Mr. Jacques-Taylor and a co-accused were jointly charged with firearms offences. On July 6, 2022, each co-accused's defence counsel, Crown counsel, and a trial coordinator appeared in court to set a trial date. Mr. Jacques-Taylor's counsel was available for the first available court date of August 8, 2022 or for any date in August but was not available in September. Crown counsel was available for the first available court date of August 8, 2022. Counsel for Mr. Jacques-Taylor's co-accused was not available for any date in August. Counsel agreed on trial dates from October 2 to 4, 2022. Time from laying of charges to the anticipated start of trial was 22 months and 2 weeks. Mr. Jacques-Taylor filed a motion to stay the proceedings against him for unreasonable delay in breach of his right to be tried within a reasonable time guaranteed by s. 11 (b) of the Charter of Rights and Freedoms. The motions judge, after attributing delay, calculated net delay to be 2 weeks over the 18-month presumptive ceiling. The motions judge declined to attribute 25 days of the delay following the appearance to schedule trial dates that were caused only by the unavailability of counsel for the co-accused as defence delay. We dive into a BC sexual assault case where the trial judge's heavy-handed interventions—pages of pointed questioning, steering how evidence was led, and relying on answers personally elicited—pushed the process past what a reasonable observer would call fair. The conviction didn't fall because of proven bias, but because the appearance of fairness matters just as much as the verdict, and the court ordered a new trial to reset the game.From that courtroom moment, we zoom out to a piece of Canadian legal history that still shapes modern practice: private prosecutions. Yes, “anyone” can lay an information, but today the pathway runs through built-in safeguards—judicial screening, notice to Crown Counsel, and the power for Crown to take over and stay proceedings. We explain when that discretion is virtually unreviewable, and when it crosses into abuse of process due to bad faith, improper purpose, or actions that undermine the integrity of the justice system. At her death, Elizabeth I had reigned for 44 turbulent years, facing many threats, whether external from Spain or internal from her cousin Mary, Queen of Scots. But no danger was greater than the uncertainty over who would succeed her, which only intensified as her reign lengthened. Her unwillingness to marry or name a successor gave rise to fierce rivalry between blood claimants to the throne—Mary and her son, James VI of Scotland, Arbella Stuart, Lady Katherine Grey, Henry Hastings, and more—which threatened to destabilize the monarchy. As acclaimed Tudor historian Dr. Tracy Borman reveals in The Stolen Crown: Treachery, Deceit, and the Death of the Tudor Dynasty (Grove Atlantic, 2025), according to Elizabeth's earliest biographer, William Camden, in his history of her reign, on her deathbed the queen indicated James was her chosen heir, and indeed he did become king soon after she died.
