This deeper structural transformation is often called state capture, and it has altered political systems from South Africa to Guatemala to Sri Lanka. What is this form of corruption? He also served as an investigative counsel at the U.S. Department of Justice. He clerked for U.S. District Judge Anita Brody and was a litigator in two international law firms. Mark is the author of Valor, which tells untold stories of 21st century American soldiers, sailors and Marines who faced gut-wrenching decisions to overcome enormous odds. He is a frequent speaker at industry events, and he regularly appears in the news media. He graduated from Columbia University School of Law, where he was a Harlan Fiske Stone scholar, and he earned his undergraduate degree from Duke University.Jodi Vittori is an expert on the linkages of corruption, state fragility, illicit finance and U.S. national security. She is a Professor of Practice and co-chair of the Global Politics and Security program at Georgetown University's School of Foreign Service. Jodi is also an associate fellow with RUSI's Centre for Finance and Security and was previously a non-resident fellow with the Carnegie Endowment for International Peace. Before joining the Georgetown University faculty, she was the U.S. Research and Policy Manager for Transparency International's Defense and Security Program and a senior policy advisor for Global Witness. Jodi also served in the U.S. Air Force; her overseas service included Afghanistan, Iraq, South Korea, Bosnia-Herzegovina, Saudi Arabia and Bahrain, and she was assigned to NATO's only counter-corruption task force. She was an Assistant Professor and military faculty at the US Air Force Academy and the National Defense University. Jodi is also a founder and co-moderator of the Anti-Corruption Advocacy Network (ACAN), which facilitates information exchange on corruption-related issues amongst over 1,000 participating individuals and organizations worldwide. She is a graduate of the U.S. Air Force Academy and received her PhD in International Studies from the University of Denver.Kedric Payne leads the government ethics program at Campaign Legal Center, where he works to strengthen ethics laws and hold public officials accountable at the federal, state and local levels. He conducts investigations into government corruption and initiates legal actions against officials who violate the law. At CLC, Kedric has been at the forefront of advancing reforms on issues such as congressional stock trading, Supreme Court ethics enforcement, executive branch conflicts of interest, and state ethics commission autonomy. His legal work and analysis have been featured in major media outlets. He has also testified at congressional hearings on government ethics and accountability. Before joining CLC, Kedric built a broad legal career across all three branches of the federal government and in private practice. He began as a litigator at Cravath and later practiced political law at Skadden. A lot of empty plastic bank bags were among the expensive bottles of whiskey and boxes of cigars left behind by the Guptas when they fled South Africa. So says Clive Lazarus, the Director of Park Village Auctions (PVA), the house that has sold the infamous Gupta compound where politicians and businessmen entertained lavishly during the State Capture era. The compound' three properties, numbers 3, 5, and 7 Saxonwold Drive, Sandton, Gauteng, and their contents of furniture and appliances fetched an estimated total of R34,500,000. To date, PVA, on behalf of the Business Rescue Practitioners, has successfully disposed of Gupta-owned assets previously belonging to Confident Concept, Islandsite Investments, Koornfontein Mines, Optimum Coal Mine, Optimum Coal Terminal, The New Age Medial and VR Laser Services, clawing back “maybe in the hundreds of millions,” says Lazarus, adding, however: ”but the Business Rescue Practitioners have sold a lot privately, not through auction. That amount I wouldn't be able to give you, but it's a considerable amount of money. I would presume in the hundreds of millions of rands.” He notes that PVA is “proud” to be involved in many State Capture auctions.

Trade and Industry Minister Parks Tau was “surprised” by the links of Deputy President Paul Mashatile to the new Lotto licensee appointed by him at the end of May. So says Toby Chance, the Democratic Alliance (DA) spokesperson on Trade, Industry and Competition, after the Minister was questioned today. “Minister Tau didn't appear to be aware of it, which raises serious questions of due diligence in the Lottery adjudication process.” Chance says there are lots of unanswered questions “and unfortunately, it's a classic case - yet again - of how State Capture and corruption works. It's a dubious connection between politicians, business people and public officials. which has led to the downfall of so many of our institutions.” Chance adds that the corruption charges laid against the Deputy President by the DA over a year ago are still pending. “And so I think that what Mr. Tau is able to uncover, if he does go ahead with this investigation into Sizekhaya's shareholding, could be the beginning of a slippery slope for the Deputy President.”

Bad governance involving collusion between councils and management is enabling corruption and capture at some of South Africa's historic universities. That is the charge from National Tertiary Education Union Secretary General Grant Abbott who says: “We've coined the term, you use the Corruption Mafia and that's a very good term. We've also coined the term University Capture in the line of State Capture that we see a lot of that unfortunately happening.” Abbott describes the “systemetic targeting” of whistleblowers and union leaders, including his union president who was kidnapped and tortured before being dismissed. “…it had happened one Sunday night, 12 men arrived at his house. We later learned that three of them were police officers. They did not produce an arrest warrant or anything like that, but you can imagine 12 men arriving at your house and he's at home on a Sunday evening with his wife and children. And they have AK-47s and big rifles and dressed in police uniform, and tell him he must come with them. They proceeded to then take him to an undisclosed location and tortured him for seven hours, allegedly trying to get him to confess to involvement somehow in the attempted assassination on the Vice Chancellor back then.” The CCMA has now overturned the dismissal and ordered his reinstatement. Abbott also comments on the case of the corruption-busting lawyers who now find themselves in the dock alongside some of the people they had investigated. He outlines the union's proposals to stop the corruption at and capture of higher education institutions.

Millions of South Africans were plunged into peak-hour darkness again last night. In this interview with BizNews, Kevin Mileham, the Democratic Alliance (DA) spokesperson on Electricity and Energy, says that ESKOM's fleet is running at 28% unplanned outages - and that “this last week, they've burned 210 million rands worth of diesel to keep the lights on.” As for sabotage, Mileham says: “I think that we've come a long way in that respect, that there's less, to use that word, sabotage than there was before… and I think that certainly the department and ESKOM are taking steps in that regard to weed those people out and take the necessary action against them. It's not happening as quickly as I would like, but there are steps being taken.” ESKOM is also battling the financial impact of corruption . “I think one of the challenges that we've got is, and again, I'm going to emphasise State Capture as being part of the problem, that we had a massively corrupt entity where things ran years over time, cost more than double what they were budgeted for. And as a result, ESKOM's balance sheet took a huge hammering.” Meanwhile, Mileham expresses concerns around the National Transmission Company which he says “needs to be really fully independent…it needs to be out of ESKOM's control and more independent minded so that there's a level playing field between ESKOM and the private sector generators.” He notes that ESKOM still behaves in a “very monopolistic fashion; that they aren't willing to play fairly and competitively with other role players”.
The State's failure to both prosecute Apartheid-era crimes and effectively pursue Zondo Commission State Capture accused, is back in the spotlight. For decades, allegations have persisted that the National Party (NP) and the African National Congress (ANC) cut a secret deal to avoid prosecutions on both sides following testimony at the Truth and Reconciliation Commission (TRC). In this interview with BizNews, Advocate Glynnis Breytenbach of the Democratic Alliance (DA) describes President Cyril Ramaphosa's belated decision to establish a Commission of Inquiry as a “desperate measure to avoid all of this dirty laundry being trawled through the public eye”. As for the “showcase” trial of former Vlakplaas commander, Colonel Eugene de Kock, she says: “..one always felt that he was kind of the scapegoat, because we all know that while he was busy doing those things that were so absolutely appalling, he was being lavishly praised by his superiors in the police and awarded medals for, amongst other things, bravery...And those people calling the shots have never been held to account which is both unsatisfying and deeply unfair.” Breytenbach is equally incensed about the failure to “see even one” notable State Capture prosecution. As for claims of “political interference” there as well, she says: “The last time interference was mentioned was with the access to the database of the State Capture issue; there was..a peripheral reference to interference. But…when we (Parliament's Portfolio Committee) asked about it, we were told, well, we prefer to keep it in-house because we don't want to make a fuss. Well, that's just not my approach to things, I'm afraid.”
