In November of 2002, friends and family of 25-year-old Fort McMurray DJ Robert LeVoir became concerned that they hadn't heard from him in over two weeks. Although he'd been a troubled guy, struggling with drugs, cocaine in particular, it wasn't like Robert to be out of touch for so long. They worried about his welfare and began searching for him, eventually involving the RCMP. To Robert's family, the RCMP appeared to be doing little to find their loved one. However, behind closed doors, investigators were working on a tip from a man claiming Robert's roommate, Dax Richard Mack, also a DJ, had murdered Robert LeVoir and disposed of his body. In October 2008, the friends and family of 38-year-old Johnny Altinger were worried. Although emails and social media messages had indicated Johnny had run away on the spur of the moment with an unknown woman he'd just met, things didn't add up. The messages did not have the same feel as Johnny's typical fare, and he wasn't known for his spontaneity. Police had already spoken with the tenant at the Edmonton garage that Johnny was directed to on the night he disappeared. They'd seen some things that concerned them, but there was no sign of Johnny. Something seemed off with the 29-year-old filmmaker Mark Andrew Twitchell, the man they'd spoken to. Little did the police know that only a week before Johnny vanished, another man, Gilles Tetreault, had suffered a bizarre attack at Twitchell's hands after being lured to the same garage. Paul Lewin and Jack Lloyd are Toronto lawyers and activists who practise in cannabis and psychedelics law at their firm, Cannabis and Psychedelics Law Group LLP.What a great conversation! Paul has represented clients across Canada for over 27 years, practising with Lewin & Sagara LLP, fighting for clients at all levels of the Ontario Courts, including the religious use of cannabis, challenging the medical cannabis doctor-as-gatekeeper rules, the constitutionality of the limited cannabis strain choice, the cannabis extraction rules, and the cannabis grower privacy laws, which ended privacy breaches by police of cannabis growers. From 2011 to 2020, Paul was on the Board of Directors of the National Organization for the Reform of Marijuana Laws in Canada (NORML Canada) advocating for cannabis reform and lobbying politicians at all levels of government. Paul has spoken at cannabis events, moderated cannabis policy discussions and he has been interviewed dozens of times in the media on cannabis policy. Paul also advises doctors, lawyers, politicians and the police on cannabis laws and regulations, and the emerging psychedelic industry. Jack practices criminal and constitutional litigation relating to medical cannabis regulation at all levels of court in Ontario and British Columbia, and the Supreme Court of Canada. He also performs consultancy work relating to the cannabis industry and the emergent issues surrounding psilocybin for medical purposes all across Canada, excluding Quebec. Prior to becoming a lawyer, Jack was the editor at Green Candy Press, the world's largest publisher of books about the cannabis plant and psilocybin mushrooms. He continues to edit select titles for Green Candy Press, including an update to  The Cannabis Breeder's Bible, The Ganja Kitchen Revolution and Marijuana Chef Cookbook as well as the Psilocybin Chef Cookbook. In 2016, Jack edited The Psilocybin Mushroom Bible: The Definitive Guide to Growing and Using Magic Mushrooms, which was the first book on psilocybin mushroom cultivation released in over a decade. Jack is currently the President of NORML Canada, where he advocates for sensible regulations concerning cannabis in Canada.In this interview we also talk about Paul and Jack's most recent ruling R v. On this, our first post-coronavirus pandemic episode, Hilary Young and Robert Danay are joined by Steven Penney, Professor of Law at the University of Alberta Faculty of Law, to discuss R v Brown, 2020 ABQB 166. This was a case that gained national attention, in which a young man with no history of violence, consumed alcohol and magic mushrooms and went on a naked rampage in which he broke into strangers' homes and committed a brutal assault, all of which he did not recall doing after the fact. The discussion touched on the defence of extreme intoxication automatism, the constitutionality of section 33.1 of the Criminal Code and more. In obiter dicta, Steven recommended The Goodness Paradox by Richard Wrangham, Hilary recommended another story involving magic mushroom fuelled naked criminality, and Rob recommended a fantastic online criminal procedure lecture by University of Arkansas Law School professor Alex Nunn.

Episode 072 - On a freezing December morning the Castor Volunteer Fire Department braved the icy Alberta roads to attend a structure fire at a farm a few kilometers outside town. When the firefighters arrived there were red flags evident immediately. The family dog lay dead in the driveway from an apparent gunshot wound, two 9mm casings were nearby as was a partially full gas can which lay only meters away from the front door of the home, now almost burned to the ground. Three people, Sandra and Gordon Klaus, and their adult daughter Monica, had been at home at the time of the unsurvivable inferno. The only member of the immediate family left alive was the couple’s eldest son and Monica’s brother, Jason, who lived in a trailer nearby. Who could have committed horrific acts and why?
