President Cyril Ramaphosa “stumbles through life under the misapprehension that he's not accountable to South Africans for what he does, forgetting who put him there in the first place. South Africans.” This is the charge from Democratic Alliance (DA) MP Advocate Glynnis Breytenbach. She spoke to BizNews after the DA laid charges of corruption against Human Settlements Minister Thembi Simelane for allegedly stealing more than R700 000 by fraudulently billing Eskom when she worked for Vitrovian whose charges to Eskom appear “ridiculously” inflated. Eskom was allegedly invoiced by Vitrovian for work done by employees that did not exist, and Simelane's signature appears on the very first of these fraudulent invoices. The corruption charges come on top of Simelane's alleged involvement and subsequent implication in the looting of VBS Bank - after which the President ignored calls to suspend or sack her, and instead just moved her from Justice to Human Settlements. He has also repeatedly refused to disclose the content of Simelane's report to him on these allegations. Breytenbach believes his continued protection of Simelane raises serious questions on his ability and willingness to root out corruption at the highest level. “There are many ministers in the Cabinet that are less than…salubrious…who should, in all fairness, step aside and not hold those positions,” Breytenbach says.

In her first chat with BizNews since the election, Democratic Alliance (DA) Justice spokesperson Glynnis Breytenbach comments on Justice Minister Thembi Simelane's alleged links to the VBS Bank scandal, saying: “…the issue is that it's untenable for her to continue as the Minister of Justice if there is in fact a matter being investigated against her.” She also gives an update on her party's legal action to stop former Judge - and MKP MP - John Hlophe from sitting on the Judicial Service Commission (JSC). Meanwhile, she is pressing ahead with the proposed Anti-Corruption Commission Bill - despite President Cyril Ramaphosa signing into law the National Prosecuting Authority Amendment Bill, which makes the Investigating Directorate Against Corruption a permanent entity in the NPA. Breytenbach says the ID is not the “corruption-busting panacea that people want us to believe that it is.” As for the Government of National Unity (GNU) in which she now serves, Breytenbach says the African National Congress (ANC) is no longer “able to ram things through Parliament as they choose”.

South Africa's Justice Minister Thembi Simelane is expected to appear before Parliament's Portfolio Committee on Justice and Constitutional development on Friday to be questioned over an alleged link to the VBS Bank scandal. In this interview with BizNews, ActionSA's Parliamentary caucus leader Athol Trollip lists all the “red flags” in her case - and says: “She needs to be held to account in a court of law. That's the only place that's going to have any credibility.” He also gives an update on in-depth discussions over the coalition future of Tshwane.  He gives the assurance that although “the people of Tshwane have found it very difficult working with the DA”, ActionSA is “not going to be pushed into a motion of No Confidence (in DA Mayor Cillier Brink) because the ANC wants to do it today so that they can get their hands on Tshwane”. Trollip also renews his call for lifestyle audits to fight corruption - and gives examples of cases that make it imperative for “a couple of tall trees to be blown over”. On this second part of current affairs we talk to daily maverick's Pauli van Wyk, regarding an interesting article she wrote with News24's Kyle Cowan titled “Justice minister took half-a-million-rand 'loan' from accused VBS investment broker”. The article talks about Justice Minister Thembi Simelane who took a loan of more than half-a-million rand from a company that brokered unlawful investments of R349 million into VBS Bank by the Polokwane Municipality – while she was mayor of the city in 2016. According to Simelane's version, the R575 600 was "a loan" for "the purchase of a coffee shop business". She states the "loan in question has since been paid in full” but did not respond to requests for supporting documents to prove this version.  Minister Simelane also does not believe that there is a conflict of interest between her previous involvement with VBS and her position in the executive. The provisional liquidators overseeing the SA Post Office (Sapo) have come out against a plan put forward by the Department of Communications and Digital Technologies (DCDT) to place the struggling entity in business rescue. Just days before a court is set to hear the department's application, provisional liquidators Anton Shaban and Gerry Musi have said they fear business rescue is "not an option" and will not work. The post office was placed into provisional liquidation in March as it could not pay its debts. In a statement on Friday, Shaban and Musi said that for business rescue to work, Sapo would need billions of rands in extra funding and a complete overhaul of its business operations. Parliament still needs to pass the Post Office Amendment Bill, they stated. Instead of business rescue, the Shaban and Musi have put forward a compromise agreement under section 155 of the Companies Act. This is the same section of the act used by retailer Steinhoff in its R25-billion settlement agreement with creditors and shareholders. This section of the act allows a company to put forward a compromise agreement to creditors to bypass being liquidated or placed into business rescue. Let's compromise Shaban said a compromise agreement was the best route to restore the Post Office to solvency. He said it could be done more quickly and at a lower cost than business rescue, without revealing any figures. The DCDT, meanwhile, is hoping to convince the North Gauteng High Court in Pretoria that the Sapo is a candidate for business rescue when the matter is heard on Tuesday. The department has nominated Anoosh Rooplal, the chartered accountant who has overseen the liquidation of VBS Bank for the past four-and-a-half years, as the Post Office's business rescue practitioner. "We are crossing our fingers that the court responds to our prayer favourably," DCDT Minister Mondli Gungubele told a Parliamentary briefing earlier this month. If the court declines to place the debt-laden State-owned entity into business rescue and the section 155 settlement proposal does not pan out, the Sapo will face a final liquidation hearing later this year.

The South African Municipal Workers Union (SAMWU) says it is intact and financially stable, despite the negative media reports. The union says it is able to pay salaries to its workers, even though it has a loan agreement with the controversial VBS Bank that is currently under curatorship. President of the union, Pule Molalenyane, says they don't have a bond with VBS Bank but an 11 million rand photocopy machine loan agreement. Molalenyane says the contract is still binding and they are servicing the loan through a monthly debit order. The union however says they are not able to withdraw one million rand from its saving account until he VBS curatorship matter has been resolved. Amina Accram reports...
