De wetgever zit in een spagaat met de BOX3 heffing. Enerzijds is er het Kerstarrest van 24-12-2021 dat zegt dat de heffing moet worden gebaseerd op “Werkelijk Rendement”. Daarnaast ligt er het wetsvoorstel ‘Wet Werkelijk Rendement' waarin staat dat het werkelijke rendement nauwkeurig wordt bepaald, maar komt de Raad van State met haar advies om dat voorstel aan te passen, omdat het veel te ingewikkeld is. In deze RB Podcast doet Nick van Bemmel, senior fiscalist bij DDJ in Arnhem een poging om uit deze BOX3 impasse te komen.
