In his time as State Auditor, Shad White's team has stopped the largest public fraud in state history, made the largest civil recovery after an auditor's investigation in the history of the office, and concluded cases that, collectively, led to hundreds of years of prison sentences for fraudsters. White, a Certified Fraud Examiner (CFE), grew up in Sandersville, Mississippi, population 731, in a blue-collar family. His father and grandfather were oilfield pumpers, and his mother and grandmother were public school teachers. On the weekends, his father was music minister at their small country church, and his mother played the organ. Shad went on to earn degrees from the University of Mississippi, the University of Oxford, where he studied as a Rhodes Scholar, and Harvard Law School. White was appointed the 42nd State Auditor of Mississippi in July 2018 and won election to the office after establishing a tough, no-nonsense reputation. Prior to becoming Auditor, White served as a special prosecutor, won ethics cases against politicians who broke the law, and earned a certificate in forensic accounting (the use of accounting to discover fraud) from the University of North Carolina at Charlotte. He also serves in the military as a captain in the Mississippi National Guard. Today Shad, his wife Rina and their children live in Rankin County and are faithful members at St. Richard Church. Pharmacy Benefit Managers (PBMs) are increasingly utilizing gag clauses in pharmacy contracts as a means of prohibiting pharmacies from telling customers that paying for drugs out of pocket would cost them less than if they used their insurance and paid their copays. Critics argue that this practice results in artificially inflated prescription drugs costs. In this episode, Richard Church and Ryan Severson discuss recent litigation stemming from these gag clauses, as well as various state and federal efforts to prohibit PBMs from using gag clauses in their pharmacy contracts, including a proposal in President Trump’s recently released drug pricing plan. In the midst of the ongoing federal conversation surrounding the 340B Drug Pricing Program, individual states are implementing a number of regulatory efforts related to the 340B Program at an increasingly fast pace. These efforts are largely designed to avoid duplicate discounts, capture Medicaid drug rebates, and reduce reimbursement for 340B drugs. Many states have implemented new requirements at the claims level, though requirements widely vary by state and may vary by setting and whether billed as retail, clinic-administered, or contract pharmacy drugs. In this episode, Richard Church and Ryan Severson discuss several specific examples of states that are implementing changes to 340B billing procedures and some of the operational and compliance challenges that may arise, particularly for providers enrolled in multiple state Medicaid programs.
