Steven Devecseri was insured by the respondent Royal & Sun Alliance Insurance Company of Canada (“RSA”) under a standard motor vehicle policy. Under this policy, Mr. Devecseri was prohibited from operating a motorcycle with any alcohol in his bloodstream. To do so would constitute a policy violation. In 2006, Jeffrey Bradfield, Mr. Devecseri and another were riding their motorcycles. Mr. Devecseri drove onto the wrong side of the road and collided with an automobile. Mr. Devecseri was killed. Mr. Bradfield the automobile driver were injured. RSA engaged an adjuster to investigate the accident. The adjuster obtained the police report, which made no mention of alcohol. The adjuster noted that the coroner's report would confirm whether alcohol had been a factor in the accident, but neither he nor RSA took steps to obtain the report. Mr. Bradfield commenced and later settled an action against Mr. Devecseri's estate and his own insurer for uninsured and underinsured coverage. The other motorcyclist brought a personal injury action against Mr. Devecseri and Mr. Bradfield. RSA retained counsel to defend Mr. Devecseri's estate in both actions. Three years after the accident, RSA became aware that Mr. Devecseri had consumed beer before the accident. It then took steps to obtain the coroner's report, which confirmed that Mr. Devecseri's blood alcohol level was above zero at the time of death. RSA then took the position that the matter was off-coverage and it stopped defending Mr. Devecseri's estate. Mr. Bradfield commenced an action against RSA alleging that it was too late for RSA to take an off-coverage position. He argued that, having defended Mr. Devecseri's estate to the point of examinations for discovery even though it was or should have been aware of the policy breach, RSA had waived Mr. Devecseri's policy breach, or was estopped for denying the coverage. The chambers judge granted the application, finding that RSA's failure to take an off-coverage position after June 2006, and its defence of the claim amounted to a waiver by conduct of Mr. Devecseri's breach of the insurance policy. The Court of Appeal allowed RSA's appeal and dismissed Mr. Bradfield's action. In the overnight session, the S&P 500 and the Dow closed at all-time highs as worries about rising inflation subsided, while a bigger-than-expected fall in weekly jobless claims and the signing of a  $1.9 trillion stimulus bill into law reinforced expectations of a strong economic recovery. The Dow Jones Industrial Average rose 0.58%, the S&P 500 gained 1.04% and the Nasdaq Composite added 2.52%. Following a strong finish for US stocks, its Asian peers also climbed. Australia’s S&P/ASX 200 Index rose 0.8%, Japan’s Topix index advanced 0.2% and South Korea’s Kospi index added 1.3%. Indian markets too looked set top open on a firm footing, amid a firm global setup. The SGX Nifty was trading at 15,420 levels around 7.15 am against Wednesday close of 15,209. However, rising Covid-19 cases in the country, which have led to a lockdown in Nagpur, Maharashtra, could dampen the sentiment on Street. Yet, investors could take heart from the news that Bharat Biotech’s Covaxin has been given the regular emergency use authorisation, putting it on a par with the approval granted to Serum Institute’s Covishield’s. This development could help speed up India's inoculation process. Besides that, investors would also watch out for industrial production data for January and CPI inflation data for February that are slated to be released today. Now, a look at the stock-specific developments that are likely to sway the market today: Insurance stocks are likely to be in focus today after the cabinet has approved changes to the Insurance Act for increasing the foreign direct investment (FDI) limit to 74 per cent from the present 49 per cent. IDBI Bank has been taken out of the PCA framework by the RBI. The bank has provided a written commitment that it would comply with the norms of minimum regulatory capital, net NPA and leverage ratio on an ongoing basis. JSW Steel's crude steel production in February 2021 declined to 13.06 lakh tonnes from 13.20 lakh tonnes in the same month last year. Max Healthcare raises Rs 1,200 crore via the qualified institutional process. REC Ltd and Power Finance Corporation (PFC) have entered into a pact with Bhutan-based Kholongchhu Hydro Energy Ltd (KHEL) to finance a 600-megawatt hydroelectric project at Trashiyangtse in the neighbouring country. Wipro has appointed Pierre Bruno as Chief Executive Officer of its European operations. Lastly, an update on the primary market. Anupam Rasayan's Rs 760 crore IPO would open for subscription today. The company has fixed a price band of Rs 553-555 a share for its initial share sale, which will open for public subscription on March 12 and close on March 16. On Wednesday, it raised Rs 225 crore from anchor investors.

Welcome to our second episode of Tarion Talks. Last May, Tarion held its 2017 Annual Public Meeting and there were a number of questions about illegal building that were discussed, which led us to select illegal building as the topic for this episode. Just what is illegal building? Almost all new homes sold in Ontario are required by law to be built by a registered builder and be enrolled in the New Home Warranty Program administered by Tarion. Illegal building falls into two buckets: When a builder or vendor who is not registered with Tarion sells a newly built home, and, When a builder -- even one registered with Tarion -- begins construction of a new home without enrolling the home with Tarion. All builders in Ontario must be registered with Tarion. And all builders and vendors of newly built homes must enrol the home with Tarion. But why does this matter? Working with a registered builder is important for new home buyers for a number of reasons: It ensures buyers are aware of the warranty coverage for their new home and that they can turn to Tarion for help. Illegally built homes often do not meet Ontario Building Code standards, which means there could be safety issues. Illegal builders often ignore other laws like Ontario’s Workplace Safety and Insurance Act and the Occupational Health and Safety Act. Illegal building promotes an underground economy and creates unfair competition in the building industry. Illegal builders damage the reputation of reputable, registered builders and the home-building industry. In this episode, we talk more about how Tarion is combatting illegal building in Ontario and what happens to a builder who appears to be building illegally. We also share some of the warning signs that your builder may be building illegally and how to protect yourself and your home. This episode is hosted by Laurie Stephens, Tarion’s Director of Strategic Communications. Her special guest is Tanya Gibson, Director of Enforcement at Tarion.
