Let's talk about Trump and the ‘manifestly unlawful'....
First, Leah and Melissa explain the legal battles around the ICE occupation in Minnesota and what might come after the killings of Renee Good and Alex Pretti. Then, Leah, Kate, and Melissa run through the latest legal news, including Jack Smith's testimony before the House Judiciary Committee, before diving into this week's blockbuster oral argument, Trump v. Cook, on whether Trump has the power to fire Lisa Cook from the Federal Reserve Board. They also cover the week's other oral arguments, including a Second Amendment case where Sam Alito came out as woke…for guns. Finally, with apologies to the Fifth Circuit, a new nominee for America's worst circuit court. Brad runs Bannon Communications Research, a polling, message development and media firm which helps labor unions, progressive issue groups and Democratic candidates win public affairs and political campaigns. His show, 'Deadline D.C. with Brad Bannon,' airs every Monday from 3-4pm ET. Brad is joined by CNN Military Analyst Cedric Leighton (USAF-Ret.). The two discuss Trump's capture of the Venezuelan President on their soil, and whether or not the action was lawful. Additionally, they posit whether this move by Trump undercuts the U.S. argument that China should keep its hands off of Taiwan. They also analyze the prospect of invading Cuba or Greenland, and the impact of a more Western Hemisphere-centric foreign policy on the security of the U.S. Lastly, the pair details Defense Secretary Pete Hegseth's continued retribution against Senator Mark Kelly, a U.S. military veteran, for a video he was part of encouraging military members only to follow lawful orders. Then, Brad is joined by Sarah Jones, Editor-in-Chief of PoliticusUSA. The pair discusses the anniversary of the January 6th insurrection, as well as Jack Smith's recent testimony to Congress on how culpable President Trump is for the attack on our Capitol. Next, they preview the incoming cost increases for Americans' health insurance, thanks to the changes that Trump and Congressional Republicans have made to the Affordable Care Act. Finally, Sarah evaluates how possible it seems for Democrats to retake the House during this year's midterms, and whether the Senate could be attainable. Col. If you've ever wondered about your rights during an arrest, or what really constitutes “unlawful,” this episode delivers clear answers, practical advice, and a much-needed reality check.Welcome back to another episode of Lawyer Talk! Today, Steve Palmer and Troy Henricksen talk about a hot-button topic that's sparked tons of debate and plenty of strong opinions: Can you legally resist an unlawful arrest?Building off recent listener questions and comments, the conversation unpacks what the law actually says, where confusion often arises, and—most importantly—why the courtroom is the right place to argue an unlawful arrest, not the streets.Together, Steve Palmer and Troy Henricksen break down misconceptions about probable cause, discuss real-world scenarios, and clarify the difference between legal defenses after the fact and dangerous choices in the moment.Moments03:55 "Charges, Police, and Legal Defense"07:49 "Resisting Arrest and Court Rights"Here are 3 key takeaways:Legal Rights vs. Practical Realities: While Ohio law recognizes resisting an unlawful arrest as a legal defense, trying to do so on the street can have dangerous—and even fatal—consequences. The courtroom is the right place to fight back, not during the incident itself.Probable Cause Standard Is Low: Many people misunderstand what constitutes “probable cause.” As Troy Henricksen points out, it doesn't take much for an officer to make a legal arrest—matching a vague description might be enough.Courtroom Is the Battleground: Steve Palmer emphasizes that even if an arrest is later found to be unlawful, resistance during the arrest can lead to additional charges. The best course of action is to comply in the moment and let your attorney fight for you in court.Got a question you want answered on the podcast? Call 614-859-2119 and leave us a voicemail. Stories this week:A woman in Japan “marries” an AI chatbot, raising serious questions about the nature of marriage, human relationships, and how emerging technologies blur the line between real and artificial intimacy. An Atlantic article suggests physics may be reaching the limits of reductionism, as living systems exhibit emergence, self-organization, and information that can't be explained by particles alone. A New York Times piece sparks discussion on when military personnel are morally obligated to disobey unlawful orders, drawing on just war theory and biblical principles of higher law. Ross Douthat's analysis of the rightward shift among young men argues that perceived institutional discrimination and lost opportunities are fueling resentment and radicalization. Listener question: Should churches use AI generated worship music?Listener question: Should woman receiving abortions be charged as criminal "masterminds"?Note: Our Weekly Cultural Update episodes will be on hiatus during Christmas & New Years. News of a U.S. attack on a boat off the coast of Venezuela—which included a second strike on survivors of the first—has raised new concerns about the administration's operations against alleged drug traffickers. Legal analysts, including some at Lawfare, call the second strike clearly unlawful. So why did the U.S. military agree to follow the order? On today's episode, Executive Editor Natalie Orpett discusses the roles and responsibilities of military personnel with Frank Rosenblatt, a professor at MC Law and a former U.S. Army Lt. Col and Judge Advocate General in the U.S. Army, and Colby Vokey, former Marine Corps Lt. Col and Judge Advocate General. They talk about the duty to disobey unlawful orders, the complexity of choosing to do so, and what it means for the future of U.S. operations. To receive ad-free podcasts, become a Lawfare Material Supporter at www.patreon.com/lawfare. Thousands of Police issued 'formal warnings' have been scrapped after findings that 63% were issued unlawfully. 'Formal warnings' are used as alternatives to prosecutions where the offence is deemed unworthy of going through the courts. Last week, Police told all staff that compulsory training will be rolled out and an updated policy for formal warnings would be issued by the end of the year. Defence lawyer John Munroe joined Heather du Plessis-Allan to chat about how this happened, and what it means. LISTEN ABOVESee omnystudio.com/listener for privacy information.

A judge in the United States has dismissed two high-profile criminal charges brought by the Trump administration against the president's perceived enemies. The judge says the administration violated the Constitution in its appointment of Lindsay Halligan to prosecute the pair, rendering the charges she brought unlawful.
Nicolle Wallace covers a judge's ruling that the interim US attorney for the Eastern District of Virginia, Lindsey Halligan, “has been unlawfully serving in that role…”. With the judge's rebuke against Halligan came the dismissals of the criminal cases against former FBI director James Comey and New York Attorney General Letitia James, which Comey says is nothing short of a win for the rule of law.Later, Lt. General Mark Hertling breaks down the Pentagon's investigation into Senator Mark Kelly, one of the six Democrats who Trump has accused of “sedition at the highest level,” due to his participation in a video reminding active servicemem bers to refuse illegal orders. For more, follow us on Instagram @deadlinewhTo listen to this show and other MS NOW podcasts without ads, sign up for MS NOW Premium on Apple Podcasts. CannCon and Alpha Warrior dive straight into one of the most chaotic 48-hour stretches in recent political memory, breaking down the explosive fallout from Democrat lawmakers urging the military to refuse “illegal” orders—something the guys argue is closer to a call for insubordination than anything Trump has said. From congressional rhetoric to Biden-era military politicization, they unpack why this moment is far more dangerous than the media admits. The episode also revisits the growing controversy around the J6 pipe bombs, analyzing newly surfaced footage, the questionable canine sweeps, overwritten surveillance, and the suspicious Capitol Police search patterns that have everyone asking what really happened. Along the way, CannCon and Alpha mix sharp analysis with the usual veteran-style banter, roasting inter-service rivalries, laughing through technical failures, and sharing viewer messages. It's a fast, fiery SITREP filled with hard questions, sharp insights, and zero patience for political games.

America is facing unprecedented division and anxiety, but this is also a moment of new possibilities and bold leadership. In this powerful episode, your host Paul Rieckhoff (@PaulRieckhoff) continues the Meet the Independent Candidate series with Ty Pinkins—army veteran, lawyer, lifelong Mississippian, and independent candidate for US Senate. Pinkins shares his compelling personal journey from the cotton fields to the campaign trail, discusses the failures of both parties, and lays out why Mississippi—and America—need true independent voices now more than ever. Packed with the kind of real, unfiltered conversation you won't hear elsewhere, this episode is a must-listen for anyone who cares about breaking up the partisan gridlock, challenging big money in politics, and unifying the country.
