Former Eskom CEO, Matshela Koko has accused the state of pursuing what he calls a hate crime against him and his family. Koko's remarks follow a decision by the Middelburg Specialised Commercial Crimes Court which struck the corruption case against him and 18 co-accused off the roll on Tuesday afternoon. The court found that there have been unreasonable delays in the case involving alleged corruption to the tune of over R2 billion in the construction of the Kusile Power Station, outside Emalahleni in Mpumalanga. Speaking with members of the media following the court's decision, Koko further accused the state of taking South Africans for a ride. The National Prosecuting Authority says the ruling made by the Middelburg Specialised Commercial Crimes Court has no bearing on the merits of the case except procedures. The Middelburg Specialised Commercial Crimes Court on Tuesday struck the case against former Eskom boss Matshela Koko and others from the roll. The court found that there had been unreasonable delays in the R2.2-billion corruption case against Koko and his co-accused. This, however, is not a pronouncement of the innocence or guilt of the accused. The matter can be re-enrolled at a later stage. Koko was accused of being "at the centre of a corrupt scheme" which sought to help Swiss engineering firm ABB secure a lucrative R2.2-billion contract at the Kusile Power Station in Mpumalanga. With Koko allegedly wielding his influence at the power parastatal to swing the contract in their favour, an elaborate network of actors received kickbacks, and millions were ploughed into companies connected to his daughters.

There won't be fridges to keep the dead, says EFF leader Julius Malema on predicted stage 10 load-shedding, calling for former CEOs Brian Molefe and Matshela Koko to return to “rescue” Eskom. Malema said SA is heading for a disaster worse than Covid-19 as stage 10 load-shedding will last for three days and up to a month.He slammed the Zondo commission of inquiry into state capture as “useless”. The commission recommended Molefe face criminal prosecution for fraud and contravening the Public Finance Management Act over irregular contracts with The New Age publication. Koko also faces corruption charges related to Eskom. Malema called on President Cyril Ramaphosa to step down to “avoid insurrection”.

Solidarity has welcomed the arrest of Matshela Koko, his wife Mosima, and his stepdaughter, Koketso Choma, due to alleged corruption at Eskom.  Solidarity filed criminal charges against Koko and others at the Brooklyn police station earlier this year. The fraud, corruption, and money laundering trial has been postponed to the 23rd of March next year at the Middelburg Specialised Crimes Court in Mpumalanga. Koko has been granted bail of R300 000. Eskom CEO André de Ruyter says the power utility is facing two decades of unattended maintenance. Briefing the media yesterday, de Ruyter accused his predecessors of delaying the introduction of the Independent Power Producer Procurement Programme for a number of years. He says currently there was an additional 200 Mega Watts of power available from independent power producers, but contractually they are being prevented from feeding this into the grid, due to government regulations. Former journalist and current Eskom spokesperson Sikonathi Mantshantsha has launched a crowdfunding appeal for around R1-million to cover the costs of fighting a defamation suit filed against him by Matshela Koko. In an opinion piece in the Daily Maverick on Tuesday, Mantshantsha writes that one year ago he received a summons to answer a defamation charge from Koko, which includes a R600 000 damages claim. "The lawsuit followed a series of news articles I published in the pursuit of my chosen career as a financial journalist in the seven years to June 2019 in the financial publications of Times Media Group, now Arena Holdings," said Mantshantsha. After leaving Times Media, where he worked at Business Day and the Financial Mail, Mantshantsha joined Daily Maverick before being appointed Eskom spokesperson in January 2020. In the article, Mantshantsha appeals for financial help to fight the case. He says that although Arena Holdings has already settled about a third of the legal cost, a shortfall of around R1-million remains. "Needless to say, most journalists such as I am have never seen such a sum of money," he said. Koko, who briefly served as Eskom's acting CEO during his more than two decades at the power utility, told Fin24 on Tuesday that his defamation suit was directed against "false and defamatory" statements allegedly made by Mantshantsha when he was still a journalist. "He must be held to account. You can't lie and claim the lie is in the public interest. That's rubbish," he said via WhatsApp. Koko resigned from Eskom in February 2018 without admitting to wrongdoing.

Former Eskom CEO Matshela Koko has told the Commission of Inquiry into State Capture he felt vilified by the media and hopes the commission will help clear his name. Koko was one of the executives suspended at the power utility in 2015. The other three executives reached settlement agreements with Eskom. Koko this week gave evidence on the circumstances leading to his suspension at the power utility. He has also criticised the commission's investigators for failing to do due diligence in their investigations. Amina Accram reports

The National Treasury's forensic report has outlined corruption at Transnet and Eskom over the last six years. It pointed former Eskom executives Matshela Koko, Anoj Singh and Suzanne Daniels in wrongdoing at Eskom. The report also looking into the procurement of locomotives at Transnet has recommended that criminal charges be laid against a number of people including former CEOs Siyabonga Gama and Brian Molefe. Eskom head of generation Matshela Koko says he's determined to clear his name. He's taken to Twitter, to confirm his suspension after receiving a letter with fresh charges last night. Last Friday Koko won a Labour Court application preventing Eskom from firing him. Since the new board took over about two weeks ago, several Eskom executives have resigned or are being suspended. Yesterday, Chief Information Officer, Sean Maritz, was suspended pending an investigation into his dealings with consulting firm McKinsey.
