brand. Whether you're naming a new business, launching a product, or starting a podcast, this episode is packed with must-know strategies to avoid legal headaches and financial losses. Think your brand is safe? You might want to think again. [00:05- 07:10] Common Misconceptions About Brand Protection Owning a URL does not grant legal protection for a brand name. Business entity registration does not equate to trademark protection. Trademarking with the USPTO provides a legal defense against name disputes. A registered trademark is policed by the USPTO, preventing similar names from registering. [07:11 -14:33] The Limits of DIY Trademark Searches Searching the USPTO database is not enough to confirm trademark availability. Similar-sounding or phonetically equivalent names can still cause conflicts. Google searches do not account for common law trademarks. Trademark attorneys understand nuances like foreign equivalency and industry overlap. [14:34 - 29:38] The Trademark Registration Process A comprehensive search determines if a name is legally available. The USPTO review process takes 8-10 months. Trademark registration strengthens brand identity and legal protection. Businesses with trademarks have an advantage in negotiations and funding. [22:39 - 30:53] Why Podcasts and Digital Brands Should Be Trademarked Trademarking a podcast prevents others from using a similar name. Even non-monetized podcasts benefit from brand protection. Legal conflicts arise when similar show names confuse audiences. Entrepreneurs should treat digital assets as valuable business properties. The Cult: The Cannabis Business, Culture, and Marketing Show
In the cannabis industry (or any industry), trademarks are your first defense against copycats and confusion. A distinctive brand identity ensures consumers know who you are while laying the groundwork for geographic expansion, customer loyalty, and potential acquisitions. Generic names or overly familiar symbols (ahem, bud leaves) may seem appealing, but they're nearly impossible to protect—leaving your business exposed to risk. Trademarking cannabis comes with unique challenges due to federal restrictions, making state registrations and creative strategies essential. From protecting your core products to leveraging trademarks for ancillary goods like merchandise, every step strengthens your position in the marketplace. A proactive approach saves you time, money, and headaches by reducing the risk of legal disputes and allowing your business to grow confidently. Safeguarding your trademarks isn't just about legal compliance—it's about securing your future in a competitive industry. Whether launching or scaling your brand, the right trademark strategy ensures your hard-earned reputation remains yours alone. Hybrid Director of Strategy Jen Lamboy and Seth Gardenswartz of Black Garden Law discuss trademarking in the cannabis industry during this recent webinar.

The conversation also touches on the significance of trademarking the podcast and the realities of navigating legal mistakes in healthcare settings. takeaways • Balancing professionalism and comfort is a daily conflict for lawyers. • Lawyer wellness is crucial due to the stressful nature of the job. • Consultations create an attorney-client privilege even without a fee exchange. • True crime media has a significant impact on public perception of legal cases. • The nuances of legal cases are often lost in media portrayals. • Mistakes in healthcare often stem from systemic failures, not individual negligence. • Police reports can be inconsistent with body cam footage, affecting case outcomes. • Understanding constitutional rights is essential during police encounters. • The nature of truth in legal proceedings is complex and subjective. • True crime shows can provide a clearer picture of events than court cases. Join Doug as he interviews Georgia Kirke, founder of Clio Books. They talk about the revolutionary world of AI-powered book writing, discussing how Clio is changing the game for aspiring authors. Georgia shares her expertise on the importance of books for building authority and thought leadership, while Doug reflects on his own authorship journey. This episode is a must-listen for entrepreneurs looking to share their knowledge and boost their personal brand through writing. KEY TAKEAWAYS Clio Books is an AI-powered SaaS platform that guides non-fiction authors through the book planning process, allowing them to speak their book rather than write it. Traditional book writing methods can be time-consuming and expensive, but Clio reduces the time by 93% and costs a tenth of traditional methods. Having a book establishes authority and thought leadership, opening doors to speaking engagements and industry recognition. Consistency in content creation, including books, blogs, and podcasts, is crucial for building a strong personal brand and sharing expertise. Clio doesn't replace the author's thinking or content; it streamlines the process and structure, making book creation more accessible. Effective book marketing strategies include creating a targeted hit list of ideal clients and strategic partners for personalised outreach. Trademarking key phrases or titles can add extra authority to an author's brand and make them more memorable. While immediate financial returns on books may not always be evident, the long-term benefits in terms of opportunities and brand building can be significant. BEST MOMENTS "Clio is an AI powered SaaS platform that leads non-fiction authors through the book planning process, provides the structure, gives you a talking plan, and then asks you questions, and your answers then become the book manuscript that Clio types up for you." "Writing and books are synonymous, yes, but it's not accurate that you have to become a writer in order to author a book." "Books and authority go hands in hand and, and in fact, the word author comes from the original Latin word for authority." "I know my book sort of kept me up with the Million Dollar Roundtable, MDRT, and you know I've been invited to go on a committee about membership services and so that's happened and then somebody else is talking to me about the possibility of speaking at the conference next year, which would be amazing." "Don't write your book, speak your book. Get onto the Clio site, follow Clio, loads, loads of exciting things to come." On this episode Mincov shares his insights & experiences on the importance of trademarks for entrepreneurs and businesses, and the common mistakes and misconceptions that people have about the trademarking process. He will also explores the role of IP in business growth & success, & the strategies &best practices for protecting & leveraging your ideas & brands. KEY TAKEAWAYS My dad was a famous composer in Russia. A radio station that stole a song he wrote & turned it into an ad for Samsung without his permission, at the time I was attending law school & he asked me for help. I didn't know anything about IP but in 1996 nobody in Russia had any idea about IP because Russia had just changed from Soviet law into free market law, so I gave it a shot & as part of that journey I became passionate about helping people who created something to protect it from others who want to steal it from them. Trademarking is mostly the same around the world, there are small differences here & there & you need to understand them to be successful in those countries. But, this isn't something I think entrepreneurs should care about, that's why providers exists who can navigate them through this. What you should know are the basics, it's not as complex as you might think: What is trademarking? What are you protecting? What do you need to show to the government to prove it's a brand & not a cute name or image? The biggest misconceptions I see with trademarks is that you don't own the word or the image you own the mental association between that work, phrase or image & specific products & services that you sell. Why trademark? If you plan to be in business for several/many years, the brand will become the most valuable asset of your business. It makes it easier t=for you to attract better talent, attract better leads at a lower cost to advertise at lesser cost. Even if you file your trademark a day before someone else does, you're good. The problem is you don't know when someone else will file for a trademark, so you should do it early or else someone else will do it and you won't be protected, even if you came up with the name first. BEST MOMENTS ‘The trademarking process takes a long time & I've seen a lot of entrepreneurs being taken advantage of by unscrupulous firms that claim to be able to trademark their brand for $49.' ‘The success rate of your trademark application is directly related to your willingness to understand the basics.' ‘On a general level, what trademarks protect is the brand, whether it's the name, tagline, logo, or some combination.' ‘Trademarks is the only type of IP that you can own, in theory, forever. Copyrights, patents, industrial right expire, if you renew your trademark every 10 years you can own it forever.' ABOUT THE GUEST Andrei Mincov, the founder and CEO of Trademark Factory, is a renowned expert in intellectual property law. With a career that began with a fight to protect his father's music, Mincov has since written multiple books on the subject, including an international bestseller, & has helped thousands of entrepreneurs and companies protect their IP. His passion for ensuring that hardworking entrepreneurs are not taken advantage of led him to found Trademark Factory, the only firm in the world that offers trademark registration services with a guaranteed result for a guaranteed budget. When he's not helping secure trademarks, Mincov enjoys living in Dubai with his wife & 3 kids & playing his one-of-a-kind DrumDesk. Then we take the time to examine the beauty of the taco and how it can heal us as a nation. Our Sponsor this week is the return Tacopocalypse It's HERE! Pros of Trademarking Your Wedding Venue Business: Brand Recognition: A trademark helps establish a unique identity for your wedding venue business in the market. It makes it easier for clients to identify your brand and up levels your venue amongst other wedding venues. Legal Protection: Trademarks legally safeguard your business name, logo, and other identifiers. This prevents others from using similar marks that could cause confusion among customers and dilute your brand's reputation. Market Exclusivity: Once your trademark is registered, you gain exclusivity of your mark(s) in connection with your goods and services within your geographic area. This can help you establish a strong market presence. Asset Value: A registered trademark can become a valuable business asset. It can enhance your business's value in case you decide to sell or expand in the future. Licensing Opportunities: Trademarks can be licensed to others, providing an additional revenue stream. You can license your trademark to other entities or people for use in related products or services. Credibility and Trust: A registered trademark can boost the credibility and trustworthiness of your business in the eyes of customers and partners. It shows that you are committed to protecting your brand identity. Cons of Trademarking Your Wedding Venue Business: Costs: The process of registering a trademark involves fees, including application fees and legal costs if you choose to hire an attorney. Additionally, there are ongoing maintenance fees to keep the trademark active. Time-Consuming: Trademark registration can be a lengthy process, taking several months or even longer. This might delay your plans to use the trademark in marketing and branding. Complexity: The process of trademark registration can be complex, especially if you're not familiar with intellectual property law. It may require legal assistance, adding to the costs. No Guarantee of Approval: Not all trademark applications are approved. If your chosen mark is too similar to an existing trademark or doesn't meet other criteria, your application could be rejected. Geographic Limitations: Trademarks are typically registered within specific geographic areas. If you plan to expand your business internationally, you might need to register the trademark in multiple jurisdictions. Maintenance Obligations: Registered trademarks require ongoing maintenance, including periodic renewals and continued use of the mark in commerce. Failure to meet these obligations could result in the loss of the trademark. Public Disclosure: The trademark registration process involves public disclosure of your business name, logo, and other information. This could potentially expose your business to imitators.
