Donald Trump has refused to answer questions under oath from the New York Attorney General's office today, as its years-long civil fraud probe nears its conclusion. The investigation, led by Attorney General Letitia James, is determining if the Trump Organisation used misleading information to get millions of dollars in tax breaks and loans. An hour after he arrived at James' office, Trump issued a statement saying he took his Fifth Amendment right against self-incrimination. In the past, Trump had said dodging questions is an admission of guilt. But today, his stance on that somewhat changed. New York University law professor Stephen Gillers spoke to Guyon Espiner.

What happens if witnesses as to a woman's captivity only show up after she's already married (as per the mishnah)? The Gemara explains that the mishnah doesn't mean actually married. And if she has witnesses who can corroborate that she was unscathed - that is believed. Likewise, if there are witnesses that she's NOT unscathed, she's supposed to leave her marriage (especially if she's married to a kohen). Plus, a case of events that took place - actual captive women. With Shmuel knocking his father, and with his father winning, after all. Also, a paid of witnesses who each said they were pure - they can testify on behalf of the others, but not for themselves. Plus the full range of permutations, so that all basis are covered. And now, behold, the king walks before you, and I am old and gray; and behold, my sons are with you. I have walked before you from my youth until this day. Here I am; testify against me before the LORD and before his anointed. Whose ox have I taken? Or whose donkey have I taken? Or whom have I defrauded? Whom have I oppressed? Or from whose hand have I taken a bribe to blind my eyes with it? Testify against me and I will restore it to you.” They said, “You have not defrauded us or oppressed us or taken anything from any man's hand.” And he said to them, “The LORD is witness against you, and his anointed is witness this day, that you have not found anything in my hand.” And they said, “He is witness.” And Samuel said to the people, “The LORD is witness, who appointed Moses and Aaron and brought your fathers up out of the land of Egypt. Now therefore stand still that I may plead with you before the LORD concerning all the righteous deeds of the LORD that he performed for you and for your fathers. When Jacob went into Egypt, and the Egyptians oppressed them, then your fathers cried out to the LORD and the LORD sent Moses and Aaron, who brought your fathers out of Egypt and made them dwell in this place. But they forgot the LORD their God. And he sold them into the hand of Sisera, commander of the army of Hazor, and into the hand of the Philistines, and into the hand of the king of Moab. And they fought against them. And they cried out to the LORD and said, ‘We have sinned, because we have forsaken the LORD and have served the Baals and the Ashtaroth. But now deliver us out of the hand of our enemies, that we may serve you.' And the LORD sent Jerubbaal and Barak and Jephthah and Samuel and delivered you out of the hand of your enemies on every side, and you lived in safety. And when you saw that Nahash the king of the Ammonites came against you, you said to me, ‘No, but a king shall reign over us,' when the LORD your God was your king. And now behold the king whom you have chosen, for whom you have asked; behold, the LORD has set a king over you. If you will fear the LORD and serve him and obey his voice and not rebel against the commandment of the LORD, and if both you and the king who reigns over you will follow the LORD your God, it will be well. But if you will not obey the voice of the LORD, but rebel against the commandment of the LORD, then the hand of the LORD will be against you and your king. Now therefore stand still and see this great thing that the LORD will do before your eyes. Is it not wheat harvest today? I will call upon the LORD, that he may send thunder and rain. And you shall know and see that your wickedness is great, which you have done in the sight of the LORD, in asking for yourselves a king.” So Samuel called upon the LORD, and the LORD sent thunder and rain that day, and all the people greatly feared the LORD and Samuel. And all the people said to Samuel, “Pray for your servants to the LORD your God, that we may not die, for we have added to all our sins this evil, to ask for ourselves a king.” And Samuel said to the people, “Do not be afraid; you have done all this evil. Yet do not turn aside from following the LORD, but serve the LORD with all your heart. And do not turn aside after empty things that cannot profit or deliver, for they are empty. For the LORD will not forsake his people, forhis great name's sake, because it has pleased the LORD to make you a people for himself. Moreover, as for me, far be it from me that I should sin against the LORD by ceasing to pray for you, and I will instruct you in the good and the right way. Only fear the LORD and serve him faithfully with all your heart. For consider what great things he has done for you. But if you still do wickedly, you shall be swept away, both you and your king.” Acts 22:30—23:11 But on the next day, desiring to know the real reason why he was being accused by the Jews, he unbound him and commanded the chief priests and all the council to meet, and he brought Paul down and set him before them. And looking intently at the council, Paul said, “Brothers, I have lived my life before God in all good conscience up to this day.” And the high priest Ananias commanded those who stood by him to strike him on the mouth. Then Paul said to him, “God is going to strike you, you whitewashed wall! Are you sitting to judge me according to the law, and yet contrary to the law you order me to be struck?” Those who stood by said, “Would you revile God's high priest?” And Paul said, “I did not know, brothers, that he was the high priest, for it is written, ‘You shall not speak evil of a ruler of your people.'” Now when Paul perceived that one part were Sadducees and the other Pharisees, he cried out in the council, “Brothers, I am a Pharisee, a son of Pharisees. It is with respect to the hope and the resurrection of the dead that I am on trial.” And when he had said this, a dissension arose between the Pharisees and the Sadducees, and the assembly was divided. For the Sadducees say that there is no resurrection, nor angel, nor spirit, but the Pharisees acknowledge them all. Then a great clamor arose, and some of the scribes of the Pharisees' party stood up and contended sharply, “We find nothing wrong in this man. What if a spirit or an angel spoke to him?” And when the dissension became violent, the tribune, afraid that Paul would be torn to pieces by them, commanded the soldiers to go down and take him away from among them by force and bring him into the barracks. The following night the Lord stood by him and said, “Take courage, for as you have testified to the facts about me in Jerusalem, so you must testify also in Rome.” The Sacrament of the Altar Who receives this Sacrament worthily? Fasting and bodily preparation are certainly fine outward training. But that person is truly worthy and well prepared who has faith in these words: “Given and shed for you for the forgiveness of sins.” But anyone who does not believe these words or doubts them is unworthy and unprepared, for the words “for you” require all hearts to believe.

Also, it probably qualifies as irony that federal prosecutors in DC routinely use the Secret Service Forensic Sciences Division to perform forensic searches of computers and cell phones, including when prosecutors seek to retrieve informations deleted from computers and cell phones. This video also explores the need for former Vice President Mike Pence to testify to the January 6 House select committee, particularly now that important text message evidence has ben deleted by the Secret Service. Things are going super over in the United Kingdom, jokes Molly Jong-Fast to British journalist Ian Dunt on this episode of The New Abnormal podcast. Dunt broke down the events that led to the U.K. Prime Minister's resignation as well as whether or not he thinks Boris Johnson will still hold the title by the fall and the state of U.K. politics—and whether there's a chance to actually reverse Brexit. Then, CNBC Fast Money contributor Dan Nathan explains why a recession might actually be a good thing, and that it's what the federal government likely wants. “Sadly they need the economy almost to go in a recession for inflation to come down meaningfully,” he says. Plus! Molly and co-host Andy Levy shoot the shit about Elon Musk hurting Trump's feelings, Biden's dumb move to swing “left,” and the one thing that'll actually maybe get Steve Bannon to testify in front of the Jan. 6 committee.  See acast.com/privacy for privacy and opt-out information.

Today's episode pays off a bet Andrew made last month that the January 6 Committee would eventually secure the testimony of White House Counsel Pat Cipollone. Find out why that's such a big deal! In addition to explaining how the J6 Committee came to secure Pets of Belonging's testimony, Andrew answers your questions regarding whether this is some kind of elaborate con (No), how Cipollone's answers are likely to interact with executive and attorney-client privilege (frequently), and the likelihood that he will help round out the successful case for prosecuting Donald Trump for crimes in connection with the 1/6 Insurrection (EXTREMELY!). It's a big deal! After the main breakdown, we share a thoughtful and informative letter from a listener who helps put the Supreme Court's recent (atrocious) decision in Carson v. Makin (that we broke down in Episode 608) permitting direct government aid to expressly religious schools into a fuller context. It's an Andrew Was Wrong (About Rural Maine) and an important object lesson that you can never trust the fact section in a SCOTUS case involving religion these days. Links: The brilliant and hilarious Merrill Markoe captured the live-captioning of Pat Cipollone's name as Patsy Baloney (and others) on Twitter. For the background for the crime-fraud exception, check out Rule 1.2 and Rule 1.6 of the Model Rules of Professional Conduct. You can check out the Senate Judiciary testimony of Jeff Rosen as well as Richard Donohue for all sorts of new goodies, some of which we covered on the show!
