A series of adverse legal findings has put both Julius Malema's seat in Parliament and his position on the Judicial Services Commission (JSC) in jeopardy. Should he be served a severe sentence for his firearm offences, he will be disqualified from being a member of the National Assembly. Meanwhile, Chris Oxtoby of Freedom Under Law, tells Chris Steyn why the Economic Freedom Fighters (EFF) leader's position on the JSC has become “untenable”. He stresses that Parliament now has enough grounds to act. He further gives the inside story of two days of JSC hearings - from which Malema was absent in order to attend the Ad Hoc Committee hearings. Oxtoby says despite there being some “credible” candidates to fill a Supreme Court of Appeal vacancy, none were able to get enough votes. Three of South Africa's civil society organisations have called on Economic Freedom Fighters Leader, Julius Malema to step down from his role in the Judicial Service Commission (JSC) following his latest conviction. Freedom Under Law, Defend our Democracy and the Council for the Advancement of the South African Constitution say Malema's recent conviction on gun charges, makes him unfit to hold a position that selects judges to be placed on the bench. The organisations say the recent removal of impeached former judge, John Hlophe from the JSC, further affirms the requirement that members of the JSC be fit and proper. EFF leader Julius Malema says he intends on appealing the guilty verdict handed down against him by the East London Magistrate's Court earlier today. Malema was found guilty on all five counts that were brought against him while his co-accused Adriaan Snyman, who had allegedly handed him the firearm in question was found not guilty. Malema had been fighting a seven year trial for discharging a firearm during the party's 5th anniversary celebration at Sisa Dukashe stadium in Mdantsane township back in 2018. His former bodyguard, Synman was found not guilty of unlawful possession of a firearm and ammunition. Malema has however stood firm, noting that he will continue the fight despite targeted attacks against him. Judgment is expected in the drawn-out firearm case against EFF leader Julius Malema and his former bodyguard, Adriaan Snyman in the East London Magistrate's Court today. The pair stand accused of illegally firing a weapon during the EFF's fifth anniversary rally back in July 2018 at Sisa Dukashe Stadium in Mdantsane, Eastern Cape. Afriforum has welcomed a Cape Town Equality Court ruling that found EFF leader Julius Malema guilty of hate speech. The decision relates to a 2022 speech tied to a 2020 incident at Brackenfell High School. Judge Mark Sher ruled Malema's remarks, calling for violence against white men were meant to incite hatred.
