Il a fallu attendre, la fin du XXe siècle pour que l’inceste devienne un sujet de discussion publique. Le premier article sur le sujet ne figure dans le journal Le Monde qu’en mars 1974. Pourtant, les chiffres sont là : selon une enquête Ipsos publiée en novembre 2020, un Français sur 10 serait victime d’inceste. Marie-Pierre Porchy a été juge des enfants puis juge d'instruction pendant 36 ans. Elle analyse, dans son livre "Les Silences de la loi" (éd. Fayard) – paru en 2003, réédité cette année et préfacé à l'aune de l'affaire Duhamel –, les manques législatifs pour lutter contre l'inceste.  Les timides avancées juridiques sur l'inceste Si l’inceste commence à devenir un vrai problème de société, ça n’a pas toujours été le cas. "Lorsque j’ai commencé à officier dans la magistrature et à l’époque dans le Nord, on considérait que ce problème était uniquement un problème éducatif", témoigne Marie-Pierre Porchy.  Les choses commencent timidement à évoluer, mais il reste encore du chemin à faire selon l'ancienne magistrate. "Pour caractériser le viol ou l’agression sexuelle, il faut prouver qu’on était sous la menace de la contrainte, de la menace ou de la surprise y compris quand on est un enfant. Pour moi c’est scandaleux. Une agression sur un enfant est toujours violente et toujours faite sous la contrainte. Il faut sortir de cette notion de contrainte", affirme-t-elle. Selon elle, si on parvient à sortir de cette notion, "on pose enfin l’interdit". "C’est un interdit absolument pas négociable", lâche-t-elle. Le 15 mars dernier, l’Assemblée nationale a voté en première lecture un texte renforçant la protection des mineurs. L’âge de consentement a été fixé à 15 ans pour tout acte sexuel commis par un majeur sur un mineur. "Je pense que c’est un véritable pas en avant. On a trouvé une solution juridique. Le vrai problème c’est 'est-ce que la justice va pouvoir faire face à cet afflux de procédures qui arrivent déjà dans les cabinets d’avocats ?'", s’interroge Marie-Pierre Porchy, assurant qu’en France, il y a deux fois moins de juges qu’en Allemagne. Faire évoluer les mentalités "Il faut véritablement que la loi vienne structurer nos mentalités et change nos comportements privés", assure l’ancienne juge, qui estime que les problématiques soulevées dans son livre "Les Silences de la loi" paru en 2003 sont toujours d’actualité.  Sur le modèle de la commission indépendante sur les abus sexuels dans l'Église (CIASE), une commission sur l’inceste est lancée en France. "La CIASE a fait un travail extraordinaire en écoutant les victimes. Surtout le nécessaire travail de dénombrer les victimes. L‘inceste c’est très différent. Si on veut entendre les victimes il faut être prêt à écouter des milliers de victimes. C’est quasiment mission impossible", commente Marie-Pierre Porchy.  Selon elle, "il faut se demander pourquoi les parquets classent sans suite autant d’affaires. Je pense qu’il faudrait orienter sans doute les tribunaux vers l’instauration de la justice réparative très efficace et développée dans les pays anglo-saxons. Je pense que si on en reste là, la justice ne va pas beaucoup évoluer".

L'ancienne juge des enfants et juge d'instruction revient sur la loi autour du crime d'inceste, qui évolue peu à peu en France.
