Emma hosts Karen Levy, Assistant Professor of Information Sciences at Cornell University, to discuss her recent book Data Driven: Truckers, Technology, and the New Workplace Surveillance. Emma first runs through updates on Zelesnkyy's congressional address, Senate Republicans obstructing Biden's funding bill, and Sean Hannity's admission under oath that he didn't buy much of the election-denying shenanigans on his OWN SHOW, also touching on Rep Kevin Brady's speaking out against holding powerful people to account financially. Karen Levy then joins as she dives right into the supposed “trucker shortage” that the US is facing right now, exploring why there are, in fact, many truckers available, they're just not getting paid enough to continue work in the industry, before stepping back to analyze the impact of four decades of deregulation of the industry, bringing about dropping wages, raising hours, and falling safety levels. Continuing this analysis, Professor Levy walks Emma through the precipitous decline of the role of unions and teamsters in an industry that was previously known for its labor forces, with the government still proclaiming the work as “essential” while refusing to meet the needs of the workers, from wages to infrastructure and more. Next, Emma and Karen discuss the little bit of trucking regulation that the government has actually stood behind, parsing through their surveillance requirements for digital tracking of truckers, walking through its failure to address the root issue it was supposed to address (worker safety) and how it provided an infrastructure for the corporations to ramp up their own surveillance measures, pushing biometric monitoring and predictive analytics that push their workers to abuse stimulants and push their bodies to the limits. Wrapping up, they tackle potential solutions that Professor Levy sees as possible and that actually target the issue at hand by detaching payment and protections from miles driven or hours worked. And in the Fun Half: Emma talks with Hamish from Taho on cashews and veganism, and Dr. Phill hosts an anti-teacher-union hack to discuss why public school teachers are swindling the US out of billions (that they refuse to spend on themselves)! Sam and Emma host Jonathan Levy, professor of History at the University of Chicago, to discuss his recent book Ages of American Capitalism: A History of the United States. Sam and Emma begin by discussing the newly passed defense policy bill and debt limit increase in the House, which includes a huge weapons sale to Saudi Arabia, something the strange bedfellows of Rand Paul and Bernie Sanders completely agree is a complete slap in the face to the suffering Yemeni people. Then they dive in with Professor Levy about the origins of capitalism in America starting in 1660, where they define capitalism and capital itself, before diving into the question of whether exploitation is intrinsic to capitalism, as well as its relationship to labor. They then discuss the different types of liquidity, before diving into the centrality of empire, specifically the British, empire to the first stage of capitalism. Levy also expands upon how geopolitical spread was crucial to expanding capitalism in the U.S. at this time, and this happened primarily through war-making and the expansion of slavery. Sam, Emma, and Jonathan then plumb the depths of whether capitalism could exist without slavery in the U.S., or if specifically the next era of capitalism, the Industrial Revolution could without it. Jonathan then explains how crucial the Louisiana Purchase and the Haitian Revolution were to the capitalist expansion, before going into how the Industrial Revolution may have been the greatest break in civilization since that of the transition from hunter gatherers to settler colonists. He then explains how this period was defined by speculation, something that we can see manifested today in something like stock buybacks. Going into the age of control, where the New Deal propped up the idea of the male breadwinner, as well as the idea of labor rights and wage parity being the definition of citizenry rather than property ownership, Levy also characterizes the New Deal as not as progressive as some admirers may tend to believe, mostly due to its focus on private enterprise over public investment. Sam, Emma, and Jonathan end on summarizing the post-New Deal aftereffects from those private emphases that ultimately result in massive inflation and economic turmoil during the late 70's and the Carter Administration, coinciding with the "Volcker shock", leading to the short-termism, debt-focused Clinton years. Finally, they discuss the turn towards austerity in the 2010's, how Obama essentially re-made the old economic order in the wake of the 2008 crash, and how the Trump administration and COVID completely fragmented that order, leading to some truly remarkable developments like the massive strike wave we saw this fall. And in the Fun Half, the MR Crew discuss AOC calling out the Senate parliamentarian in favor of a pathway to citizenship in the BBB bill, Matt cautioning that there won't be any spring rain frolicking with Dems once the GOP takes House control with Speaker Donald J. What is free will? How should we think about it? Is it something we have? Is it even possible?   Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast, Good Law | Bad Law, is joined by Professor Ken Levy, of Louisiana State University, to discuss free will and responsibility, as well as the role of the criminal justice system.   Aaron and Ken are asking big questions about the world around us and delving deep into philosophical theories that underly our entire legal system.  Most people believe that we have both responsibility and free will, that our choices, decisions and actions are self-determined.  Ken breaks down why the majority of philosophers believe it is not so simple.  Ken and Aaron explore the metaphysical, touching on notions of determinism, metaphysical libertarianism, compatibilism, and more. Aaron and Ken address common questions about free will, discussing the concepts of God and destiny, the ideals of consequences and justice, the idea of the self, the conditions of the universe, and the laws of nature, as well as how attitudes and positions have changed over time.   What are the possibilities of free will? And furthermore, how do you reconcile those idea with that of our criminal justice system?   Dr. Levy is a professor of law at LSU, where is specializes in criminal law, criminal theory, international criminal law, white-collar law, and tort law. A student of philosophy, Dr. Levy is a graduate of Rutgers University (Ph.D.) In his new book, Free Will, Responsibility, and Crime: An Introduction, Ken presents an informed and insightful look at the intersection among metaphysics, ethics, and criminal law. A graduate of Columbia Law School, Dr. Levy continues to work primarily in criminal theory. The United States, as Alexis de Tocqueville wrote in his account of the USA, is a country where people spend most of their lives in voluntary associations. He meant clubs, community organizations, and all sorts of activities that tie us together in communities which are not imposed on us by the state. How can we balance this fundamental right of free association (anchored, in the US, in the First Amendment), and the government's obligation to protect its citizens from unjust and illegal treatment? Should the government intervene when there’s a speech controversy on campus? Or should universities be allowed to set their own rules, like other associations such as clubs, homeowner associations, or churches? Jacob Levy has written extensively about the tension between the idea that the state grants or restrict our liberties while allowing private associations to set their own rules for their members. When is the right moment for the state to interfere in a group's (a church, a baseball team, a religious sect, a school, a homeowners' association) rules? And when can a university assert its right to regulate itself without external pressure and political interference? Professor Levy has thought a lot about the tension between allowing people to associate voluntarily in groups that have their own rules, and the state's obligation to make sure no one's constitutional or human rights are infringed upon. Universities here provide a special case. People enter them voluntarily, but then do they leave their constitutional rights at the college gate? Certainly not. So I asked Professor Levy how to make sense of the relationship between associations and the state itself. Can voluntary associations deprive members of rules set otherwise guaranteed by the state? In the context of the university, can the university have speech codes or codes of conduct that are different from those in the public square? How is this different from a church, temple or mosque, which imposes religious conformity on its members while the state allows for religious freedom, and even freedom from religion? Should the state intervene if a university does not grant a political speaker an opportunity to speak, and is this different from forcing a church to host a speaker who questions or attacks that religion? Professor Levy offered a nuanced and precise definition of academic freedom, what constitutes academic speech and external commentary by faculty members, what the purpose of a university is, and how speech controversies turn exceptions into generalizations that will ultimately do more harm than good. Professor Levy is the Tomlinson Professor of Political Theory and Professor of Political Science and Philosophy at McGill University. He is the author of Rationalism, Pluralism, and Freedom, and The Multiculturalism of Fear, and writes frequently about academic freedom, freedom of speech, and other issues of political importance.
