La France a été condamnée depuis 2020, à plusieurs reprises, par la CEDH pour l'indignité des conditions de détention ce qui rend ce sujet portant sur les droits fondamentaux d'une actualité toute particulière. Par ailleurs, les juridictions administratives prennent également régulièrement des décisions en la matière. Ce sont ces décisions récentes qui nous ont conduit à évoquer ce sujet. Et notamment certaines d'entre elles, largement relayées dans les médias et qui renvoie à un débat de société sur les conditions de détention des détenus, sur la manière dont la société française considère et traite ses détenus, notre vision de la prison. La première, il s'agit d'une une ordonnance du 28 octobre 2025, du juge des référés du tribunal administratif de Nouvelle-Calédonie, qui enjoint à l'administration pénitentiaire de prendre trois séries de mesures destinées à mettre fin aux conditions de détention de cinquante détenus du centre pénitentiaire de Nouméa, dit « Camp Est », qu'ils estiment indignes. Rappelons que ce juge peut être saisi en cas d'urgence particulière afin d'ordonner toutes « mesures nécessaires à la sauvegarde d'une liberté fondamentale » dans le cas où l'administration y a porté une « atteinte grave et manifestement illégale » (art. L. 521-2 du code de justice administrative). Le juge a enjoint l'administration de : - prendre toutes les mesures qui apparaitraient de nature à améliorer les conditions matérielles d'installation des détenus dormant sur des matelas posés à même le sol au sein de la maison d'arrêt, du centre détention n° 2, du service général et en quartier de préparation à la sortie ; - procéder à la désinsectisation et à la dératisation et mettre en place une solution pérenne en vue de remédier à la présence excessive de nuisibles ; - assurer la séparation du bloc sanitaire dans l'ensemble des cellules où sont détenues plus d'une personne par la fourniture de rideaux adaptés là où ils sont manquants. J'aimerais mettre en parallèle de cette décision du juge administratif, les conditions de détention de M. Nicolas Sarkozy à la prison de la Santé ont récemment défrayé la chronique. Naturellement, les situations ne sont pas les mêmes, les procédures non plus, et il ne s'agit pas de réaliser un sophisme absurde, une fausse équivalence. Pour rappel, après vingt jours de détention provisoire, M. Sarkozy est sorti de la prison de la Santé, le lundi 10 novembre 2025, à la suite de la décision le même jour de la cour d'appel de Paris qui l'a placé sous contrôle judiciaire conformément aux réquisitions du parquet général, en attente du procès en appel. Dans l'affaire Sarkozy-Kadhafi, il était accusé d'avoir été corrompu par le dictateur libyen Kadhafi en échange du financement illégal de sa campagne électorale, et il a été condamné en première instance, en septembre 2025, à une peine d'emprisonnement ferme d'une durée de 5 ans pour association de malfaiteurs. Il était écroué à la prison de la Santé de Paris depuis le 21 octobre 2025. Bref, Il nous a semblé important de revenir à l'occasion de ces débats sur les conditions de détention des détenus sous l'angle de l'étude de leurs droits fondamentaux. Pour cela, nous recevons aujourd'hui Michaël Poyet, magistrat administratif, et enseignant au sein de la Prépa ISP.
