Sanchez in the U.S. Court of Appeals for the Ninth Circuit on May 15, 2025. Argued by Derek L. Shaffer (on behalf of Americans for Prosperity, et al.) and David Kolker (on behalf of Intervenor-Defendant Voters' Right to Know) and Eric Fraser (on behalf of Arizona Citizens Clean Elections Commission).Background of the case, from the Institute for Free Speech amicus brief:Proposition 211 imposes sweeping disclosure rules unlike anything seen before. On every metric, the law expands on its predecessors. It covers more people, more speech, for a longer time. Where other laws narrow, Proposition 211 widens.….Proposition 211 expands on other disclosure rules in virtually every way. It does not limit disclosure to speech about elections, to speech close in time to elections, or to speech by those engaged mainly in election advocacy. It does not limit disclosure to donors who intend to support election advocacy, or even donors who know their dollars might be used for election advocacy. By expanding every part of an ordinary disclosure rule, Proposition 211 “accomplishes a shift in kind, not merely degree.” See Nat'l Fed'n of Indep. Bus. v. Sebelius, 567 U.S. 519, 583 (2012) (“NFIB”) (Roberts, C.J., op.). Today's bonus episode is a live audience recording of my show with Americans for Prosperity of Georgia. The show opens with a short interview of Jeff Thompson of AFP in NW Georgia. We then dive into a shortened version of my show, touching on how the Legacy/mainstream media always seems to be on the exact same message and page as the narratives being provided by the Left. I then move into foreign policy with Israel taking out the head of Hamas in the very area that Harris told Israel not to go. Then, Harris has the audacity to address the press and take half credit for what Israel accomplished. We next turn to a quote from Gov. Ron DeSantis (R-FL) on whether or not we will ever hear him use the words “climate change.” After his reply I remind the audience that if we really wanted clean energy we'd be building nuclear power plants on every street corner. Before moving to the audience Q&A portion, we close with a quote from VP Harris on the Brett Baier interview where she said she would never call the American people “stupid” and yet I have a quote from here calling 18-24 year old's just that. I then take several questions from the audience and close with a reminder from our host, Jeff Thompson, on how to reach out to AFP and/or follow them online and on social media.
