A Cape Town Advocate has served the Speaker of Parliament with a letter of demand to remove the chairperson of suspended Public Protector Busisiwe Mkhwebane's impeachment inquiry. Advocate Winston Erasmus is demanding Speaker Nosiviwe Mapisa-Nqakula to remove Richard Dyantyi after his recusal application against him was declined. The existence of the committee follows the National Assembly's adoption of a motion to probe Mkhwebane's fitness to hold office, after several negative court findings against her. Suspended Public Protector's term of office ends on the 15th of October. Many times the work of the committee was delayed, including two recusal applications for the chairperson, Qubudile Dyantyi and court challenges against the Parliamentary process. Chairperson of the Section 194 committee inquiring about suspended Public Protector Busisiwe Mkhwebane's fitness for office, Qubudile Dyantyi will respond to Mkhwebane's latest attempt to remove him by Friday. Last week, the beleaguered Mkhwebane brought her second application for Dyantyi's recusal. The Section 194 committee is inquiring whether Mkhwebane displayed misconduct or incompetence warranting her removal from office. Mkhwebane's application has its genesis in allegations by her husband, David Skosana, that the late African National Congress (ANC) MP Tina Joemat-Pettersson solicited bribes of R200 000 each for herself, Dyantyi and ANC chief whip Pemmy Majodina. Skosana opened a complaint with the police while Mkhwebane did so with Parliament's ethics committee. Dyantyi and Majodina have publicly denied the allegations. Joemat-Pettersson died on 5 June. Her death is the subject of an inquest. After Mkhwebane, backed by the Economic Freedom Fighters (EFF), the United Democratic Movement (UDM) and the African Transformation Movement, insisted on Dyantyi's recusal at a meeting of the Section 194 committee last month, he indicated that he would consider a written recusal application, as required by the committee's directives. On 12 July, Mkhwebane filed her formal application for his recusal, compiled by her counsel, Advocate Dali Mpofu SC and his juniors, advocates Bright Shabalala and Hangwi Matlhape, a day before the Constitutional Court upheld her suspension by President Cyril Ramaphosa and dismissed her challenge to the impeachment proceedings. Mkhwebane presented seven grounds for Dyantyi's recusal: Allegations of bribery, corruption and/or extortion against the presiding officer; The chairperson is a subject of a pending investigations by Parliament's ethics committee (sic); Chairperson is a subject of a pending police investigations (sic); Disparaging media statements and interviews; Committee and/or chairperson is proceeding despite Public Protector's lack of legal representation; The role of Joemat-Pettersson as a member of the committee; and The role of Majodina as the ANC chief whip. In her application, Mkhwebane argued that it is immaterial whether actual bias from Dyantyi exists and that questioning her and her legal team's motives in bringing a recusal application is also grounds for recusal. According to a statement from Parliament, Dyantyi noted the recusal application and informed Mkhwebane's attorneys that he would respond in writing by Friday. "Mr Dyantyi indicated that he will apply his mind to the content of the application. The committee awaits the summation of evidence from the evidence leaders. The committee has noted that Advocate Mkhwebane did not indicate her intention to make a closing argument or submit a written closing statement," reads the statement. Mkhwebane has a history of accusing those attempting to hold her accountable of bias or disparaging them. In September last year, she brought another application for Dyantyi's recusal, along with an application for the recusal of DA MP Kevin Mileham. She claimed that Dyantyi had been biased against her and her legal team, and had allowed the process to be procedurally unfair. Dyantyi refused to recuse himself. "I do so in the belief that the Public Protector has failed to establish any grounds upon which it can be said that I am biased or that my conduct may give rise to an apprehension of bias," he stated on 17 October. Mkhwebane wanted Mileham to recuse himself because the motion that led to the impeachment proceedings was moved by his wife, DA MP Natasha Mazzone, in her capacity as DA chief whip at the time. Even though the motion was adopted by the National Assembly - thus becoming a motion of the National Assembly - Mkhwebane and her legal team continue to refer to it as the "Mazzone motion" and refer to Mazzone as the "complainant". Mileham, too, refused to recuse himself. Mkhwebane subsequently challenged Dyantyi's decision in court, ...

In a unanimous judgment written by Deputy Chief Justice Mandisa Maya, the Constitutional Court upheld President Cyril Ramaphosa's suspension of Public Protector Busisiwe Mkhwebane and dismissed her application to halt the Section 194 inquiry into her fitness for office on Thursday. In June 2022, two days after Mkhwebane informed him that she was investigating the Phala Phala matter, Ramaphosa suspended her. It came after letters went to and fro since March about her suspension, pending the Section 194 inquiry, which started in July. Mkhwebane applied to the Western Cape High Court to have the suspension overturned and to have the Section 194 process declared unlawful. In September, a full Bench of that court appeared unconvinced by the bulk of Mkhwebane's challenges to the impeachment process against her, but it found that "from the objective facts, the decision of [Mkhwebane] to investigate the president and to put 31 questions to him [about the break-in], prompted the president not to wait a day more and to immediately suspend her". Given that Ramaphosa was "sitting with a letter from [Mkhwebane] with a long list of questions" that he was required to answer within 14 days at the time he suspended her, the High Court found that to "suggest that such a suspension would not have any effect on delaying the course of investigation would be a difficult proposition to convincingly sustain". "Thirdly, the expansive nature of the questions that the president was required to answer in the said short space of time in respect of events that took place some two years ago may well have caused the president to conclude that 'there she goes again' in those circumstances, rather than to have to contend with [Mkhwebane], he was better off with any person but [Mkhwebane]," it stated. But the apex court didn't agree after the Democratic Alliance and Ramaphosa appealed. Mkhwebane filed a cross-appeal, which the apex court found to be meritless. Justice Maya said they found that the mere fact that Mkhwebane was investigating Ramaphosa, wasn't enough to say there was a conflict of interest when he suspended her. The suspension didn't have any benefit for him, as it did not hamper the investigation, and there was no evidence that he suspended her due to the Phala Phala investigation. "It cannot be said that the president's decision was irrational," Maya said. Furthermore, the court found Ramaphosa had "rational reasons" for the suspension, including allowing her to prepare for the impeachment proceedings. The suspension wouldn't cause her irreparable harm, it added. The court also noted that the independent panel Parliament had appointed found that there was a prima facie case for her removal, and that the court itself made "grave" findings against her in the past. Mkhwebane must pay part of the costs personally. Arguments were heard in November. Mkhwebane, and the African Transformation Movement have complained about the long wait for a judgment. Mkhwebane said the judgment would be merely academic. On 30 June, Acting Public Protector Kholeka Gcaleka released the report on Phala Phala, which cleared Ramaphosa. After several delays, Mkhwebane didn't conclude her testimony before the Section 194 inquiry and refused to answer the committee's questions, which it had to submit in writing. The committee will now only consider the evidence already before it is expected to adopt its report on 28 July. Mkhwebane's term expires on 14 October, at which time she will receive a gratuity of around R10-million.

The Executive Ethics Code is yet again in the spotlight- this time it involves the Public Protector's finding into the theft of millions of US dollars in cash from his Phala Phala game farm in Limpopo in February 2020. The Acting Public Protector advocate Kholeka Gcaleka found that President Cyril Ramaposa did not violate the Executive Ethics Code in the Phala Phala matter. Ramapho was accused of breaching the Executive Ethics Code and being in a conflict of interest between his constitutional obligations and his private interests arising from his alleged paid work at Phala Phala.  In 2022, the Constitutional Court upheld a Gauteng High Court judgment that found legislation in the Executive Ethics Code was unconstitutional and invalid as it did not require members of the executive to disclose "donations made to campaigns for their election to positions within political parties- this was about the donations that were made to Ramaphosa's "CR17" campaign for the ANC presidency...  At the time, the now suspended Public Protector Busisiwe Mkhwebane found that the president was in breach of the Executive Ethics Code for not disclosing an R500 000 donation to his campaign for the ANC presidency in 2017 which was received from former Bosasa chief executive Gavin Watson. Not-for-profit organisation Freedom Under Law (FUL) has recommended that the Judicial Service Commission (JSC) be reconstituted to include more senior judges and fewer party-political appointees. This comes from the organisation's report ‘A Review of the Activities of the South African Judicial Service Commission 2009 to 2022', which highlights key deficiencies in the composition and operation of the JSC and makes remedial recommendations and proposals to address the structural problems inherent in the JSC, as well as the challenges in its current processes. FUL argued that, for years, the JSC had been prone to political interference in the appointment of judges. Lead researcher and author of the report Calli Solik said the JSC's Sifting Committee, which compiles a shortlist of candidates to be interviewed by the Commission, should reflect on how it decided on suitable candidates. The report also highlighted the various criticisms levelled against the Sifting Committee's interview process. These include, “the clumsiness in its processes that is the result of an overlarge and eclectic body; the frequent failure on the part of the Chair to maintain fairness; the lack of clear guidelines or criteria in assessing candidates; great inconsistency in the depth and length of the questioning of candidates; the JSC's understanding and implementation of its constitutional mandate in section 174(2); and party-political interference.” The FUL said a major issue of the interviews was the lack of guidelines on how they arrived at their candidates. FUL calls for clear guidelines for the interview process. Solik also suggested the strengthening of the JSC's secretariat, in-depth interviews and greater standardisation of the interview process. She added that questions should be required to cover specific areas of accountability and the JSC should produce its reasons on how a particular candidate was appointed to reduce political interference. Professor Emeritus of Public Law at the University of Cape Town and Freedom Under Law board member said the appointment and accountability of judges was critically important. He said FUL had watched with dismay as the JSC failed to maintain the standards set by the transformative ethos of the South African Constitution since 2009. He said the FUL board resolved in January to commission research into mandate appointment and accountability of the JSC. FUL executive director Judith February said judicial selection, appointment and accountability were key aspects of the judicial system which was "fit for purpose and operates on the bases of integrity”. She said over the past decade South Africa's constitutional democracy had come under scrutiny, particularly relating to politicians and those who were under pressure from the recent damning findings of the Zondo Commission and even the legal fraternity. She cited suspended Public Protector Busisiwe Mkhwebane “protecting” former President Jacob Zuma and some within the African National Congress and called out "narrow political focuses as factional battles are at play”. She noted that many South Africans had criticised how matters had been politicized in the JSC, but added that despite pressure, the JSC had proven to be a resolute. She emphasised that the strength of the judicial arm was a national constitutional asset and it should not be taken for granted.

A day before its report is due, National Assembly Speaker Nosiviwe Mapisa-Nqakula has extended the deadline for the independent panel appointed to determine whether there is a prima facie case for President Cyril Ramaphosa's impeachment after the Phala Phala saga. Parliament announced the extension on Wednesday after chairperson of the panel, former Chief Justice Sandile Ngcobo, wrote to Mapisa-Nqakula. "In his letter, the chairperson indicated that the panel had assessed the [inquiry] process to determine if it will meet the submission deadline of Thursday, 17 November 2022, and had, based on its assessment of the amount of ground still to be covered, and the available resources, determined that the [inquiry] should be completed within 13 days, that is by 30 November 2022," reads a statement from Parliamentary spokesperson Moloto Mothapo. "The panel said the additional time requested was realistic, taking into account the importance of the [inquiry], its complexity, as well as the novelty of the nature of work involved." The panel believes that it is in the public interest that an inquiry "of this nature be scrupulously conducted and all the information and submissions placed before it is carefully considered". In considering the request, Mapisa-Nqakula was mindful that rules governing the Section 89 process do not provide for a deadline extension for the panel to submit its report. She invoked Rule 6 - which deals with unforeseen circumstances - to accede to the panel's request. In terms of this rule, the speaker may give a ruling or frame a rule in respect of any eventuality for which the rules or orders of the House do not provide, having due regard to the procedures, precedents, practices and conventions developed by the House, and based on constitutional values and principles underpinning an open, accountable and democratic society. "The speaker concurs with the panel chairperson that the extreme importance of the panel's work to the members of the National Assembly, the president and the people of South Africa, require the panel to carefully consider all the information and submissions placed before it," Mothapo added. She extended the deadline from 17 November to 30 November. "The speaker has advised the chief whips of political parties of her decision this morning. The speaker continues to wish the panel well in its work." On 14, September, Mapisa-Nqakula appointed Ngcobo, Judge Thokozile Masipa and Professor Richard Calland to the panel. But, before it could start with its work, the Democratic Alliance and Economic Freedom Fighters raised concerns about Calland's alleged bias towards Ramaphosa. After a discussion with Mapisa-Nqakula, Calland withdrew and Mapisa-Nqakula replaced him with advocate Mahlape Sello, SC. This meant that the panel started with it is work on 17 October - a month after it was appointed. All parties represented in Parliament are entitled to make submissions to the panel. Ramaphosa was also expected to provide a written submission to it, which he did. The panel isn't allowed to have oral hearings. In its report, it must include any findings, with reasons, upon which its recommendations are based. It must also include a minority view - if there is one. The National Assembly will then consider it. If a simple majority votes in favour of a recommendation that Parliament should investigate Ramaphosa, an impeachment committee will be formed for this purpose. This will be a similar process to the one under way for suspended Public Protector Busisiwe Mkhwebane. Mapisa-Nqakula's predecessor, Thandi Modise, also granted an extension to the independent panel that considered whether there was a case against Mkhwebane.

Public Protector Busisiwe Mkhwebane has lost yet another high profile case after the North Gauteng High Court declared another report involving the South African Revenue Service (Sars), unlawful and invalid. The Public Protector's report, released in April, had found that Sars had irregularly appointed a company to provide a 100 million rand  IT services contract. But the court on Friday set aside all findings and remedial action. The Public Protector's office has also been ordered to pay Sars' legal costs incurred in the review of this report. This comes as Parliament's impeachment inquiry probes legal expenditure by the Public Protector's office. In another case on Thursday, the Constitutional Court banged the last nail in the coffin of the infamous and discredited report into the SARS "rogue unit", dismissing the suspended Mkhwebane's application for leave to appeal. The Gauteng High Court in Pretoria has invalidated suspended Public Protector Busisiwe Mkhwebane's final report on Minister Pravin Gordhan, quashing her investigation into a South African Revenue Service (Sars) IT contract. The Office of the Public Protector did not attempt to defend Mkhwebane's report on Sars' appointment of IT company BB&D in 2007, which was already found to have been above board by, among other investigations, the Nugent Inquiry. As a result, it was declared invalid and unlawful, reviewed and set aside. Former Public Protector SA (PPSA) spokesperson Oupa Segalwe previously told News24 the office's decision not to defend the report against a previous legal challenge by former Sars official Ivan Pillay was "based on prospects of the PPSA successfully defending the review application". "In the main, the PPSA considered the fact that the grounds for review were procedural aspects of investigation and the publication of the report, which were the subject of unfavourable judgments against the institution in other matters," he said. "Financial implications were the other reason," he added. This is the 39th report by Mkhwebane to be overturned, with 47 of her investigations currently facing legal challenges. Mkhwebane's fitness to hold office is currently the subject of an investigation by a Section 194 committee in Parliament.

Above and beyond the obligation to declare any personal or private financial or business interests, executive members will now have to disclose funds received for their internal party campaigns. On Tuesday, the Constitutional Court upheld a Gauteng High Court judgment that found legislation in the Executive Ethics Code was unconstitutional and invalid as it did not require members of the executive to disclose "donations made to campaigns for their election to positions within political parties". Handing down the unanimous judgment, Justice Steven Majiedt found the code "falls short of constitutional and statutory dictates of transparency, accountability, and openness". He added the current legislation around disclosures of donations for internal party elections undermined the Ethics Act and the conflict of interests regime essential to promoting "transparency and [dealing] with the pervasive corruption bedevilling" the country. Majiedt stressed that "the need for transparency in campaign donations must be understood against the backdrop of and the context of the pressing need to curb and strive towards eradicating corruption". The case is likely to have a bearing on donations to the campaigns of politicians seeking positions in their parties, especially the African National Congress (ANC) leading up to its December elective conference. The Constitutional Court judgment confirmed a ruling handed down by the Gauteng High Court in Pretoria in December last year. It found the Executive Ethics Code, in its current state, was unconstitutional and invalid for not requiring members of the executive to disclose "donations made to campaigns for their election to positions within political parties". The High Court gave President Cyril Ramaphosa a year to remedy the defects in the code, which the Constitutional Court also upheld on Tuesday. The judgment is not retrospective, meaning donations made to Ramaphosa's "CR17" campaign for the ANC presidency will not have to be made public. The case was brought by investigative journalism unit amaBhungane, as it sought confirmation of the High Court ruling. The Constitutional Court heard amaBhungane's case in May. The investigative news unit argued democracy "is diminished when unaccountable people and entities with unknowable resources bring extraordinary influence to bear on policy and the elected officials they have sponsored". It also stressed when politicians knew they could operate without the scrutiny brought by an effective watchdog system, they might be more likely to take advantage of the spoils of public office at the expense of the public good. amaBhungane took up the case after the High Court set aside Public Protector Busisiwe Mkhwebane's CR17 report in 2020. Mkhwebane found Ramaphosa in breach of the Executive Ethics Code for not disclosing a R500 000 donation to his campaign for the ANC presidency in 2017 which was received from former Bosasa chief executive Gavin Watson. At the time, the court deemed that under the current prescripts of the code, Ramaphosa was not legally obligated to disclose the donations he received for internal party elections because he had not personally benefitted from them. The outcome of the Ramaphosa case led to amaBhungane challenging the constitutionality of the Executive Ethics Code in a parallel process.
