From 1968 through the early 1980s, thousands of fires raged through the Bronx. The precise number is unknown and it's uncertain who was responsible for setting them. But at the time, most fingers pointed to the working-class Black and Puerto Rican tenants who lived in the borough. The newspapers said as much, as did the Blaxploitation movies of the late 1970s. Politicians, too: in the words of Senator Daniel Patrick Moynihan, “People don't want housing in the South Bronx, or they wouldn't burn it down.” The Bronxites who lived that history, however, have long identified a different culprit, and over the past decade, historians have arrived at a new explanation for the arsons. Arson - which frequently involves the destruction of property - and business are not typically thought to be compatible. Indeed, there is a whole industry - the insurance industry - whose stated business is the mitigation of risk, including the risk of fire. Over the course of the late 1960s and early 1970s, however, fire insurance and fire prevention became untethered. This, combined with other developments, created the circumstances for arson to become profitable for some landlords. In this month's episode, guest Bench Ansfield details the local, national, and international circumstances that helped fuel the rise of arson-for-profit in U.S. cities. In doing so, they show how the Bronx and other urban areas like it served as crucial sites of late twentieth-century financialization via a ground-up history of finance told from the perspective of Bronx residents and community activists. Along the way, we discuss insurance brownlining, community-developed arson-fighting algorithms, and disco.

A court has heard the man accused of lighting the fatal Loafers Lodge fire told a psychiatrist voices in his head told him to burn the place down. It was also revealed the man had previously been convicted of attempted arson. The 50-year-old defendant, whose identity is suppressed, has denied murdering five people by setting the Wellington boarding house alight in 2023. “Ladies and gentlemen, the Bronx is burning!” That legendary and apocryphal phrase, allegedly uttered by announcers during the 1977 World Series as flames rose above Yankee Stadium, seemed to encapsulate an entire era in this nation's urban history. Across that decade, a wave of arson coursed through American cities, destroying entire neighborhoods home to poor communities of color. Yet as historian Bench Ansfield demonstrates in Born in Flames: The Business of Arson and the Remaking of the American City (Norton, 2025), the vast majority of the fires were not set by residents, as is commonly assumed, but by landlords looking to collect insurance payouts. Driven by perverse incentives—new government-sponsored insurance combined with tanking property values—landlords hired “torches,” mostly Black and Brown youth, to set fires in the buildings, sometimes with people still living in them. Warning, this scenario mentions suicide. The insured's 21-year-old son lives with them and suffers from depression. While the insured parents are away, their son goes through a breakup and decides to kill himself. He gets very drunk and douses the entire first floor in the gasoline they use for their lawnmower. He turns over a candle and goes upstairs to pass out. A neighbor called the police in time, and the young man was saved-- but the resulting fire consumed the house.   Notable Timestamps [ 00:10 ] - John shares a serious scenario that raises pertinent coverage questions. [ 01:22 ] - The intentional loss exclusion ensures insurance covers fortuitous/accidental events, not property purposely destroyed for the prupose of collecting insurance proceeds. [ 02:00 ] - The intentional loss exclusion is clearly worded: if any insured commits an intentional act causing loss, no insured, even innocent ones, are entitled to coverage. [ 03:16 ] - Two criteria for the exclusion: the act must be by an insured, and committed with intent to cause loss, which can be difficult to prove. [ 04:53 ] - Courts consider if the perpetrator lacked the ability to form intent due to mental handicaps, mental health issues, or age, making the exclusion potentially inapplicable. [ 05:40 ] - Courts are now less friendly to the intoxication defense. The inferred intent doctrine holds that if a loss (like fire from gasoline) is "substantially certain to occur," intent is inferred, regardless of primary motive (e.g., suicide). [ 08:30 ] - Suicidal intent can be a defense, as individuals may not be in their right mind. However, the inferred intent doctrine makes recovery difficult if the actions were likely to cause property damage. [ 13:36 ] - In states with a Standard Fire Policy (SFP), which uses "conduct of the insured," innocent co-insureds might still recover, overriding tighter policy language. Authorities arrested the former city manager for La Marque, Texas on Saturday. A warrant for the arrest of J.B. Pritchett had been issued about a week prior on charges related to felony arson and tampering with evidence and misdemeanor charges related to allegedly lying about his education and military service on his job applications and resume.
