Dr. Sandie Morgan is joined by Ambassador John Cotton Richmond as the two discuss the 2024 Trafficking in Persons Report. John Cotton Richmond Ambassador Richmond is an attorney and diplomat focused on ethical business, human rights, democracy, and rule of law. He served in the country's highest position dedicated to combating human trafficking as a U.S. Ambassador where he led U.S. foreign policy in the global fight for freedom. As a Partner at Dentons, Ambassador Richmond helps companies keep their supply chains and workforces free of human trafficking. He was named one of the federal “Prosecutors of the Year,” after a decade successfully trying complex police misconduct, cross-burning, neo-Nazi hate crimes, forced labor, and sex trafficking cases across the country. Ambassador Richmond is a Senior Fellow at the Atlantic Council, frequent expert for the United Nations, and frequent speaker on justice, freedom, leadership, faith, and vocation. Key Points The TIP Report evaluates 188 countries on their anti-trafficking efforts, including prosecution, protection, and prevention, and ranks them based on their progress compared to previous years. The rankings influence U.S. foreign policy, with tier three countries facing sanctions. Victim identification has improved with 133,943 victims identified this year, but this number represents less than 0.5% of estimated global victims. The TIP Report notes a rise in identified labor trafficking victims (31% of the total), highlighting a shift from primarily sex trafficking cases. The report does not specify industries, but labor trafficking occurs in various sectors, including domestic work and agriculture. Although prosecutions have slightly increased to 18,074, they are still below previous highs. Convictions remain significantly lower compared to past years, indicating insufficient accountability for traffickers. Despite regulations, victim identification remains low due to unfunded or underfunded mandates. Improved funding and strategic resource allocation are necessary to increase victim identification and support. The TIP Report emphasizes both the challenges and opportunities technology presents in combating trafficking. June 23rd, 2023 - The U.S. State Department has recently released its ⁠annual Trafficking in Persons (TIP) Report⁠ – a key instrument used globally to assess the state of anti-trafficking responses.  This year's TIP Report highlights the rise of trafficking to online scam centers as an emerging threat. As Ambassador-at-Large Cindy Dyer, wrote, “Cyber scams —from fake dating profiles to illegal gambling operations—are increasingly perpetuated through forced criminality. The two discuss the importance of shedding light on labor trafficking as well as understanding labor trafficking cases collaboratively. Key Points The same approach and attention given to sex trafficking should be used when approaching labor trafficking as both are crimes. While labor trafficking cases have decreased, collaboration when pursuing cases gives victims to opportunity to be liberated and ensures those who have committed the crime are held accountable. Investigating and identifying labor trafficking is difficult without collaboration because of its tendency to involve foreign nationals. It's important to have knowledge of the signs of labor trafficking to keep individuals who could possible be in a labor trafficking situation from being exploited. ...โควิด-19 กลับมาวิกฤติอีกรอบหนึ่งก็เพราะว่าปัญหาเรื่องส่วยก็คือความไม่ชอบมาพากลที่ซุกอยู่ใต้พรมของสังคมไทย ไม่ว่าจะเป็นส่วยแรงงาน บ่อน บ่อนชนไก่หรือว่าสถานบันเทิง... ต้องการชี้เป้าให้คนไทยเห็นว่าเรื่องส่วยแรงงานที่เราพูดกันมีอะไรเชื่อมโยงบ้าง เป็นเรื่องแรงงานข้ามชาติ เป็นเรื่องการค้ามนุษย์ โควิด-19 กลับมาวิกฤติอีกรอบหนึ่งก็เพราะว่าปัญหาเรื่องส่วยก็คือความไม่ชอบมาพากลที่ซุกอยู่ใต้พรมของสังคมไทย ไม่ว่าจะเป็นส่วยแรงงาน บ่อน บ่อนชนไก่หรือว่าสถานบันเทิง สิ่งเหล่านี้คนไทยรู้อยู่นานแล้วแต่ว่าเราก็นิ่งไป บังเอิญว่าครั้งนี้กลายเป็นเรื่องใหญ่ขึ้นมาเพราะโควิด-19 ต้องการเชื่อมโยงให้คนไทยเห็นภาพเหมือนกับที่ต่างชาติเขารู้ว่าเกิดอะไรขึ้นในประเทศไทยเกี่ยวกับเรื่องแรงงานต่างชาติ ผมจะอ่านข้อมูลบางส่วนให้ฟัง ผมเขียนอย่างนี้ แรงงานต่างชาติที่เข้าประเทศไทยอย่งผิดกฎหมาย จริงๆ แล้ว มีทั้งทางบกและทางทะเล อันนี้เป็นข้อมูลที่ชัดเจนเลย หลักฐานยืนยันก็คือรายงานเรื่องเกี่ยวกับการค้ามนุษย์หรือที่เรียกว่า TIP Report ที่เขาเผยแพร่กันในยุโรป เผยแพร่กันในสหรัฐอเมริกา แล้วก็จัดอันดับของประเทศไทย เขาเผยแพร่ออกมาแรงงานที่เข้าทางทะเลก็คือตั้งแต่ระนองไปจนถึงจรดชายแดน ไทย – มาเลเซีย ทางฝั่งอ่าวไทยมีไหม มีครับ ตั้งแต่จรดชายแดนเมเลเซียไปจนถึงจรดชายแดนกัมพูชา ตลอดแนวนี้ก็จะมีหมดเลย พวกนี้ถ้าเป็นแรงงาน ก็จะเป็นแรงงานที่เกี่ยวกับอุตสาหกรรมประมง เป็นลูกเรือหรือทำแรงงานที่ท่าเรือ สะพานเรือ หรือเป็นแรงงานที่เกี่ยวกับการแปรรูปอาหาร ส่วนหนึ่งเป็นแรงงาน ส่วนที่สองคือการค้ามนุษย์ จำได้ไหมครับ เมื่อปี พ.ศ. 2561 มีคดีค้ามนุษย์ชาวโรฮิงญา จำเลยในคดีนั้นก็คือนายทหารยศ พล.โท ชื่อมนัส สำหรับทางบกมีทั้งที่ถูกกฎหมายและผิดกฎหมาย ช่องทางเข้าส่วนหนึ่งก็เข้ามาตามด่าน แต่จะมีคนส่วนหนึ่งที่ไม่มีเอกสารถูกต้องหรือไม่ผ่านกระบวนการถูกต้อง รับเงินค่าอำนวยความสะดวกกัน พวกนี้จำนวนไม่มาก จำนวนมากจริงๆ ก็คือคนที่ข้ามแดนมาตามช่องทางธรรมชาติ จะต้องจ่ายเงินกันให้กับนายหน้าที่ฝั่งเขา 8,000 - 15,000 บาท นายหน้าได้ เป็นค่าใช้จ่ายอะไรบ้าง ผมจะขอไล่เรียงให้ท่านฟัง สิ่งที่เรารับรู้กันมาตลอดก็คือว่าพอเขาข้ามชายแดนมาอาจจะข้ามคลอง มุดป่าฝ่าดง ข้ามเขา อะไรมาก็แล้วแต่ ข้ามมาแล้วเขาจะมีบ้านที่พัก คนเมียนมาที่อพยพมาอยู่ หรือคนไทย หรือกลุ่มชาติพันธุ์ที่อาศัยอยู่ตามชายแดน แต่คนพวกนี้จะเป็นหนึ่งในเครือข่ายที่เปิดเป็นที่พักพิงให้กับคนที่เข้าแดนผิดกฎหมายเหล่านี้ เขาจะเข้ามานอนอยู่วันหรือสองวัน ถึงเวลานัดหมาย ก็จะมี รถตู้ รถกระบะ รถเก๋ง มารับคนเหล่านี้ เป็นกลุ่ม เป็นคณะ เดินทางมาสถานีขนส่งในเมืองใหญ่ จะเป็นแม่สาย เป็นเชียงใหม่ เป็นเชียงราย อะไรก็แล้วแต่ แต่จะมีอีกส่วนหนึ่งที่นายหน้าจะพาขึ้นรถตู้เอาเข้าไปจนถึงแหล่งทำงาน ยังมีอีกส่วนหนึ่งก็คือขบวนการค้ายาเสพย์ติด ตามข้อมูลของกรมแรงงาน เขาบอกว่าประเทศไทยมีแรงงานต่างชาติปีที่แล้ว บอกว่ามี 2,080,000 คน แต่ในความเป็นจริงแรงงานต่างชาติที่ทำงานในประเทศไทยแบบผิดกฎหมายมักจะมีจำนวนพอๆ กัน หรือ เท่ากันกับคนที่มาอย่างถูกกฎหมาย ไปต่อบัตร ต่ออายุ ทำเรื่องราวต่างๆ ก็ยังต้องมีการจ่ายเงิน จ่ายค่านายหน้า มีเรื่องของค่าอำนวยความสะดวก เพราะฉะนั้นในภาครัฐเองก็ต้องจัดการอะไรบ้างอย่าง ตามพรบ. อำนวยความสะดวกในการพิจารณา อนุญาตของทางราชการให้มีความสะดวกคล่องตัวมากขึ้น มีภาระน้อยลงก็เอามาใช้กับเรื่องแรงงานให้เกิดความชัดเจน ปัญหาส่วย สินบน ภาระเรื่องความยุ่งยากที่เขาว่ามาก็จะลดน้อยลง แต่มีอีกทางหนึ่งนะ เราไปแก้ปัญหาคอร์รัปชันที่กลุ่มชาติพันธุ์ที่คนเหล่านี้เกิดและเติบโตในประเทศไทยอยู่แล้ว เป็นคนที่มีคุณภาพอยู่แล้ว ให้เขาสามารถเคลื่อนย้ายเข้ามาทำงานในเมืองได้ อันนี้ก็เป็นอีกทางหนึ่งในการแก้ปัญหา ถือว่าเป็นการแก้ปัญหาไป 2 เปราะพร้อมๆ กัน แต่สิ่งที่เกิดขึ้นและกลายเป็นอุปสรรคก็คือว่ากลไกของรัฐ ระบบของรัฐ ที่ไม่เอื้ออำนวยและไปถูกแทรกไว้ด้วยมือที่มองไม่เห็น นั่นคือคอร์รัปชัน ส่วย สินบน ก็เลยทำให้เกิดปัญหาแรงงานผิดกฎหมายขึ้นมาจำนวนมากเพราะฉะนั้นวันนี้ถ้าเรายอมรับความจริง เรามาช่วยกันแก้ให้ถูกต้อง เรามาช่วยกันกำจัดคอร์รัปชัน ส่วย สินบนเสีย ทุกคนก็จะอยู่ด้วยกันอย่างมีความสุข ติดตามเรื่องราวขององค์กรต่อต้านคอร์รัปชันได้ที่ http://www.anticorruption.in.th/2016/th/ https://www.facebook.com/act.anticorruptionThailand/ https://youtu.be/xs_XqiDQtYg
