SEASON 4 EPISODE 46: COUNTDOWN WITH KEITH OLBERMANN A-Block (2:30) SPECIAL COMMENT: Well, that's it in sum, isn't it? He's "El Presidente" now, isn't he? Military Dictator. Succeeding Maduro. Until he finds somebody else to “run” it. Not the elected Vice President. Not the actual winner of the last election. Not the U-N. Maybe somebody he, in his dysfunctional haze, somebody he can trust. Maybe an oil executive. Or Elon Musk. Or Catturd. The invasion was illegal there, and illegal here. The kidnapping was illegal. Declaring we would run it is illegal. Naming a proxy dictator is illegal. As was his threat yesterday to the acting president that quote “if she doesn’t do what’s right, she is going to pay a very big price, probably bigger than Maduro” and calling for her belief that her country shouldn’t be invaded by another country breaking its own laws is quote “defiant rejection.” THAT’S illegal. It’s all illegal. That’s a lot of illegal – even for Trump. And I say this, hating Maduro completely. So he needs to be impeached, if not now then a year from now. Rubio can be impeached now for deceiving Congress about its approval. And both of them turned over to the World Court. And the ramifications are almost uncountable, including emboldening them to consider this in Cuba, Greenland, Iran. The poll numbers are terrible, and the risk to Americans of terrorism and violence are just as terrible. And maybe worst of all the evidence of linkage between Putin's strange silence about his ally Maduro, and Trump's dithering about Ukraine, is terrible too. But at least it produced a pretty good Olivia Nuzzi joke. ALSO: WHY DID THEY CHANGE THE TRUMP HEALTH COVER-UP STORY AGAIN? Five significant changes, about his MRI/CT, his cardiovascular health, and now the total of Cognitive tests he's gotten in just the last nine months. Three? Not two? He's really needed three tests in nine months? To repeat the insightful question from his niece Mary Trump: Why do they have to keep giving him cognitive tests? B-Block (40:00) THE WORST PERSONS IN THE WORLD: There's begging the new boss to let you keep your current job, then there's what CBS Legal Analyst Jan Crawford is doing for Bari Weiss to try to keep hers. Chuck Schumer comes out firing on Venezuela: with one-millionth of one barrel blazing. And just when you think Cheryl Hines can't get any dumber, Tucker Carlson tries to talk to her about vaccines. C-Block (50:00) THINGS I PROMISED NOT TO TELL: Will Ferrell did a great comedy bit at the L.A. Kings hockey game on New Year's Day and he did it for the pure joy of it. Which reminded me of the difference between amateurs and pros, and of the days when "Anchorman" was new and Will and I ad libbed a pretty good comedy bit that he said he really loved doing. BULLETIN: TRUMP'S ILLEGAL WAR WITH VENEZUELA Two months ago, in an interview, Trump's Chief of Staff Susie Wiles "conceded that attacking targets on Venezuela’s mainland would force Trump to get congressional approval. Quote: "If he were to authorize some activity on land, then it’s war, then [we’d need] Congress.'" She was entirely right. Yet overnight Trump invaded Venezuela and seized its leader Nicolas Maduro. To paraphrase his own chief of staff he DID authorize some activity on land, then it’s war, then [we’d need] Congress.'" AND TRUMP BROKE THE LAW AND BREACHED THE CONSTITUTION. And this morning he and his hapless Vice President JD Vance confirmed this is as much about seizing oil - as much about increasing the profits of American corporations - as any supposed "narco-terrorism." Without any Congressional consent, Trump did this - anyway - from inside his madness, from within his monomaniacal delusional fog - without any legal right to do so - without any legal right THERE and without any legal right HERE. On his own. Without congressional approval. Without the nation's approval. Without even the flimsiest of the fig leaves of democracy. Without any international consensus. Without any concern for the consequences. Without any consideration of the precedent he provides China in Taiwan and Russia in Poland and any other tyrannical bandit nation anywhere in this world. And we, thanks to Trump, we - the United States of America - are now that tyrannical bandit nation. It is important to note that on the simple, theoretical scale of who should remain as the leader of a failed rogue state, there is no defense for Nicolas Maduro. There is overwhelming evidence that he fabricated his latest quote “re-election” after first denuding the opposition and the law within his country. Again, by those tokens Trump has just put us on that identical path. And the idea that a country is suffering under a dictator who has no moral right to continue can be said even more easily of Putin. And of Xi in China. And dozens of others, many of whom Trump considers friends, about whom he makes no distinction. Maduro has no moral right to continue as president of Venezuela, and Trump has no moral right to act upon that by himself. See omnystudio.com/listener for privacy information.

A gallon of gas costs about twice as much in California as it does pretty much anywhere else in the United States. The reason why, of course, is that California makes it cost about twice as much – by reducing supply and by adding costs, chiefly for “environmental” reasons. This includes a new requirement – going into effect very soon (Dec. 31) that all gas stations must either replace single-walled underground storage tanks or permanently close them – no matter whether the tanks are actually leaking and no matter how much it costs to replace them. It is estimated that about 473 gas stations in California are going to close – because the owners cannot afford the mandatory underground storage tank upgrade costs or the $5,000 per day fines for non-compliance. At the same time, the state's regulatory bureaucracy has essentially shut down supply by denying 97 percent of permits for new refineries to supply the extra-special (and extra-expensive) gasoline formulations that all gas stations in California are required to sell. If this hypothetical scenario ends up becoming the actual scenario it could result in the collapse of California as a state. (VIDEO) Thomas Massie and Ro Khanna Announce Plans to Bring Inherent Contempt Charges Against Attorney General Pam Bondi Over Epstein Files – “We're Building a Bipartisan Coalition” Reps. Thomas Massie (R-KY) and Ro Khanna (D-CA), the authors of the Epstein Files Transparency Act, signed into law by President Trump last month, announced their intention to bring charges for inherent contempt against Attorney General Pam Bondi. Under the rarely used congressional power, “the House or Senate has its Sergeant-At-Arms, or deputy, take a person into custody for proceedings to be held in Congress,” according to the National Constitution Center. However, it is unclear how effective this would be in the face of legal challenges and the executive branch's power. This is the latest in an escalating saga of threats, with Massie and Khanna claiming the DOJ has not complied fully with the law due to redactions in the files and not releasing every document available. Deputy Attorney General Todd Blanche appeared on NBC's Meet the Press this morning, where he dared Massie and Khanna to “bring it on,” maintaining that the DOJ is simply following the law and taking the necessary time to make redactions before releasing all of the files. Blanche told NBC's Kristen Welker that ensuring victim information is redacted “very much Trumps some deadline in the statute,” and he dared Khanna and Massie to file Articles of Impeachment. “We are complying with the statute, we will continue to comply with the statute, and if by complying with the statute, we don't produce everything on Friday, we produce things next week, and the week after, that's still compliance with the statute,” Blanche added. Salon's Amanda Marcotte pointed out that the president has developed an over-reliance on deflecting questions while claiming he is not up to speed on the topic or person he is being asked about, and that often begins with, “I don't know…” That is a change from his previous deflections, where he promised everything would sort itself out in “two weeks.” Source: rawstory.com President Trump's Plan https://twitter.com/amuse/status/2002836773236306381?s=20 polygraph which they claim he failed to justify keeping their activities secret from Trump’s team. Trump to replace nearly 30 career diplomats in ambassadorial positions with ‘America First' allies The U.S. chiefs of mission in at least 29 countries were informed last week that their tenures would end in January 2026; all of them had taken up their posts in the Biden administration The Trump administration is recalling nearly 30 career diplomats from ambassadorial and other senior embassy posts as it moves to reshape the U.S. diplomatic posture abroad with personnel deemed fully supportive of President Donald Trump's “America First” priorities. All of them had taken up their posts in the Joe Biden administration but had survived an initial purge in the early months of Mr. Trump's second term that targeted mainly political appointees. That changed on Wednesday (December 17, 2025) when they began to receive notices from officials in Washington about their imminent departures. How Trump shifted America's policy in a week Ambassadors serve at the pleasure of the President, although they typically remain at their posts for three to four years. Those affected by the shake-up are not losing their foreign service jobs but will be returning to Washington for other assignments should they wish to take them, the officials said. Africa is the continent most affected by the removals, with ambassadors from 13 countries being removed: Burundi, Cameroon, Cape Verde, Gabon, Ivory Coast, Madagascar, Mauritius, Niger, Nigeria, Rwanda, Senegal, Somalia and Uganda. Second is Asia, with ambassadorial changes coming to six countries: Fiji, Laos, the Marshall Islands, Papua New Guinea, the Philippines and Vietnam affected. Four countries in Europe (Armenia, Macedonia, Montenegro and Slovakia) are affected; as are two each in the Middle East (Algeria and Egypt); South and Central Asia (Nepal and Sri Lanka); and the Western Hemisphere (Guatemala and Suriname). Source: zerohedge.com Deep State Apoplectic with Trump's Use of Emissaries to Deliver Results President Trump is ducking and weaving through some of the deepest Machiavellian constructs, while maintaining forward progress. To put context to it, these creeps have had four years to strategize how to control Trump and manipulate policy with their retention of all sorts of government agencies in alignment with the status quo. Yet, remarkably President Trump is dancing through their deep state minefield while keeping dozens of plates spinning on sticks. The use of non-traditional emissaries is really making them angry. , the use of emissaries outside the govt framework of traditional policy was going to be a key facet in any America-First agenda. The Deep State does not like President Trump's use of emissaries to conduct foreign policy. In fact, they oppose it strongly; they hate it. The “emissary” is the person who carries the word of President Trump to any person identified by President Trump. The emissary is very much like a tape recording of President Trump in human form. The emissary travels to a location, meets a particular person or group, and then recites the opinion of the President. The words spoken by the emissary, are the words of President Trump. The IC cannot inject themselves into this dynamic; that is why it is so valuable. The emissary then hears the response from the intended person or group, repeats it back to them to ensure he/she will return with clarity of intent as expressed, and then returns to the office of the presidency and repeats the reply for the President. The emissary recites back exactly what he was /is told. This process is critical when you understand how thoroughly compromised the full Executive Branch is. More importantly, this process becomes even more critical when you accept the Intelligence Community will lie to the office of the President to retain their power and position. NULLIFICATION AND THE WEAPONIZATION OF IMPEACHMENT Colleague Victor Davis Hanson. The discussion covers modern "nullification," where jurisdictions like sanctuary cities deliberately ignore federal immigration laws, creating a dangerous legal asymmetry. Hanson also argues that the impeachment process has been distorted into a political tool used to punish first-term presidents who lose congressional majorities, rather than for genuine high crimes. He contends that the dual impeachment of Donald Trump set a destructive precedent that effectively nullifies the electoral will of the citizenry. NUMBER 6

This Day in Legal History: Trump ImpeachedOn December 18, 2019, the U.S. House of Representatives voted to impeach President Donald J. Trump, marking the third presidential impeachment in American history. The impeachment followed a months-long investigation centered on Trump's dealings with Ukraine. House Democrats alleged that the president abused the powers of his office by pressuring a foreign government to investigate a political rival. A second article charged Trump with obstruction of Congress for directing executive branch officials not to comply with House subpoenas. The votes largely split along party lines, reflecting deep political polarization.Impeachment itself did not remove Trump from office, but instead formally accused him of constitutional wrongdoing. Under the Constitution, the House holds the sole power of impeachment, functioning similarly to a grand jury. Once impeached, the process shifted to the Senate, which is responsible for conducting a trial. Chief Justice John Roberts later presided over the Senate proceedings, as required when a president is tried. The Senate ultimately acquitted Trump in February 2020, falling short of the two-thirds vote needed for conviction. Despite the acquittal, the impeachment reinforced Congress's oversight authority over the executive branch. The episode also highlighted ongoing debates about the limits of presidential power and the role of impeachment as a constitutional check.A federal appeals court in Washington reversed an earlier ruling that would have allowed the Trump administration to move forward with mass firings at the Consumer Financial Protection Bureau (CFPB). Sitting as a full bench, the court blocked plans to cut as much as 90% of the agency's workforce and agreed to rehear the administration's appeal of a lower court order that had paused efforts to dismantle the bureau. As a result, the administration remains temporarily barred from gutting the agency while litigation continues. The legal fight has stretched on for months, during which the CFPB has been largely sidelined. Congress originally created the CFPB after the 2008 financial crisis to protect consumers from unfair, deceptive, and abusive practices by banks, lenders, and other financial companies. Its mission includes enforcing federal consumer financial laws and preventing the kinds of predatory conduct that helped trigger the financial collapse. Supporters of the agency, including Senator Elizabeth Warren, praised the ruling as necessary to shield families from financial harm.Critics within the Trump administration have argued the CFPB is politically motivated (as protecting consumers from predatory financial practices is political, apparently) and should be eliminated, though they have also claimed in court that some version of the agency would remain. Complicating matters further, the CFPB faces a funding dispute over whether it can draw money from the Federal Reserve, raising concerns that it could run out of operating funds.US appeals court tosses decision allowing Trump mass firings at consumer bureau | ReutersFull DC Circuit Will Review Trump's Bid to Dismantle CFPB (2)A group of leading medical organizations asked a federal judge to allow their lawsuit challenging vaccine policy changes under Health Secretary Robert F. Kennedy Jr. to move forward. The groups argue that recent actions by Kennedy and the Department of Health and Human Services will reduce vaccination rates and endanger public health. They point to a directive removing COVID-19 vaccine recommendations for pregnant women and children without advance notice or explanation. The lawsuit also challenges Kennedy's decision to dismiss 17 experts from a CDC advisory panel and replace them with members more aligned with his views. That reconstituted panel later voted to scale back broad vaccine recommendations, including limiting COVID-19 shots to shared decision-making with doctors and eliminating universal recommendations for certain childhood vaccines. The plaintiffs claim the panel was unlawfully reshaped in violation of federal law requiring advisory committees to be balanced and free from improper influence. Government lawyers argue the medical groups lack standing because the CDC's guidance merely advises consultation with doctors and does not directly harm them. The plaintiffs counter that they have been injured by having to divert resources to help doctors navigate confusing and abrupt policy shifts. The judge indicated skepticism toward the government's standing argument, particularly in light of statements suggesting doctors could face liability for deviating from CDC guidance. A ruling on whether the case can proceed is expected before a scheduled January hearing.US medical groups urge judge to allow challenge to Kennedy-backed vaccine policies to proceed | ReutersA federal appeals court allowed President Donald Trump's deployment of National Guard troops in Washington, D.C., to remain in place while legal challenges continue. A three-judge panel said the administration was likely to succeed in defending the deployment, temporarily blocking a lower court order that would have ended it. The ruling gives Trump an interim victory as he claims broad authority to use troops for domestic law enforcement. The deployment began earlier in the year and expanded after two Guard members were shot near the White House. The judges emphasized that Washington, D.C.'s unique status—because it is not a state—strengthens presidential authority there. District officials who sued to stop the deployment said the decision is preliminary and does not resolve the underlying legal questions. The White House praised the ruling as confirmation of the president's lawful powers and credited the deployment with improving public safety. The case comes amid broader disputes over Trump's efforts to deploy troops in several major cities despite objections from local and state leaders. Lower courts have generally been skeptical of those efforts, rejecting claims that protests against federal immigration enforcement qualify as rebellions. The Supreme Court is widely expected to weigh in on the scope of presidential power in this area.US appeals court says Trump's National Guard deployment in DC may continue | ReutersTrump's DC Troop Deployment Gets Extension From US Appeals CourtA federal judge allowed President Donald Trump to continue work on a proposed White House ballroom, rejecting an emergency request from preservation advocates to immediately halt the project. The judge ruled that the National Trust failed to show imminent, irreparable harm that would justify stopping construction at this early stage. However, he cautioned that the government may be required to reverse certain underground work if it ends up locking in a specific design. The project involves replacing the demolished East Wing with a large ballroom that would be significantly bigger than prior White House renovations. Trump has described the ballroom as a privately funded project and recently increased its estimated cost. Preservationists argue the administration moved forward without required public input and bypassed federal planning and design review processes. The government countered that the design is still in flux and that above-ground construction will not begin for several months. Relying on those representations, the judge found no immediate risk of irreversible aesthetic damage. He scheduled another hearing to reconsider whether the project should be paused as the lawsuit continues. For now, construction may proceed while the court reviews whether the administration complied with historic preservation and planning laws.Judge allows Trump's ballroom project to proceed for now | Reuters This is a public episode.
