The DEA has recently confirmed that it believes delta-8 THC synthesized from CBD is federally illegal. This is based on a 2021 letter from DEA's Drug & Chemical Evaluation Section Chief Terrence Boos. Boos states, “Arriving at delta-8-THC by a chemical reaction starting from CBD makes the delta-8-THC synthetic and therefore, not exempted by the Agriculture Improvement Act. Any quantity of delta-8-THC obtained by chemical means is a controlled substance.” Hemp itself is considered a legal agricultural product under the 2018 Farm Bill. The DEA's position is based on the Controlled Substances Act (CSA), which defines a "synthetic drug" as "a drug that is not naturally occurring and that is chemically made." The DEA argues that delta-8 THC is not naturally occurring in hemp, and that it is therefore a synthetic drug. The DEA's position is controversial, and there is some legal debate about whether it is correct. However, the DEA has the authority to enforce the CSA, and it is likely that they will continue to pursue cases against businesses that sell delta-8 THC synthesized from CBD.

Kellie Adesina serves as Director of Government Affairs at Bayer where she is responsible for crop science issues like gene editing, biotech regulation and approvals, biostimulants, oilseeds, vegetables, and food security. Prior to joining Bayer, she served as Chief Counsel on the House Agriculture Committee for Chairman Collin C. Peterson. In this capacity, she successfully drafted several provisions that were included in the Agriculture Improvement Act of 2018. She also provided strategic and legal counsel to the Chairman and other Democratic Members of the Committee. Before joining the House Agriculture Committee, Kellie was Senior Counselor in the Office of the General Counsel at the U.S. Department of Agriculture (USDA). In this role, she served as the chief of staff to the General Counsel and provided legal advice and services regarding the broad range of activities at USDA. Prior to USDA, Kellie was Legislative Director to Congresswoman Marcia L. Fudge of Ohio where she developed and implemented the Congresswoman's legislative agenda, as well as managed the legislative staff. She also guided the Congresswoman through the 2014 Farm Bill Conference Committee negotiations. Additionally, Kellie has worked for Congresswoman Judy Chu of California as Legislative Counsel and in various roles for Senator Robert Menendez of New Jersey, her home state. The Food and Drug Law Institute reported that The Agriculture Improvement Act of 2018 (2018 Farm Bill) marked a watershed in the regulation of cannabis in the United States. While the crop remains highly regulated, the law makes hemp production and distribution legal under federal law and establishes a framework of shared oversight by federal, state, and Indian tribe authorities. The 2018 Farm Bill permits the interstate transfer of hemp products for commercial or other purposes, and it requires compliance with a state, tribal, or U.S. Department of Agriculture (USDA) plan for hemp production. Recently the FDA held a meeting that was supposed to address critical questions regarding the federal regulation of hemp when used in products regulated by FDA, such as the use of cannabidiol (CBD) in foods and dietary supplements.

Rep. Collin Peterson, D-Minn., was one of the main architects of the Agriculture Improvement Act of 2018 as he served as the ranking member of the House Agriculture Committee. In a statement Wednesday afternoon, Peterson pointed out improvements for dairy farmers and permanent funding for Local Food & Farmers Market Promotion Program, Value-Added Producer Grants, the BFRDP Program, Organic Research and the Section 2501 Outreach Program. "As I said in my floor speech, rural America is facing so many challenges and this bill goes a long way toward providing needed certainty to farmers and ranchers," Peterson said. "I encourage President Trump to sign the farm bill into law quickly."
