Clay Jenkinson's conversation with regular guest Dr. Lindsay Chervinsky about the doctrine of nullification. That's when a state refuses to accept the legitimacy of a federal law. Nullification is nowhere enshrined in the U.S. Constitution, but through the course of American history a number of nullification crises have arisen. When the Adams administration passed the Alien and Sedition laws of 1798 Jefferson wrote a set of secret resolutions for the state of Kentucky resisting those laws, which Jefferson said were worthy of the ninth or tenth century. John C. Calhoun attempted nullification for South Carolina and other southern states in the 1830s, mostly over tariffs, and now again a number of states, led by Texas, are threatening to nullify federal laws they hate--or even to secede if necessary. Dr. Chervinsky has a hilarious response to the idea of Texas or Louisiana secessions.

In the recent past, we have seen a couple of more statues removed. First Thomas Jefferson was hauled out of the New York Capitol. Back in 2020, in Charleston (SC), a figure of John C. Calhoun, like Jefferson, a former Vice President of the United States was taken away. Then Jackie Robinson was stolen from a ball park in Kansas – albeit probably not for the same reasons. Now, the reason that we are given for this is, of course, that they were white, patriarchal, cisgendered, slave owning racists. Which, was true. Although in fairness they would have no idea what “cisgendered” means or that anything else existed. In the bigger picture, why would any statue be removed? If you consider it clearly, the answer cannot be that it is because they were white, patriarchal, cisgendered, slave owning racists. Why not? Because is not… logical. So what are we left with? In Communist West Taiwan, Imperious Leader Xi has pushed for an educational program that venerates the traditions of Chinese history and culture. Historically Thinking: Conversations about historical knowledge and how we achieve it

It's no secret that historians love to create periods and errors, and then physically argue about them. We love to talk about the long 18th century, the short 18th century, the long 19th century, the short 19th century, the short 20th century — and God knows what will say about the 21st, but we will have something to say about it, of that you can be sure. But often by breaking things into discrete periods such as antebellum, Civil War, and reconstruction, we miss commonalities between periods of time that amount, from the perspective of a medieval or classical historian or anyone focused on the longer duration, to just a few decades. Paul Escott's new book The Civil War Political Tradition: Ten Portraits of Those That Formed It likewise refuses to divide things into neat and discrete boxes. Rather it profiles very different people who nevertheless all endorsed or rebelled against a political tradition that emphasized individual ambition, short-term thinking, compromise, and a pragmatic approach to problems—a tradition that did not, however, have the necessary power to resolve the crisis over slavery and race. Paul D. Escott is the Reynolds Professor of History Emeritus at Wake Forest University. He was last on the podcast in Episode 294. Historically Thinking: Conversations about historical knowledge and how we achieve it

William Hunter was a radical advocate for American democracy. Born in New Brunswick, New Jersey, he was the founder of the second newspaper west of the Alleghenies, and the first newspaper editor to protest the Alien and Sedition Acts. Arguably a Jacksonian Democrat before Andrew Jackson first ran for president, Hunter served the Jackson Administration, and as a civil servant seven successive administrations. Yet that brief biography obscures his very interesting origins. For William Hunter had been born in New Brunswick, yes, but as the son of John Hunter of the 26th Regiment of the Line. For the first ten years of his life William followed his father as his peacetime service in British America became combat service in the rebellious territory of the new United States. Departing for Britain at age ten in 1778 when his sick father was detached for recruiting duties, William returned to the United States fifteen years later, his father dead, his mother and sister left behind. He was now a committed republican, arriving in Philadelphia in the midst of the yellow fever epidemic of 1793. He would never again travel back across the ocean, or see his mother and again. Gene Procknow describes the ups and downs, and twist and turns of William Hunter's eventful life in his new book William Hunter Finding Free Speech: A British Soldier's Son Who Became an Early American. Formerly a management consultant with a global consulting firm, Gene Procknow has become a careful historian of early American history; William Hunter is his first book. White supremacist groups are apparently recruiting hispanics & blacks to their cause now, since any crime is now blamed on whites - Brian Levin of Cal State calls it Hispanic white supremacy; this demonstrates how such labels are defenses against opposition to Democrat policies and are a bigger joke that Dave Chappelle's ‘black white supremacist Clayton Bigsby. In a racist screed worthy of John C. Calhoun, a real black-white-supremacist Democrat, Congressman Hank Johnson of Georgia, said earlier this week that immigrants are inherently waiters and construction workers, and that we need them to bring us food and clean up our hospitals. As Title 42 ended on Thursday, it's business as usual at the southern US-border. Decent people mixed with human smugglers, drug cartels, terrorists, Chinese nationals, etc. Children kidnapped and drugged and women from South America in particular are raped up to 8/10 (https://www.hhri.org/publication/i-didnt-have-anywhere-to-run-migrant-women-are-facing-a-rape-epidemic/). Hundreds of thousands waited to pour across the border on Thursay as a Federal Judge in Florida put a stop to the ‘parole' plan of the White House, which continues to violate Article 4, Section 4 of the U.S. Constitution, ensuring states protection from “invasion.” A few word redefinitions fixes that problem though.According to the IOM on United Nations Migration, the “highest ever reported” number of displacements and movements occurred around the world in 2022 - 61 million. (https://www.iom.int/news/record-number-609-million-internal-displacements-2022-idmc-report) This record number coincides with the United Nations assessment from 2000 called “Replacement Migration.” That report outlined how population decline and population aging were leading to drops in overall population numbers from the US to Italy to Japan. By 2050 it is excepted these countries lose tens of millions in domestic population. The UN reports that in the “absence of migration, the declines in population size will be even greater than those projected…” Thus, “the levels of migration needed to offset population aging are extremely large, and in all cases entail vastly more immigration than occurred in the past.” (https://www.un.org/development/desa/pd/sites/www.un.org.development.desa.pd/files/unpd-egm_200010_un_2001_replacementmigration.pdf) Such mass migrations are akin to the forced migrations of Mao; just like his environmental polices destroyed the land and water, and his idea of equality meant equal poverty. * It Can Happen Here, The Mormon Trail of Tears. - Few people know the extraordinary persecutions that the early members of the Church of Jesus Christ of Latter-Day Saints had to endure in the City of Navoo, Illinois in 1844-1846. * A letter to the Church leadership reveals Governor Thomas Ford's true character. * Alexander Doniphan: Courageous Defender & Friend of the Mormon Saints! * President Van Buren's reply: ‘Gentlemen, your cause is just but I can do nothing for you;' and the cold unfeeling manner in which he was treated by most of the senators and representatives in relation to the subject, [Henry] Clay saying, ‘You had better go to Oregon,” and [John C.]Calhoun shaking his head solemnly, saying, “It's a nice question – a critical question; but it will not do to agitate it.' * Eventually, the latter-day-saints were driven out of the United States of America and settled in Mexico (what is today Utah). Though they were hunted like rabbits, had their property destroyed, and were denied their Constitutional rights, they did avoid the abomination of desolation that always results when a nation turns its back on God, and persecute His saints. * On June 25, 1976, Governor Kit Bond issued an executive order rescinding the Extermination Order, recognizing its legal invalidity and formally apologizing on behalf of the State of Missouri for the suffering it had caused the Mormons. * Nations are not punished in the afterlife, they eventually meet their fate in this present mortal sphere. The Civil War, the War of Northern Aggression was the punishment on this nation that turned its back on the members of the Church of Jesus Christ of Latter-Day-Saints. * 618,222 men and women died during the War of Northern Aggression. Eventually, the scales of justice come back into balance. * Today we find ourselves in a similar situation; the scales of justice are in a serious state of imbalance. When they will be set back into balance, I cannot tell you, but that they will be set back into balance is beyond doubt. * What side of the ledger we will find ourselves on is entirely up to us as individuals. I, as Uncle Ted Nugent is fond of saying, would hope to be found in the asset column. * It is our hope and prayer that we would all repent and do what we can to restore the God-ordained Constitutional foundation of this country so that we do not have to repeat history and incur the same fate that those wicked early inhabitants of this continent were condemned to suffer in both time and eternity.
