This evening on Legal Matters we talk about the payment of gratuity in employment law. Is it a right or a benefit? The payment of gratuity is popularly known as the 13th cheque or Christmas bonus– in other words, a payment of gratitude by the employer to the employee in recognition of a job well done, or if you like, going the extra mile. It must be understood that Labour Law is silent on the question of bonuses. This means that the payment or non-payment of bonuses is a matter entirely for the employer to decide, and to negotiate with employees. If an employer who presently does not pay bonuses of any sort wishes to continue on that route he can do so, without fear of being accused of unfair labour practice. The Gauteng High Court in Pretoria has dismissed with costs the application by former Public Protector, Busisiwe Mkhwebane to have her former office pay her an estimated gratuity amounting to almost 10 Million rands. Mkhwebane has been battling to get the money in the courts after her successor Kholeka Gcaleka took a decision that, because she was removed from office for misconduct and incompetence by parliament, she has no right to the money. Lawyers for the office of the Public Protector have argued that the gratuity is not a salary nor a right in terms of her service contract but rather a discretionary payment for work well done. Advocate Busisiwe Mkhwebane's status in proceedings before the Supreme Court of Appeal is been debated before the appellate court in Bloemfontein, Free State. Mkhwebane is before the superior court appealing the judgment dismissing the Chairperson of the Section 194 inquiry, Qubudile Dyantyi's refusal to recuse himself from the inquiry that impeached her. However, the former Public Protector no longer occupies the position. Her legal counsel, Advocate Dali Mpofu (SC) has argued that she has brought the appeal in her personal capacity and has invoked Rule 15 of the Uniform Rules of Court. You step up to the counter, and he remembers your name;“How are you doing this morning, Mr. Welch?”And your order!“Americano with an extra shot, two inches of room?”Bingo. This kid is on fire. “That'll be $3.42,” he says. You tap to pay, and the tip screen pops up. $1, $2, $3, or “other?”Feeling inspired by his contagious energy, you click “other” and unleash a 300% gratuity. It's your personal way of getting his attention, giving him a high five, and telling him to keep up the hard work. Except he NEVER gets the message. Because technology sucks.The tip screen disappears, and the money hops from your debit card into the cafe payroll account to be evenly divided among all the other average people working that day. He'll never see or feel that high five. He'll never know you are cheering him on. And everyone involved missed a huge opportunity for joy. We've long forgotten the difference between tipping and gratuity. Gratuity, as its name suggests, is an expression of gratitude. It breeds kindness, appreciation, and entrepreneurial spirit. Tipping, on the other hand, has become nothing more than a transaction. It breeds entitlement, indifference, and apathy. Does that bother you as much as it does me?Do you want to do something about it?Carry cash, my friend.Leave a crisp twenty behind to let that high schooler know that her dreams matter. Tell the old man at the car wash to keep the change and do something fun with his grandkids. Find the single mom working the gas station counter, look her in the eyes, tell her she's doing a great job as you hand her a Benjamin Franklin. The size of the bill doesn't matter. But returning the lost gesture of gratitude to someone stuck in a thankless world can quite literally change their life.Stop tipping.Start giving gratuity.Do it in a way they will feel and know that they are important. The Pretoria High Court will today hear former Public Protector Advocate Busisiwe Mkhwebane's urgent application to compel the Public Protector South Africa to pay her a R10 million gratuity she claims she is entitled to. However, the office of the Public Protector argues that Mkhwebane is not eligible for the payment. Current Public Protector Koleka Gcaleka, in her affidavit, says that Mkhwebane has no right to the gratuity as she did not vacate office but was removed from office for serious misconduct and incompetence.
