Recently, the former New Jersey Senator Bob Menendez was sentenced to eleven years in prison for accepting bribes in cash and gold worth more than half a million dollars. He is the first person sentenced to prison for crimes committed in the Senate in more than forty years. Menendez did favors for the government of Egypt while he was the senior Democrat on the Foreign Relations Committee, and intervened in criminal cases against the businessmen who were bribing him. In New York, he broke down in tears before  a federal judge, pleading for leniency. Upon emerging from the courtroom, he made a thinly veiled plea to the man he had once voted to impeach. “President Trump is right,” Menendez declared to news cameras. “This process is political, and it's corrupted to the core. I hope President Trump cleans up the cesspool and restores the integrity to the system.”  WNYC's New Jersey reporter Nancy Solomon explores how the son of working-class immigrants from Cuba scaled the heights of American politics, and then fell dramatically. But will he serve the time? Solomon speaks with the constitutional-law professor Ciara Torres-Spelliscy, who says, “It's hard to know who Trump will pardon next. One of the more recent pardons was for the former governor of Illinois, Rod Blagojevich. He was a Democrat. . . .  [Trump] seems much more  interested in undermining anti-corruption laws left, right, and center.”

This Day in Legal History: Guiteau Stands Trial for AssassinationOn November 14, 1881, Charles Guiteau stood trial for assassinating President James A. Garfield. Garfield had been shot by Guiteau in July of that year but succumbed to his injuries months later, largely due to medical mismanagement. At the time, sterilization practices were not widely understood or practiced, and Garfield's doctors repeatedly probed his wound with unwashed instruments and hands, leading to a fatal infection. Despite the role of inadequate medical care, Guiteau was held fully responsible for the president's death, setting a notable precedent in criminal law.Guiteau's defense centered on claims of insanity, arguing that he believed he was acting on divine command to remove Garfield. His erratic behavior in court, which included singing, reciting poetry, and accusing his defense attorneys of incompetence, underscored his unstable mental state. However, nineteenth-century legal standards for insanity were narrow and rarely accepted by courts. The prosecution argued that Guiteau understood the wrongfulness of his act, and he was ultimately found guilty and sentenced to death. The case spotlighted serious deficiencies in the legal system's treatment of mental illness and brought attention to the need for clearer guidelines on the insanity defense. It also ignited a broader conversation on the role of medical practices in causation, as some questioned whether Guiteau could be solely responsible for Garfield's death. Guiteau's trial and conviction marked one of the first high-profile uses of the insanity defense in the United States and influenced subsequent legal reforms regarding both mental health assessments and standards of criminal responsibility.President-elect Donald Trump has named Matt Gaetz, a firebrand Republican congressman with a face that might terrify even the devil himself, as his nominee for attorney general. Gaetz, who has previously faced scrutiny from the Justice Department over sex trafficking allegations, will replace current leadership to help Trump “end Weaponized Government” and enact an aggressive conservative agenda. Gaetz, who resigned from Congress immediately, is known for his unconventional political moves, including his role in ousting former House Speaker Kevin McCarthy, and for his call to dismantle federal agencies like the FBI. His appointment has already triggered controversy, with Senate Republicans like Lisa Murkowski expressing skepticism about his qualifications and intentions. Gaetz's background has raised security clearance concerns, given the history of investigations into his conduct. The nomination aligns with Trump's stated intentions to reshape the Justice Department, positioning the attorney general as crucial to plans for mass deportations, pardons of January 6 rioters, and prosecutorial retribution. Gaetz's legal experience consists mainly of work at a Florida law firm before he entered politics, though he has recently championed populist stances on antitrust enforcement, supporting the Federal Trade Commission's fight against noncompete clauses and cheering the Justice Department's antitrust case against Google. Gaetz's nomination fuels concern among former Justice Department officials, who fear that he could further politicize an institution traditionally independent from White House influence.Trump taps firebrand congressman Matt Gaetz for attorney general | ReutersIn the corruption trial of former U.S. Senator Robert Menendez, prosecutors revealed that jurors were mistakenly shown unredacted evidence during deliberations. However, they argued this error does not warrant overturning the conviction, asserting that the evidence against Menendez was overwhelming. Menendez, a former New Jersey senator, was convicted in August of corruption charges that included accepting bribes like gold bars and cash, allegedly in exchange for political favors. He has maintained his innocence and plans to appeal. The Manhattan U.S. Attorney's Office indicated that both the defense and prosecution missed the unredacted material during trial, emphasizing that it likely did not affect the jury's guilty verdict on all 16 counts, including wire fraud, obstruction of justice, and illegal foreign agency activities. Menendez, once a senior figure in the Senate as the chair of the foreign relations committee, now faces sentencing in January with a potential for decades in prison.Bob Menendez jury was mistakenly shown improper evidence, prosecutors say | ReutersGary Wang, former chief technology officer of FTX, is assisting federal prosecutors by developing software to detect fraud in both stock and cryptocurrency markets. Wang, who previously wrote the code allowing ex-FTX CEO Sam Bankman-Fried to siphon billions from FTX customers, has been cooperating with the government since FTX's collapse. Prosecutors are asking for leniency in Wang's upcoming sentencing, highlighting his proactive efforts to prevent similar crimes. His new tool, details of which remain confidential to protect its effectiveness, is valued by prosecutors for its potential in identifying financial crimes. This cooperation follows Bankman-Fried's recent 25-year prison sentence for fraud and misuse of $8 billion in customer funds, while other former FTX associates, like Caroline Ellison and Nishad Singh, received lighter sentences due to their cooperation. Wang, the last of Bankman-Fried's close associates awaiting sentencing, was instrumental in exposing the scheme by testifying that Bankman-Fried directed him to alter FTX's code to grant Alameda Research unauthorized access to customer funds.Bankman-Fried lieutenant builds fraud detection tool for prosecutors | ReutersA federal appeals court has struck down a New York law that heavily restricted antiques dealers from selling or displaying ivory and rhinoceros horn items, ruling it unconstitutional. The 2nd U.S. Circuit Court of Appeals found that the law, which limited ivory content in antiques to less than 20%, overstepped by restricting dealers' First Amendment commercial speech rights. Judges argued that the law prevented dealers from communicating important details about legally marketable items, deeming this an excessive speech restriction. While federal law already restricts ivory sales under the Endangered Species Act, it allows for goods with up to 50% ivory, whereas New York's stricter limit of 20% was intended to curb poaching of endangered species. However, the court ruled that New York's law also blocked the sale of items permitted in interstate and international trade, making it too broad. The decision was a setback for animal rights groups that supported the law to protect vulnerable wildlife, although the Humane Society noted that New York could still enforce the law against local buyers.New York ivory ban for antiques dealers voided by US appeals court | ReutersLaw firm revenue surged nearly 12% in the first three quarters of the year, driven by increased demand for legal services and higher productivity, according to Citi's law firm banking group. The top 50 law firms saw especially notable gains, with revenues up 14%, demand growth at 3.6%, and productivity rising by 2.9%. Gretta Rusanow from Citi's Law Firm Group highlighted 2023 as potentially one of the strongest years for the industry, citing steady demand momentum quarter by quarter. Industry-wide demand rose by 3.2%, with lawyer productivity improving as headcount growth slowed to 1.3%, returning to historical norms. Expense growth was 7.5%, with overhead costs increasing by 8.2% and compensation expenses by 6.7%. Legal services demand spanned diverse practice areas, notably in litigation, regulatory issues, investment management, and bankruptcy. Although transactional demand has been quiet, Rusanow anticipates a rebound in mergers and acquisitions activity. Law firms also invested in technology upgrades, including new practice management tools and generative AI, which contributed to higher expenses. Law Firm Revenue Soars 12% as Lawyers Get Back to Being Busy This is a public episode. DNC Chairman Jamie Harrison has said that he believes the party will virtually select their nominee by August 7th—though, the process could be completed as soon as August 1st. 6:15pm- Bob Menendez to Resign from U.S. Senate: Nicholas Fandos and Tracey Tully of The New York Times write: “Senator Robert Menendez of New Jersey announced on Tuesday that he would resign from Congress effective in late August, bowing to intense pressure from Democratic colleagues who had pushed him to step down after his conviction in a vast international bribery scheme or face an expulsion vote. Mr. Menendez has maintained his innocence and vowed to appeal a guilty verdict returned last week by a federal jury in Manhattan. But with his own party fast-tracking a vote to expel him, he chose to spare his party an ugly fight and avoid becoming the first senator ousted since the Civil War by quitting with months to go in his term.” You can read the full article here: https://www.nytimes.com/2024/07/23/nyregion/senator-bob-menendez-resignation.html 6:40pm- According to reports, Kamala Harris and the DNC raised more than $100 million in campaign donations since Joe Biden dropped out of the race. 6:45pm- The sub-headline of a recent piece courtesy of The New York Times reads: “Voters eager to elect the first female president pointed to anger over a loss of abortion rights, but also acknowledged a fear that sexism would remain difficult for Ms. [Kamala] Harris to overcome.” Rich notes that the attack angle Democrats and the media will gravitate towards in the 2024 presidential race is simply calling opponents of Harris sexist or racist. And while it has been my intention to seek reelection, I believe it is in the best interest of my party and the country for me to stand down and to focus solely on fulfilling my duties as President for the remainder of my term.” Later Biden posted once more from his X account, endorsing his Vice President Kamala Harris as his successor: “My very first decision as the party nominee in 2020 was to pick Kamala Harris as my Vice President. And it's been the best decision I've made. Today I want to offer my full support and endorsement for Kamala to be the nominee of our party this year. During the 2020 campaign, Biden aides recall watching Harris interrogate her then-chief of staff Karine Jean-Pierre to the point that it made others uncomfortable.” In another bizarre instance, Thompson documents that “Harris has been cautious and reluctant to participate in events that weren't tightly controlled, Harris and Biden aides said… In April 2022, Harris was the guest for a dinner at D.C. news mogul David Bradley's home—a salon-style event Bradley hosts with Washington journalists and newsmakers. Harris' anxiety about the dinner was such that her staff held a mock dinner beforehand, with staffers playing participants, according to two people familiar with the event. Last night, Republican presidential nominee Donald Trump made his first public appearance since the assassination attempt against him in Butler, Pennsylvania. 3:10pm- Bob Menendez Convicted: Nicholas Fandos, Tracey Tully, and Benjamin Weiser of The New York Times write: “Senator Robert Menendez of New Jersey was convicted on all counts in a sweeping scheme to sell his office to foreign powers and crooked businessmen in exchange for hundreds of thousands of dollars in cash, a luxury car and bars of solid gold. Collier Landry and guest Dr. Roger Rhoades discuss the epidemic rise of the intergenerational trauma excuse being used to mask criminal narcissism. Sighting the recent case of Senator Robert Menendez, a New Jersey Democrat charged with accepting bribes, including cash, gold bars, and a Mercedes-Benz, in exchange for political favors to foreign governments. Sen. Menendez's attorneys revealed they planned to call a New York psychiatrist to testify that the senator's “intergenerational trauma” created an undisclosed mental health disorder that caused him to store his riches at home. The Rich Zeoli Show- Full Episode (04/17/2024): 3:05pm- On Tuesday, Congressman Thomas Massie (R-KY) requested that Speaker of the House Mike Johnson (R-LA) resign—after Speaker Johnson announced he plans to hold a vote on Ukraine aid funding later this week. Massie joins Rep. Marjorie Taylor Greene (R-GA) as Republican members of Congress now vocally opposed to Johnson remaining in power. Working with a slim Republican majority in the House (218-213 with 4 vacancies), is Johnson now in serious jeopardy of being removed as Speaker? On Wednesday, Sen. Rand Paul (R-KY) said “Republicans need real leadership” and seemed to suggest Johnson should be replaced in favor of someone who is more fiscally responsible. 3:20pm- Annie Karni of The New York Times writes: “Speaker Mike Johnson's elaborate plan for pushing aid to Ukraine through the House over his own party's objections relies on an unusual strategy: He is counting on House Democrats and their leader, Representative Hakeem Jeffries of New York, to provide the votes necessary to clear the way for it to come to the floor.” You can read the full article here: https://www.nytimes.com/2024/04/17/us/politics/johnson-democrats-ukraine-aid-plan.html 3:30pm- The Wall Street Journal writes: “Seven jurors for Donald Trump's hush-money case were selected quickly Tuesday afternoon after a sluggish start, a pace that could clear the way for trial testimony to begin next week. Three women and four men have been chosen so far for a jury that will be the first ever to decide criminal charges against a former president. The jurors, all Manhattan residents, include a charter-school teacher, a software engineer, a salesman, a corporate lawyer and an oncology nurse.” You can read the full report from Corinne Ramey, James Fanelli, and Alex Leary here: https://www.wsj.com/us-news/law/jury-for-donald-trumps-hush-money-trial-takes-shape-an-oncology-nurse-a-software-engineer-a-teacher-5a65e772?mod=hp_lead_pos4 3:40pm- While speaking with Wolf Blitzer on CNN, former federal prosecutor Ankush Khardori expressed concern about the anonymity and safety of the jurors serving on the Trump “hush money” trial. Khardori explained: “Now, this is not the fault of the media…Responsibility to guard all of the very specific information that we're learning [about the jury] resides with the D.A.'s office and with the judge. I'm a little surprised that we are learning all of this because I do not think this jury is going to remain anonymous, necessarily, if they keep this up.” 4:05pm- An arrest warrant has been issued for Pennsylvania State Representative Kevin Boyle (D) after he allegedly violated a protection order by contacting his estranged wife. Earlier this year, a video of Boyle went viral when he drunkenly berated workers at a Pennsylvania bar. In the video he continually threatens to have the bar closed and asks, “do you know who I am?” 4:20pm- Following his Tuesday court appearance, Republican presidential candidate Donald Trump stopped at a New York City bodega and spoke with supporters. 4:40pm- On Wednesday, the Senate concluded its impeachment trial of Department of Homeland Security Secretary Alejandro Mayorkas—dismissing the charges. The House voted in favor of impeaching Mayorkas earlier this year. From the floor of the Senate, Sen. Mike Lee argued that the chamber's Democratic leadership did not take the proceedings seriously. 5:00pm- Benjamin Wesier and Tracey Tully of The New York Times write: “Senator Robert Menendez may blame his wife, Nadine Menendez, for the bribery charges the couple is facing by claiming that she hid information from him and led him to believe that ‘nothing unlawful was taking place,' according to court papers unsealed on Tuesday…The senator and his wife are accused of accepting cash, gold and a luxury car in exchange for Mr. Menendez's willingness to use his political influence to help allies in New Jersey and to aid the governments of Egypt and Qatar. It's a hat trick for Sen. Robert Menendez: his superseding indictment has been superseded once again, this time with charges that he and his wife obstructed justice, including by directing their lawyers to lie to the government about a Mercedes C-300 convertible she received as a bribe. Ken says this sort of thing — lying so your lawyer will lie for you — is not a good idea, but just because it's a bad idea doesn't mean it doesn't happen...a lot. Plus: Trump posted a bond of nearly $92 million in the second case E. Jean Carroll won against him. The bond is good news for Carroll — it means she'll get paid, sooner or later, and without the need to chase Trump through the courts hunting for his assets. But Trump still faces a looming deadline to post a much larger bond in the New York Attorney General's case, and if he is unable to (or chooses not to) we'll still see what it looks like to pursue him with debtor's exams and liens and the like. The Rich Zeoli Show- Full Episode (02/14/2024): 3:05pm- On Tuesday, a special election was held in New York's 3rd District to fill former U.S. Representative George Santos' vacant Congressional seat. Democrat Tom Suozzi defeated Republican candidate Mazi Pilip 54% to 46%. Nate Cohn of The New York Times writes: “Millions were spent on campaign advertisements, with Democrats outspending Republicans by a wide margin. And unlike with most special elections, Democrats nominated a fairly well-known candidate. Mr. Suozzi, who retired ahead of the 2022 election, had a strong electoral track record, having beaten Mr. Santos here by more than 12 points in 2020… There was even a big snowstorm on Tuesday that may have dampened Republican Election Day turnout (Democrats voted more by mail).” Could this special election be indicative of what will happen during the 2024 presidential election? Cohn continues: “Last week, a Siena College poll…found Mr. Biden running a full nine percentage points behind Mr. Suozzi and trailing Donald J. Trump in the district.” Last year, Santos became the sixth congressman in U.S. history to be expelled from the House of Representatives. The House voted 311 to 114 in favor of removing him following numerous allegations of lying about his background and a 23-count indictment that includes allegations he “repeatedly, without authorization” charged donor credit cards—depositing funds into his own bank account. Though, he has not yet been found guilty of any crimes. The Republican majority in the House will shrink—219 to 213 with 3 vacancies. You can read Cohn's article here: https://www.nytimes.com/2024/02/14/upshot/special-election-democrats-new-york.html 3:20pm- Tracey Tully and Benjamin Weiser of The New York Times write: “A luxury Mercedes-Benz, gold bars, exercise equipment and stacks of cash featured prominently in a federal indictment that charged Senator Robert Menendez with accepting a sordid array of bribes. Now, prosecutors say a diamond engagement ring for the senator's future wife, Nadine Menendez, was also part of the elaborate bribery scheme — and a source of infighting between co-defendants who are expected to stand trial together in May. Wael Hana, a longtime friend of Ms. Menendez's who is also charged in the alleged conspiracy, attempted to cheat her out of the full value of the ring, according to court documents filed late Monday by prosecutors in Manhattan.” You can read the full article here: https://www.nytimes.com/2024/02/13/nyregion/menendez-bribes-ring.html 3:35pm- Karoun Demirjian of The New York Times writes: “The Senate passed a long-awaited foreign aid package for Ukraine and Israel early Tuesday morning, delivering a bipartisan endorsement of the legislation after months of negotiations, dire battlefield warnings and political mudslinging. But the measure faced a buzz saw of opposition in the House, where Republican resistance threatened to kill it. The 70-to-29 vote reflected a critical mass of support in Congress for the $95 billion emergency aid legislation and for continuing to arm Ukraine in its fight against Russian aggression. The measure would provide an additional $60.1 billion for Kyiv—which would bring the total U.S. investment in the war effort to more than $170 billion—as well as $14.1 billion for Israel's war against Hamas and almost $10 billion for humanitarian aid for civilians in conflict zones, including Palestinians in Gaza.” But will Speaker of the House Mike Johnson hold a vote on the bill in the Republican-controlled House? Demirkian explains: “Mr. Johnson controls the floor and right-wing lawmakers have shown a willingness to block legislation they oppose from even coming up for a vote. Still, if proponents can muster enough support from Democrats and mainstream and national security-minded Republicans willing to buck [Donald] Trump and the far right, they could steer around the opposition through a maneuver known as a discharge petition. That allows lawmakers to force legislation to the floor if they can gather the signatures of a majority of the House—218 members—calling for the action.” You can read the full article here: https://www.nytimes.com/2024/02/12/us/politics/senate-ukraine-aid.html 3:40pm- Lee Habeeb— Newsweek Columnist & Vice President of Content at Salem Media Group—joins The Rich Zeoli Show to discuss his latest article, “The Forgotten Man: A 1883 Speech Might Explain the Rise of Trump.” You can read the full article here: https://www.newsweek.com/forgotten-man-1883-speech-might-explain-rise-trump-1867929 4:05pm- During a White House press briefing on Wednesday, National Security Advisor Jake Sullivan answered questions about Congressional renewal of the Foreign Intelligence Surveillance Act (FISA). When asked if a warrant should be necessary for all collected data, Sullivan explained, “we do not believe that that serves the national security interests of the U.S.” 4:10pm- Mairead Elordi of The Daily Wire writes: “A trans-identifying firefighter is suing the city of Philadelphia for allegedly refusing insurance coverage for his facial feminization surgery. The firefighter, a 55-year-old man who has been with the Philadelphia fire department for 28 years, claims that the city, as well as his union, Firefighters & Paramedics Local 22, and Independence Blue Cross insurance all discriminated against him on the basis of his gender identity.” You can read the full article here: https://www.dailywire.com/news/trans-identifying-firefighter-suing-philadelphia-over-facial-feminization-surgery-coverage 4:20pm- Former NCAA leader Rachel Dolezal, who was fired from the organization after it was revealed she received the position after pretending to be black, now has an OnlyFans account. 4:30pm- Casey Mattox—Vice President of Legal & Judicial Strategy at Americans for Prosperity—joins The Rich Zeoli Show to discuss his latest article for The New York Post, “Why Our Politicians Can't Stop Passing Absurd Laws.” Some of the nation's most bizarre laws include an Arizona law which makes it illegal for donkeys to sleep in bathtubs, a ban on silly-string in Alabama, and a Connecticut regulation on the bounciness of pickles. In her 34-page decision, Secretary Bellows accuses Trump of engaging in insurrection and, consequently, determines he is ineligible to hold office under the Fourteenth Amendment. Interestingly, despite calls from the Lieutenant Governor to “explore every legal option” to remove Trump from the ballot, California Secretary of State Shirley Weber said the former president would remain on the state's primary ballot. 3:20pm- While appearing on CNN, David Axelrod—former Senior Advisor to President Barack Obama—said “I do think it would rip the county apart if [Trump] were prevented from running because tens-of-millions of people want to vote for him.” 3:25pm- A new USA Today/Suffolk University poll indicates that Republican presidential candidate Donald Trump currently has greater support within the Hispanic American community than does President Joe Biden—39% to 34%. New York City, which previously declared itself a “sanctuary city,” guarantees free housing to migrants. 4:05pm- Claudine Gay has resigned as President of Harvard University—making her the shortest tenured president in the school's nearly 400-hundred-year history. Last month, Gay testified before the House Education and Workforce Committee. During one noteworthy exchange with Rep. Gay also faces dozens of credible plagiarism allegations. 4:15pm- In a recently surfaced video, former Director of the National Institutes of Health Dr. Francis Collins conceded that the federal government made mistakes with its public health response to the COVID-19 pandemic. He explains, “if you're a public health person…you attach zero value to whether this actually totally disrupts people's lives, ruins the economy.” In November of 2021, Dr. Collins, who is now serving as an advisor to President Joe Biden, infamously performed “Somewhere Past the Pandemic”—an original song to the tune of “Somewhere Over the Rainbow.” Rich, Matt, and Henry will find any excuse to play it. 4:35pm- On Monday, Rich appeared on Fox News to preview the 2024 presidential election. Legal group Empower Oversight released the five court orders Monday after filing a Freedom of Information Act (FOIA) request for the records related to the DOJ's previously unknown attempts to monitor the communications of staffers conducting oversight of the department.” You can read the full article here: https://dailycaller.com/2023/12/04/doj-blocked-google-informing-congressional-staffers-spied-court-orders/ 3:20pm- During Tuesday's Senate Judiciary Committee hearing, Senator John Kennedy (R-LA) asked FBI Director Christopher Wray which FBI official made the decision to raid Mar-a-Lago, the home of former President Donald Trump, and retrieve classified documents. Robert Menendez's home had been directly linked to a New Jersey businessman now accused of bribing the state's senior senator, Bergen County prosecutor records from a 2013 robbery case show. The businessman, Fred Daibes, reported to police he was the victim of an armed robbery in 2013, and he asked police to recover the gold bars stolen from him. In the 2013 robbery, Daibes reported $500,000 in cash and 22 gold bars were stolen, Edgewater police records show. Police later caught four suspects with the stolen goods.” You can read the full report from Jonathan Dienst, Courtney Copenhagen, and Tom Winter here: https://www.nbcnewyork.com/investigations/gold-bars-featured-in-bob-menendez-bribe-case-linked-to-2013-robbery-records-show/4919801/ 4:20pm- In a new advertisement, Congresswoman Sheila Jackson Lee (D-TX)—who is now running for Mayor of Houston—accidentally provides her supporters with the wrong election date!
