Ryan talks about his past work as an activist in the animal rights movement and as a scholar of government repression of animal rights activists, research described by the FBI as having the potential to cause “irreparable damage to national security”. He shares his extensive history of animal rescue operations, including rescuing animals from factory farms and thwarting whale poachers. We hear about the impact of the federal Animal Enterprise Terrorism Act, which designates investigative journalists and animal rescuers seeking to uncover and remedy animal abuse in the meat and dairy industry as terrorists. "Ecoterrorism" is considered the #1 domestic terror threat while ever increasing white supremacist violence continues to be ignored. Ryan explains why Department of Justice calls him the “most prolific” Freedom of Information Act or FOIA requester, including uncovering evidence of CIA involvement in Nelson Mandela’s imprisonment and the FBI cover-up of a plot to assassinate Occupy Houston leaders. We also discuss Property of the People, the transparency nonprofit Ryan co-founded to file FOIA claims and challenge the government in court. Ryan, Roqayah and Kumars end by discussing their personal attitudes as leftists towards veganism and animal rights, including reflecting on the tensions between animal rights organizers and other corners of the left. It’s hard to know what this episode is really about. Government bullying private enterprise? An evil conspiracy to crush a competitor? Confused consumers unable to read a label? All of the above? In a nutshell, on 12 August 2015 the US Food and Drug Administration sent a warning letter to Josh Tetrick, CEO of Hampton Creek Foods, informing him that two of Hampton Creek’s products: are in violation of section 403 of the Federal Food, Drug, and Cosmetic Act (the Act) [21 U.S.C. § 343] and its implementing regulations found in Title 21, Code of Federal Regulations, Part 101 (21 CFR 101). Just Mayo and Just Mayo Sriracha are the two products, and their crime is that they do not contain eggs. So they cannot be called “mayo”. Who sicced the FDA on Hampton Creek? has become the big question, as a pile of emails winkled out of the government by a Freedom of Information Act request seem to show that the American Egg Board orchestrated a campaign against Hampton Creek. I mentioned the story in my newsletter three weeks ago, which prompted Peter Hertzmann, an independent researcher and a friend, to suggest that the reality, as ever, is not quite so straightforward. Peter was good enough to fill me in on some of the background. Notes Peter Hertzmann’s website is well worth exploring for all sorts of good things. The American Egg Board is just one of several commodity checkoff programs. There have been some very interesting challenges to the whole idea of a mandatory checkoff, one of which recently featured on BackStory, a history podcast. I did ask if I could use it, but no reply yet; you can hear the segment here, but you will need a sharper legal brain than mine to decide whether mandatory funding of something called government speech raises First Amendment concerns. What got Peter and me into the sciencey discussion of mayonnaise and emulsions was his mention of the Harvard University Science and Cooking lecture series. I’m mortified to admit that I didn’t know about it. Many of the lectures are on YouTube, and one in particular that Peter pointed me to showed Nandu Jubany from Can Jubany restaurant in Spain making an aioli from nothing but garlic, salt and olive oil, and a bit of water. You can see him do that from about 13:30 to 17:30 in this video, but the intro, on emulsions, is worth watching too if you want to a better understanding. I’m sharing, without comment, some of the AEB material obtained by Ryan Shapiro. The FDA’s letter is, of course, online. Hacking the FBI: How & Why to Liberate Government Records Ryan Noah Shapiro PhD candidate, Massachusetts Institute of Technology After narrowly avoiding a lengthy activism-related prison sentence, I began PhD work at MIT in part to map out the criminalization of political dissent in Post-9/11 America. Especially in trying to obtain records from the FBI, Freedom of Information Act (FOIA) work became an essential component of my research. However, it quickly became apparent that the FBI routinely refused to comply with FOIA. Less clear was how the Bureau was managing to accomplish this systematic violation of federal law. Consequently, I spent years using FOIA and other tools to map out the hidden mechanisms of FBI non-compliance with the Freedom of Information Act. It worked. Using the FOIA methodologies I’d developed, I began receiving tens of thousands of pages from the FBI on its targeting of domestic protest groups. As a result, the FBI is now attempting to shut down my research by arguing in court that my dissertation FOIA research itself is a threat to national security. Such efforts by the FBI are just one component of the ongoing crisis of secrecy we now face. The records of government are the property of the people, but these records are consistently withheld from us. My talk will cover my research into the historical and contemporary use of the rhetoric and apparatus of national security to marginalize political dissent, my work to reveal the hidden mechanisms of FBI FOIA operations, the FBI’s efforts to shut down my research, the ongoing crisis of secrecy and consequent threat to democracy, and the pressing need for additional modes of hacking the FBI and other intelligence agencies to pick up where FOIA leaves off. The records of government belong to us. It’s time to reclaim them. Ryan Shapiro is a transparency activist and PhD candidate in MIT’s Department of Science, Technology, & Society (HASTS). Ryan’s research focuses on the political functioning of national security and the policing of dissent. To this end, he currently has over 700 Freedom of Information Act (FOIA) requests in motion with the FBI, making him the FBI’s “most prolific” FOIA requestor. Ryan also has numerous FOIA requests in motion with the CIA, DIA, and NSA, as well as a host of active lawsuits against these agencies for their routine failure to comply with his FOIA requests. The FBI is even now arguing in court that Ryan’s dissertation FOIA research itself is a threat to national security.
