A controversial pipeline project in Michigan has been stuck in legal limbo for years. But this month, the Michigan Supreme Court sided with environmentalists and leaned on an ancient legal framework: the public trust doctrine. This doctrine, which dates back to the Roman Empire, says that natural resources, like water, belong to the public, and development must do no harm. Legal experts say this argument is cropping up more and more in climate and environmental lawsuits. The prosecution spent Monday's redirect trying to put Dr. Avram Mack back together after Kevin Reddington's cross-examination left him bruised in the murder trial of Lindsay Clancy — the Duxbury, Massachusetts mother accused of strangling her three children, 5-year-old Cora, 3-year-old Dawson, and 7-month-old Callan, with exercise resistance bands inside the family's Summer Street home on January 24, 2023. Clancy faces three counts of murder and three counts of strangulation, has pleaded not guilty, and is mounting an insanity defense built on claims of severe postpartum psychosis and psychiatric overmedication.Prosecutors used their redirect to walk Mack through something the defense hadn't dwelled on: that "postpartum onset" exists as a specifier within diagnoses like bipolar disorder and major depression, even if postpartum psychosis itself isn't a standalone DSM entry. It's a technical point, but it's the kind of technical point that can quietly undercut a defense theory without anyone raising their voice. Beyond that, the redirect stayed in the weeds — definitions of what "postpartum" actually covers clinically, more on Mack's qualifications, and other procedural cleanup. No bombshells here, just two sides fighting over the credibility of one witness inch by inch, Reddington working to keep the earlier damage intact, prosecutors working to patch it.It's not the most cinematic day of testimony, but it matters — juries remember whether an expert held up under pressure, and this was the prosecution's chance to make sure Mack's opinion still counts for something. After the killings, Clancy allegedly attempted suicide by jumping from a second-story window, leaving her paralyzed from the waist down. Her husband, Patrick Clancy, was out running errands at the time and has since relocated to Manhattan. When news organizations challenged the restrictions as overly broad and argued that they interfered with the public's right to receive information about a major criminal case, Kohberger's attorneys defended the order and maintained that limiting public statements was necessary to prevent potentially prejudicial information from contaminating the jury pool. Their position was that the extraordinary attention surrounding the case created a genuine danger that unchecked commentary by people directly involved in the prosecution could make it harder to seat impartial jurors.The fight over the gag order became part of a larger battle between Kohberger's constitutional right to a fair trial and the media's First Amendment interests in reporting on the judicial process. Kohberger's defense repeatedly emphasized the volume of television coverage, online speculation and social-media discussion surrounding the case, arguing that additional statements from attorneys or investigators could further inflame public opinion before the evidence was presented in court.
