Despite the aftershocks of Politico obtaining and publishing a draft majority opinion that would overturn Roe v. Wade, monumental Supreme Court leaks have a history dating back centuries.Northwestern University Pritzker School of Law Professor Steven Lubet unpacks that tradition on the latest episode of Law&Crime's podcast "Objections: with Adam Klasfeld" and explains why he believes the chief shares some responsibility for what he calls the Supreme Court's "accountability-free zone."The Supreme Court is the only one in the United States never to have adopted a code of conduct, and it has remained silent in the face of controversies involving justices, on the left and right.In the episode, Lubet traces the development of the first U.S. judicial code of ethics to former President and ex-Chief Justice William Howard Taft, and he explains efforts after Watergate to make those guidelines mandatory, rather than aspirational. In this episode, Steven Lubet, Edna B. and Ednyfed H. Williams Memorial Professor of Law and Director of the Fred Bartlit Center for Trial Advocacy at Northwestern University Pritzker School of Law, discusses his book "Interrogating Ethnography: Why Evidence Matters," which is published by Oxford University Press. Lubet begins by describing ethnography and ethnographic research practices. He explains why he became concerned about the factual accuracy of some of the claims made by ethnographers, and how ethnographic research practices contributed to his concerns. He describes how he investigated claims made in a range of different ethnographic works, and uses evidentiary practices from litigation as a metaphor for how ethnographers could more effectively evaluate the factual accuracy of the evidence they gather. He points to several simple practices, like fact-checking witness accounts, that would increase accuracy. He closes by reflecting on the reception of his book by ethnographers. Lubet was raised in Georgia and received his undergraduate degree at the University of Florida before receiving his juris doctor from the University of Mississippi. He began his successful, inspiring career in 1974 as a personal injury defense attorney and then transitioned to practicing criminal law. In 1976, he set out to make a name for himself as president of his prosperous private practice, Lubet & Blechman, P.A. Throughout his legal career, Judge Lubet has presided over approximately 150 jury trials and currently is the most senior judge in the Ninth Circuit.
