Just over a decade ago, the Truth and Reconciliation Commission (TRC) released its Final Report into Canada's Residential School System, including its 94 Calls to Action and 10 Principles of Reconciliation. Ep 561 - Indigenous Rights in One Minute Guest: Bruce McIvor By Stuart McNish “Over the 27 years since the Delgamuukw decision, the relationship between First Nations and the Government of Canada has changed – in some ways significantly. In others, not so much,” says Bruce McIvor, the author of "Indigenous Rights in One Minute.” The legal relationship took another step forward following the Haida decision in 2004. That decision led to changes in the way resource and infrastructure projects are approved and built. The Truth and Reconciliation Commission (TRC) was another milestone: first as a healing journey and second in establishing a record of indigenous history in Canada. The TRC recorded the mistreatment and trampling of rights of First Nations people and shared those stories with the entire country. The Commission heard testimony from 6,500 witnesses, which culminated in a call to 94 actions to further facilitate reconciliation. Understanding and appreciating the unique legal and societal circumstances indigenous people lived under and endured for more than 150 years is challenging. Bruce McIvor says, “A big part of reconciliation is calling out misinformation and lies, getting to the truth so that we can have honest conversations. The Apartheid Museum in JHB is set to unveil a new exhibition titled Grave Injustice: The Unfinished Business of the TRC. The exhibition, to be opened on Heritage Day,(WEDNESDAY Sept.24) highlights the ongoing struggle for justice and reparations since the Truth and Reconciliation Commission concluded in 2003. In January, 25 families of apartheid-era victims filed a lawsuit against the government, seeking R167 million in constitutional damages for its failure to pursue justice. They also urged President Cyril Ramaphosa to establish a commission of inquiry into longstanding allegations of political interference in these cases. The exhibition, curated by the Apartheid Museum in partnership with the Foundation for Human Rights, is expected to shed light on the legacy of impunity and the urgent need for truth by sharing the powerful stories of the families and survivors who have led this decades-long fight for accountability. The Pretoria High Court will today hear an application brought by President Cyril Ramaphosa and the government to reinstate their opposition in a constitutional damages case. The case involves 25 families and survivours of apartheid-era human rights violations seeking R167 million in damages for the state's alleged failure to investigate and prosecute crimes recommended by the Truth and Reconciliation Commission, TRC. Sadly, we recently got the news that our friend and frequent TRC contributor Dr. Stuart Farrimond passed away. Stuart was a medical doctor who had a brain cancer diagnosis at age 25. His treatment and side effects meant he had to stop practicing medicine. Stu reinvented himself as a food science expert - appearing on countless television and radio shows. He later became a best selling author of science education books. He will be missed.
