The Dobbs decision that overturned Roe v. Wade has, in many states, decimated access to abortion care and prevented abortion providers from treating patients. Dr. Leah Torres, Obstetrician/Gynecologist practicing in Tuscaloosa, Alabama, sits down to talk with us about the state of abortion access in Alabama and how the United States' healthcare system layout is generally preventing access to quality care. Currently, there is no abortion access in Alabama. Prior to the overturning of Roe v. Wade, the rate of people dying in pregnancy and childbirth in Alabama was twice the national average. Lack of abortion access will only make these extremely upsetting numbers worse. In addition, the United States' current healthcare system is compounding these dangers for pregnant and birthing people in this country. From transgender healthcare to abortion to vaccination, the politicization of modern medicine comes from the select few embedded in our current healthcare system who have money and power to gain by exploiting the framework and those who seek care within it. Some states, such Alabama, continuously refuse to expand their Medicaid program blocking insurance coverage for those who need it most, while also limiting which providers and clinics can receive Title X funding. Medical students continue to face barriers to training in abortion care. Many residency programs state the miscarriage management training is the same as abortion care training, which is not true. Fellowships, which offer training in certain areas, are often years-long. This means after medical school and residency, many who want to learn about abortion care feel the need to take on another two-year long fellowship in family planning.A lack of sex education across the United States and the gatekeeping of comprehensive information about healthcare intensifies the inability to realize sexual and reproductive health care. When powerful institutions control the narrative about our health and bodies, often informed by “religious freedom,” this can lead to interpersonal relationship problems and mis- and dis-information. While this may seem big-picture, it has a very pin-pointed impact, leading to providers like Dr. Torres to treat individual patients who are coming in for treatment because of lack of access to education and basic care elsewhere. Many who seek care at Catholic hospitals (entities that don't often make their religious affiliation clear), may not receive the reproductive healthcare they want or need because of religious directives. Sam and Emma host Dr. Leah Torres of the West Alabama Women's Center to discuss her recent piece in Slate "Doctors in Alabama Already Turn Away Miscarrying Patients. This Will Be America's New Normal." Then, Sam and Emma are joined by Richard Revesz, professor and Dean Emeritus at New York University School of Law, to discuss the EPA v. West Virginia case before the Supreme Court. Emma and Sam first dive into Biden's approval of another round of military support for Ukraine and the ever-changing story of the Uvalde police comes under more and more fire as their faulting of Robb Elementary teachers becomes another disproven factor. Dr. Torres then joins as she, Emma, and Sam unpack the soft power of the anti-abortion laws in Alabama, starting with her assuming the role of a “pariah” among her colleagues upon her migration from New Mexico as an abortion activist and provider. This immediately resulted in another colleague filing an unethical complaint against her, which the state responded to by launching a full-scale investigation into Dr. Leah Torres over “fraud,” with completely unrelated and baseless accusations over vague form responses. Next, Dr. Torres takes this idea of the state deciding what their records say and mean, and shifts into a more specific discussion of abortion access and care, particularly in a state where that care is criminalized, telling stories of her colleagues forced into fear denying treatment to 13-year-old rape victims and miscarriage patients over minuscule rules and regulations that they might not be able to disprove, before she wraps up the conversation by diving deeper into the countless ways the growing abortion rhetoric and legislation will lead to needless deaths. Then, Sam and Emma are joined by Professor Richard Revesz as they get right into the idea of the “major questions doctrine,” cousin of the non-delegation principle, and the role it plays in today's Supreme Court ideology. After covering how it will be used in the EPA v. West Virginia, Prof Revesz dives deeper into how this doctrine takes on the administrative state, requiring specific guidelines for any government agency (whereas the non-delegation principle rejects delegation outright), the role it played in SCOTUS decisions against the CDC and OSHA, and what it can tell us about the goals of this Court. They wrap up the interview by focusing on public opinion regarding the Court, specifically, before looking at the role the legal-academic institutions across the US play in providing legitimacy to the Court. Leah Torres is a physician specializing in obstetrics and gynecology and she has the unique honor and humble responsibility of addressing some of the most sensitive and intimate of topics in people’s lives. Not only does she takes this aspect of her profession very seriously, but she has also made it a central focus of her practice. I did not know what to say at the point and was thinking of pausing the recording on my phone, but I noticed a tear come down her face, and I realise how much she must have gone through, the secrecy and the pain she had to carry all these years. I can pretend to even come close to understand fully what this must do to a woman's body, physically and physiology, but I want to try to do what I can to help this problem I see today. By that I mean, what is happening in the States with the current proposal for the law to be changed and made illegal unless the woman's life is at risk, but not in the case of a rap. After spending some time researching this topic on the internet, I found this: That the U.S. Supreme Court announced 7-2 decision in Roe v. Wade: That a woman’s constitutional right to privacy extended to decisions about whether to terminate a pregnancy, thus essentially declaring that laws prohibiting abortion were unconstitutional. Now surely this is good news, but it is reality, I’m guessing we are fighting against the shame and bullying on those poor woman, that to me should have the right to do what they feel is best for their life and body. I read from Amanda Palmer blog post on her patron this book Robin Marty - Handbook for a Post-Roe America, is this a good place to start? I read you had to leave a position because of hate mail, How difficult must that have been for you and your colleagues? How can those poeple against abortion can justify keeping a baby after a rape? How can we try to change some mind and see the truth? When I first contacted you on twitter you were very wairy, I’m guessing you must get a lot of crap for speaking out? How do you deal with that? What do you have to say to the people that hate you for speaking and standing for women. Is there a petition already out there for people to help the cause? Now I did create some fake profile on Linked In and I got loads of messages of men asking my fake girls out, I was a bit amused but shocked by it. Woman must get a lot of shit on a daily basis.
