When a 12-year-old dies suddenly, law enforcement focuses their attention on one man almost exclusively. Surveillance footage seems to contradict the person of interest's alibi. In this episode we have a soccer coach, a Sheriff's deputy and a small town torn apart by the devastating loss of Garrett Phillips. Sources: Who Killed Garrett Phillips. (n.d.). 7 News Staff. Jen Thomas Bidwell Mother of Son Terron Evans R.I.P.The silence ends now. I am the BLM Potsdam NY Organizer in St.Lawrence County(the largest county by area in NYS, One of the most racist counties if not the most in NYS) . My 26 year old son Terron Evans Jr.moved here to Potsdam NY in June 2020 and is now dead of a supposed overdose of Wellbutrin pills. His girlfriend who has a relationship with the Potsdam Police, who I've been going up against for over a year for the justice of Garrett Phillips were the first responders on the scene and the ones to never call or come by to tell me about my son.I have many reasons to believe there was foul play. Regardless of how my son died,he was turned down, denied, abused, rejected,by our systems pretty much all of his life, that I thought were supposed to help him/us,but did not.Terron decided to move here instead of back to his hometown of Syracuse NY to stay away from the drama, but it was almost impossible for him to get on his feet here being a black man.The following is why I believe foul play may have occurred and most definatly Systemic racism is part of why my son is dead.12 year old Garrett Phillips was strangled in his apartment at 100 Market St Potsdam NY on October 24th 2011(there are many many media outlets and podcasts around the world that covered this case, because of the treatment of Nick Hillaary, misconduct and incompitence of the Potsdam Police and the modern day lynching of a black man).Imediatley Garrett's mother's black ex boyfriend Nick Hillary was considered a suspect.Nick was asked to go to the police station to go over a list of kids names. It was an interrogation. He was detained, made to completley strip necked and be photographed from head to toe.His phone and other belongings were taken and he was given a hasmat suit to go home in.Nick was indicted twice. The first time it was thrown out because of lack of evidence and misconduct by the Prosecutor Mary Rain. The second time he was found not guilty by the judge and Mary Rain's law lisence was suspended for two years because of her misconduct(including withholding information by a witness from the defense attorneys because it did not go with her theory).PLEASE WATCH THE 2 PART HBO DOCUMENTARY WHO KILLED GARRETT PHILLIPS(it can be watched on YouTube).Garretts mother's other ex boyfriend Deputy Sheriff John Jones (who was close friends with Mark Murray, then lead investigator in the murder, now Potsdam Police Chief)was also a suspect. He was allowed to participate in the investigation from the very beginning. He accompanied Garrett's mother Tandy Cyrus(despite Tandy previously fearing for her and her boys saftey of John Jones) the following morning to the police station for her questioning.."John Jones" had pictures of his feet and arms taken.Fully clothed and no face included in the photos.A child was murdered, the police made errors almost from the time Garrett was found on the floor in his mother's room, there was misconduct, not following other leads throughout the years and Garrett's killer evaded justice. The Potsdam Police still say that Nick is the one that murdered Garrett, therefore have not taken leads seriously.I have asked the current DA Gary Pasqua(Who will be running for DA again) to do a Sentinal Event Review,he refuses.I have asked him to refer the case to the Attorney general for an independent investigation,he refuses and he said that the State Police are the independent investigation. The State Police were involved in the investigation from the day Garrett was killed. They also have close ties to the Phillips family and commuity.I have Asked Gary if he would make a public statement announcing that leads should go to the State Police and not the Potsdam Police(the justice for Garrett Phillips sign and billboard say to call Potsdam Police with information)but he refuses.I was on the Committee for police reform in Potsdam NY,but resigned recently last year because my concerns of racism and bias within the Potsdam Police department and community were not being taken seriously, shot down and even ignored.TThis show is part of the Spreaker Prime Network, if you are interested in advertising on this podcast, contact us at https://www.spreaker.com/show/1198501/advertisement
Jen Thomas - Bidwell - Terron Evans updateJen Thomas-Bidwell lost her son in murky circumstances which have consistently failed to be investigated. Her son died in his girlfriends' house. The claim is he died through ingestion of toxic substances; but the exact events which lead to his death are convoluted and contradictory. New evidence has arisen in the case, which Ms Thomas-Bidwell has had to uncover herself due to Police inaction in the case. She tells Ed Opperman about her personal investigation and her quest to find out what exactly happened to her son, and bring him the justice he deserves. Gofundme : Jennifer BraxtonFacebook : Jen Braxton TikTok : Jen Braxton Background : Source 1 Source 2 Source 3Her previous statement is below and here is the previous interview My name is Jennifer Baxtron. I organized and led Black Lives Matter Potsdam NY from June 1,2020 through June 30,2021. I organized Black Lives Matter Potsdam NY because of the treatment of black people by law enforcement community members and prosecutors(past and present) throughout the North Country. When I started Black Lives Matter Potsdam NY I became very vocal about the treatment of a black man named Nick Hillary who was modern day lynched by the system which has caused the unsolved murder case of Garrett Phillips to remain unsolved in Potsdam NY. Please watch the 2 part HBO Documentary called Who Killed Garrett Phillips, you can also watch it on YouTube. My son Terron Evans Jr moved to Potsdam NY just a couple of weeks after I started Black Lives Matter Potsdam NY. From the time he got there he stood with me, marched and rallied with me throughout St. Lawrence County. In September 2020 Terron met a woman that he started dating. On January 8, 2021 this woman Crystal Hamilton Kipp and her adult son Brian Gates claimed that my son committed suicide in their home in Potsdam NY. I later found out that this woman and her son are informants for the police. The Potsdam Police which I was/ am up against in regards to Garretts unsolved murder in Potsdam NY and now my son. There were two Potsdam Police that responded to the scene of my sons death first. Out of the two responding officers I was only granted one body cam video which was heavily redacted down to 2min 36sec (which mentioned nothing about the third person visible in the redacted video that is plain clothed at the trunk of the first patrol car)and the police reports. This informant told the police that she had just got up for work, but told the EMTs that she had gotten home from a night shift at work. The St. Lawrence County Sheriffs(3 of them) were second to respond to the scene of my son.The Sheriffs Department Detective Caringie was the lead Detective in my sons case.I was denied the supposed suicide note, all body cam videos and more.I believe that the truth about my sons death is being covered up,that he was killed and did not committ suicide. The officer whose redacted body cam video has resigned after I called Internal Affairs in June 2021,the lead Sheriff Detective for my son has retired and the Chief ADA (that the DA said he would talk to in regards to my request of referring Garretts unsolved case to the Attorney General)resigned on the same day my son was said to have committed suicide on January 8th 2021. I have also been fighting for the justice of Treyanna Summerville another high profile murder in which an 18 year old was killed by her mother in the summer of 2020, but her 13 year old sister was charged. There are many secrets within many departments in St Lawrence County that need to be exposed.Plesas help. On a rainy October afternoon in the small town of Potsdam, New York, a young woman called 911 to tell them that she heard some odd noises coming from the apartment across from hers. The noises sounded like a child in danger. When an officer finally arrived, he heard footsteps inside and the sound of the door's lock clicking when he knocked. When he finally gained access, the officer found 12-year-old Garrett Phillips pulseless. He began CPR and Garrett was transported quickly to the hospital, but he ultimately died. The only evidence left behind was a bent window screen and a few fingerprints. Investigators immediately focused their attention on the victim's mother's ex-boyfriend, Nick Hillary, and he became an outcast, despite no physical evidence of his involvement. Were police targeting him because of his race and pushing another prime suspect aside because he was, GET THIS, another police officer? Or was the investigator's tunnel vision being exagerrated and Nick Hillary really was responsible for the savage murder of a little boy? (Jun 10, 2022) A jury in Albany found Potsdam police did not violate Nick Hillary's rights when they detained him in connection with the murder of Garrett Phillips in 2011. Hillary was found not guilty of the crime in 2016. Also: Hospitals are feeling the pinch because of the pandemic, and some are laying off staff.
(Jun 10, 2022) There may be a verdict in Nick Hillary's civil rights case against the Potsdam police by this afternoon, so here's a special look at what happened at the trial this week in Albany. Natasha Haverty was NCPR's reporter on the scene and talked about the case with SOTD host David Sommerstein.
(Jun 9, 2022) Jury deliberations are underway in Nick Hillary's civil rights trial against Potsdam Police. Hillary is a former Clarkson University soccer coach who lived in Potsdam and alleges police violated his civil rights when they detained him for six hours without a warrant in 2011 in connection with the murder of 12-year-old Garrett Phillips. Hillary was found not guilty five years later for that crime in a bench trial that captivated the region and garnered national headlines.

Nick Sues the Police Department of the small town of Potstom New York For illegal search and seizure, illegal detention, and many other things. One of many mistakes. LAWRENCE COUNTY et al.,Defendants.Tom Mortati is a top litigation attorney who is responsible for getting Nick Hillary indicted. This story is complicated, it's fascinating and it's sad. Justice for Garrett. Nick Hillary is not telling the truth.

Ame and Kenzie are back with the conclusion of the two part HBO documentary "Who Killed Garrett Phillips". This week, we get to enter the courtroom for the stunning case brought against former college soccer coach Nick Hillary. Prosecution, the family, and most of the town is convinced that Nick is the only logical suspect in the murder of Garrett, using video footage take from the high school parking lot that day as their nail in the coffin. The defense sees their evidence as not only lacking, but actually bringing about more of a civil rights infringement rather than murder charge siting their accusations as mostly race motivated. Today we get the verdict - guilty or not?
On October 24, 2011, twelve year old Garrett Phillips was found dead in his Potsdam, New York apartment. Right away, Garrett's family and the police pointed the finger at Tandy's (Garrett's mom) ex-boyfriend, Oral 'Nick' Hillary. Despite Nick having an alibi on the day Garrett was killed, the police pointed the finger at him. In Part 1, I cover Garrett's death and the mistreatment of Nick Hillary. Kenzie and Ame are back with another episode of Shear Crime. This week they dive into part 1 of the 2 part HBO documentary “Who Killed Garrett Phillips?”. When a 12 year old boy is found strangled in the upstairs apartment he shared with his mom Tandy and younger brother, the small New York town of Potsdam is desperate for answers. Not long after the murder, all eyes turn towards Tandy’s ex boyfriend Nick Hillary. Will this small town police department have the evidence they need, or was the entire theory hanging on by a thread?
This is part two of the murder of Garrett Phillips. In this episode we dive into the terror of Mary Rain -- District Attorney of Potsdam. Mary had it out for Nick Hillary and digs her claws in until she can get an indictment. We also toy with the idea of other suspects, especially John Jones ...a deputy Sherriff of Potsdam at the time of the murder..and ex boyfriend of the mother of Garrett Phillips. This is one messssyyy case. Listen to find out who we think killed Garrett Phillips.
This is going to be a two part series. This case is so insane we couldn't cover it all in one go. This weeks episode we recap the HBO documentary Who Killed Garrett Phillips and dive into the death of Garrett Phillips and how the entire town of Potsdam railroaded an innocent black man. Listen to how Nick Hillary is immediately deemed guilty by the court of public opinion. This case will drive you insane and have you screaming WHO KILLED GARRETT PHILLIPS?!?
(Aug 17, 2020) Advocates for the wrongfully accused are trying to draw new attention to the murder of Garrett Phillips in Potsdam nine years ago. They’re calling for the state Attorney General to appoint a special prosecutor to investigate the 12 year-old boy’s death.
(Aug 5, 2020) It’s been nearly four years since Nick Hillary was found not guilty in the murder of 12 year-old Garrett Phillips in Potsdam. The trial gripped the region. Now, Hillary is pursuing a lawsuit of his own, against the law enforcement officials who charged him with Garrett’s death.
(Aug 5, 2020) Even before Nick Hillary was found not guilty in the 2011 murder of 12 year-old Garrett Phillips, Hillary sued local police and prosecutors, saying they singled him out as a suspect because he's Black. That takes on new significance today. A special report.
Listen in today as we discuss the unsolved murder of Garret Phillips, a 12 year old boy who unfortunately died of strangulation, and the mishandled investigation against Nick Hillary.
Half-rant, half-review of the HBO documentary
Michelle and I talk about the 2 part HBO documentary Who Killed Garrett Phillips. It focuses on the main suspect Nick Hillary. Nick was black and he lived with 12 year old Garretts mom Tandy for a year, her other son and three of Nicks children lived with them as well. They broke up after a year because her kids did not like Nick, especially Garrett. He was getting a lot of teasing about his white mom living with a black man. Nick was one of the very few black people in the town of Potsdam, New York. He was a respected soccer coach at one of the universities. Garrett was murdered sometime between 440 and 520 pm. He was playing basketball and his mom called to tell him to come home. The neighbors heard what sounded like a "No" or "Help" They called the police. When the cop got there he found Garrett barely breathing in his moms room. He died later that night. He was strangled. At first they thought it might have been an accidental strangling with other kids involved. The knock out game was popular then. Its when you strangle yourself to the point of near unconsciousness . Soon we meet Tandy's ex boyfriend cop John Jones, that she dumped for Nick. Tandy had a restraining order against Jones for fear he could hurt her or her children, he had also pushed her. He was also furious for being dumped by Tandy for a black man. It's a true whodunnit, it is still not known. We go over the theories, was Nick singled out because he was black. Or did he get away with murder. We take you through the documentary. There is a chilling video you see in part 2. Thanks so much for listening. Nick Hillary is hunted by his own town after the death of a 12-year-old boy, and he must find a way to prove that he's not the killer. But the person driving the investigation is someone with a mean streak and a grudge against Nick: that somebody is the sheriff's deputy, and he's got a team of police and lawyers that will do anything to put Nick away — even if it means breaking the law.Written and researched by David Wayne Young SOURCES:W.T. In this episode...In this episode, I speak with my former students Mani Tafuri. As a new attorney, Mani found himself in the middle of a very personal legal fight. Police in upstate New York charged one of his closest friends for the murder of the 12-year-old son of a former girlfriend. The legal challenges that followed were remarkable, both the racial bias that grew from the case and the constitutional violations. The case was of such import and interest that it is now the subject of an HBO documentary, Who Killed Garrett Phillips, airing on HBO. About our guest...Mr. Tafuri is a criminal defense attorney in Queens, NY. Prior to practicing in his own law firm, he was a Staff Attorney at The Legal Aid Society. On Oct. 24, 2011, 12-year-old Garrett Phillips was murdered in his home in Potsdam, a small town in upstate New York. Police quickly zeroed in on a suspect in this unthinkable crime: Oral "Nick" Hillary, a black man in the mostly white community, who was a soccer coach at Clarkson University and the ex-boyfriend of Garrett's mother, Tandy Cyrus. WHO KILLED GARRETT PHILLIPS? chronicles the five years following the murder, as Garrett’s family and community relentlessly seek justice for Garrett, and as Nick, who maintains his innocence, fights to clear his name and take back control of his life while raising five children. Through interviews with local police investigators, District Attorneys, defense lawyers, Phillips' family members, friends of Tandy Cyrus as well as Nick Hillary and his children, along with extensive police audio and video recordings, and courtroom footage, the film is a gripping, eye-opening look at how justice is delivered and delayed. WHO KILLED GARRETT PHILLIPS? seeks to uncover the truth behind both the tragic murder of a young boy that traumatized a town, as well as the vilification of a black man who was swept up in a quest for justice, and the enduring mysteries that remain. Directed by two-time Academy Award® nominee and Emmy® winner Liz Garbus (HBO’s A Dangerous Son and Nothing Left Unsaid: Gloria Vanderbilt & Anderson Cooper, and What Happened, Miss Simone?), the captivating two-part documentary WHO KILLED GARRETT PHILLIPS? looks at the case from the initial investigation through the arrest and numerous legal twists and turns that culminated in Hillary’s trial for murder five years after the crime. Director Liz Garbus joins us to talk about how this case raises troubling questions of racial bias and issues surrounding policing and the criminal justice system. October 24, 2011. Potsdam, New York. 12 year old Garrett Phillips had played some basketball with friends after school one day and then headed home after his mother, Tandy Cyrus, called to tell him that he needed to start on his homework. Neighbors heard strange noises from his apartment after he arrived home. Law enforcement would hear someone moving around inside after showing up. When they finally gained access they discovered Garrett on the floor. He had a pulse but they could tell something was wrong. As an ambulance raced to the apartment a window was found to be open. The screen pushed out where someone may have exited. Within hours the boy died. It was discovered that he had been strangled and suffocated. A short list of suspects was drawn up, but front and center was an ex-boyfriend of Garrett's mother. Nick Hillary denied responsibility and felt that discrimination was the reason why he was being investigated. But the Jamaican born soccer coach wasn't the only ex who may have had a motive. Tandy had also previously dated a sheriff's deputy who might not have been happy about losing her, either...
