In this episode of the Level of Infection Prevention Podcast, our guest is Duane Tinker, also known as the “Tooth Cop.” He is one of the top compliance experts in the country, has over 20 years as an Emergency Medical Technician and ten years as a Law Enforcement Officer. His unique experiences have given him a unique perspective and a wealth of experience of what to do when it comes to compliance and risk management. Today, he discusses the importance of compliance in a dental practice and what you must do to establish compliance with your business. What is Compliance in a Dental Practice? [1:50] Compliance is about adhering to requirements in many areas that rules and regulations about a dental practice. Duane says that there are many things that we have to comply with and many other regulations and rules that we have to implement and follow in a dental practice. Compliance is about having a series of mechanisms and systems to make sure the way you operate your dental practice is within the rules and regulations. You can incorporate that into your business practice because it'll protect the practice and your staff from both civil and criminal liability for not complying with regulations. Creating Compliance in a Dental Practice [3:30] Most people glaze over or gag on the word “compliance.” Some people follow the rules, and people struggle with authority. The idea of compliance starts with identifying rules and regulations. People have to comply with and establish compliance that people can oversee. For most dental practices and even corporate dentistry, there are so many different roles that need to be addressed by compliance. Top Compliance Areas that the ICC needs to Handle [7:45] Duane says to focus on things that are immediate threats to the safety and security of your patients and staff, especially to your patient's health information. When you think about compliance, it can be overwhelming. So you need to develop a plan and figure out the big things you need to focus on. Figure out the most significant risks you face in your practice and take care of those first. Put a system in place, check to ensure it is working and put it on the back burner. Then come back and double-check it later on and move on to the next thing. The whole thing about managing the compliance program is it's like a marathon. It's not a race, there's no finish line, and you will never finish. The whole goal of having a compliance program is to leave the office tomorrow in better shape than you left it today. Importance of Compliance [10:50] One of Duane's main complaints is that they are swamped on time to comply. He says that you have to prioritize and allocate time to address it. You have to give time and resources to address your compliance concerns because when something happens, that affects the practice negatively, they are 100% preventable. But to prevent them from happening, you have to be dedicated to looking at your systems and identifying where and what you need to make tweaks. Then you make a commitment and follow through with that. Overcoming the Overwhelmingness of Compliance [14:05] Just do the best you can to evaluate your practice periodically. Schedule it throughout the year, looking at different aspects of your practice. You won't have a general idea of where you are, where you're going, and what you need to do to comply with your state's requirements. Make sure to pay registration fees and systematically do that with each of the different risk areas that affect your practice. Do a record on it once a year and involve your whole staff. [16:00] You will find many mistakes. Many people use templates and what you need to identify and recognize in that is if your template is complete. Figure out if you are deleting information from a template that doesn't pertain to a particular situation. Know if your staff is leaving parts of the template blank, not realizing that they need to delete it, or deleting information that doesn't apply to a given situation. Addressing Compliance [25:18] Sometimes, all it takes is just somebody that cares enough to allow you to discover for yourself that you're not there. You have great people and a great dental practice, but there are some things that you're just not ready for. Getting that information and doing something with it in a meaningful way is understanding that it's not about compliance. Sometimes, it's about understanding and addressing how to manage your risks. When you change the way you look at things, the things you look at change. Manage your risks and do the right thing. [12:22] Raising Australian Shepherds on a ranch [13:05] Dentists that administer nitrous oxide [14:31] How dentists get busted for lack of compliance I'm an introvert—until I take the stage I am an introvert. I'm like Sylvester Stallone (Hawk) in the Movie “Over the Top.” Hawk is a professional arm wrestler preparing for a national event in Las Vegas. At the end of the movie, Hawk is interviewed. He said that before he steps in the ring, he turns his hat backward and it's like he turns his face and becomes a different person. That's how I feel when I'm about to walk on a stage and speak. I'm a shy wallflower until I take the stage.  Andrea is very talkative and is a self-proclaimed social butterfly. But she believes it's just a different version of her. She has a degree in English and loves writing and being introspective. So she's at her best when she's chosen to be alone. She feels at peace. She recharges, then gets back out with people.  Country living versus city living My wife and I have a ranch and sometimes I'll go weeks without leaving it. We've got everything we need here (including fast internet). Andrea grew up in the country, too, in a small town of 1,500 people. She thought she was going to stay there for life but she followed her brother to Texas. She packed everything in her Maxima, got a part-time job within two weeks, and has been here for almost 8 years. She'd never in a million years thought she'd end up in a field close to healthcare and now she can't imagine anything else (including living in the country again).  My wife and I have 6 Australian Shepherds, five of which are related. We have a lot of livestock (sheep, goats, ducks, and geese) because my wife does competition herding with her dogs. Supporting my wife in training the dogs is my extracurricular activity. Plus, there are always things to do around a ranch.  Dentists that administer nitrous Switching gears, I've been getting a lot of calls and emails from dentists who are shocked about rules that have been in place for three years now. Many dentists are way out of compliance and don't know where to start.  How are dentists getting busted for lack of compliance? The state only does inspections for those with level 2, 3, and 4 sedation permits. Those who are administering nitrous will never be inspected for that. But let's say a new patient comes to see you for a second opinion. You prepare a treatment plan, make your recommendations, and the patient decides to go with you for treatment.  Six months down the road, you get a letter from the state board. They want to copy the patient's record and the dentist's emergency plan, and the dentist has no idea what they're talking about. Nine times out of ten, it's a complaint against another dentist. That's how dentists get busted for not having emergency plans. It's how the conversation starts with me.  Dentists who administer nitrous: What you should be doing What do you need to do? You need to have a written emergency plan in place and train your staff on that plan. You need an AED, stethoscope, blood pressure cuff, backup suction unit, and emergency oxygen unit. Most of the dentists that are calling me had no clue. Luckily, it's an easy fix.  The takeaway? Be in the know. Get the newsletter from your state licensing board. This week it is my pleasure to speak with Duane Tinker and he has a very interesting background! Duane worked in the Texas law enforcement industry then transitioned to a dental office investigator. His challenge with transitioning to this role was learning the dental industry so he could do his job well. He dealt with areas such as investigating clinical complaints against practices, fraud, and people working outside the scope of their licensure.  Through this role, Duane met many dentists and realized they were great people—some just didn’t know, what they didn’t know. Drawing on his law enforcement experience, Duane recognized the value his experiences could have when shared with dental professionals, in a meaningful way, to prevent them from getting into situations such as the ones he was being assigned to investigate. This realization was the catalyst for opening his own business to help stand in the gap for dentists and help dentists prevent situations that could bring about legal action against them. Duane’s perspectives are very important for all dentists to hear so be sure to listen to this episode. After all, you may not know what you don’t know. In this episode, you’ll hear: Tips for dealing with an investigator if you are faced with this situation. Make sure you have an attorney on your speed dial. Know which one to use and which ones to avoid. Make sure the attorney is someone you know and trust. Lying to an investigator is obstruction of justice so make sure you are protecting yourself and preserving your rights by not commenting initially to an investigator. Electronic records would need to be printed for an investigator working under a subpoena. Duane realized how many great people are in dentistry and that he wanted to work with dental professionals to help them understand which dangers can occur in their practices they may not be aware of.  How Duane’s company, Dental Compliance Specialists, can help dental practices. The importance of having your paperwork and compliance information in order. That details matter. For example, having expired medications could result in disciplinary action. It’s pretty exciting to me to be bringing you this first episode of my new podcast, “Talking With the Toothcop.” I’ve been wanting to do this for a long time and finally decided it was time to get moving. You’ve happened upon the “zero episode” where I explain a bit of who I am, why I’m doing this podcast in the first place, and what you can expect from it week to week. Dental compliance is something all you busy dental professionals know is important but don’t have the time to learn inside and out. That’s why I’m here. I’m the toothcop. Compliance has a lot to do with whether your dental practice is successful or not. All you dental pros out there know that building a successful dental practice isn’t as simple as graduating from dental school and turning on your "open" sign. You’ve got a lot of regulatory hoops to jump through in order to set up shop efficiently and in a way that isn’t going to get you into trouble. You could do the work to learn it all yourself, or you can let me help. I’m here to walk you through the headaches of OSHA and HIPAA compliance, the upkeep of patient records and more.
